AN ORDINANCE MANDATING THE SUBIDIVISION OWNERS

AND/OR DEVELOPER IN ANGELES CITY TO PROVIDE A


SUFFICIENT SPACE FOR THE ESTABLISHMENT OF
MATERIALS RECOVERY FACILITY TO STORE RECYCLABLES
AND PROCESS COMPOSTABLE MATERIALS OF THE
HOMEOWNERS.

Be it ordained by the Sangguniang Panlungsod of the Angeles City


Government in session duly assembled:

SECTION 1. Title. This Ordinance shall be known as “AN


ORDINANCE MANDATING SUBDIVISION
OWNERS/DEVELOPERS TO ESTABLISH THEIR RESPECTIVE
MRF”.

SECTION 2. Scope and Application. All owners and/or


developers of subdivisions within the territorial jurisdiction of Angeles
City.

SECTION 3. Definition of Terms. For purposes of this Ordinance


the following terms are hereby defined as follows:

a. Materials Recovery Facility – includes a solid waste transfer


station or sorting station, drop-off center, a composting
facility, and a recycling facility;

b. Composting – refer to the controlled decomposition of


organic matter by micro-organism, mainly bacteria and
fungi, into a humus-like product;

c. Recycling – shall refer to the treating of used or waste


materials through a process of making them suitable for
beneficial use and for other purposes, and includes any
process by which solid waste materials are transformed into
a new products in such a manner that the original products
may lose their identity, and which may be used as raw
materials for the production of other goods or services:
Provided, that the collection, segregation and re-use of
previously used packaging material shall be deemed
recycling under the Republic Act No. 9003.

d. Solid waste – refer to all discarded household, commercial


waste, non-hazardous institutional and industrial waste,
street sweepings, construction debris, agricultural waste,
and other non-hazardous/non-toxic solid waste.

e. Transfer stations – shall refer to those facilities utilized to


receive solid wastes, temporarily store, separate, convert, or
otherwise process the materials in the solid wastes or to
transfer the solid wastes directly from smaller to larger
vehicles for transport.

SECTION 4.

a. For existing subdivisions in Angeles City, all owners and/or


developers are mandated to provide a sufficient space for
the establishment of Materials Recovery Facility (MRF) to
store recyclables and process compostable materials of the
homeowners.

b. The Homeowners Association (HOA) shall assign personnel


to manage and operate the MRF.

c. The City Environment and Natural Resources Office


(CENRO) shall provide technical assistance in the operations
of the MRF.

d. For subdivision owners and/or developers who are planning


to put up a subdivision or any land development projects in
Angeles City, they shall incorporate the establishment of an
MRF in their subdivision lay-out plan.

e. The City Government thru the City Engineers Office, City


Planning and Development Office and other concerned
departments, shall ensure the establishment of MRF is
incorporated in the subdivision lay-out plan prior to
approval.

f. The Barangay Affairs and Public Assistance Center (BAPAC)


and Angeles City Liga ng mga Barangay are tasked to
ensure the proper implementation of this Ordinance and to
coordinate with CENRO and other agencies necessary in
implementing the same.

SECTION 5. Copies of this Ordinance shall be distributed to all


thirty-three barangay councils, and all concerned agencies and
offices.
SECTION 6. Separability Clause. If, for any reason, any
provision or part of this Ordinance shall be declared not valid by a
Court of competent jurisdiction or suspended or revoked by the
authorities concerned, such judgement shall not affect or impair the
remaining provisions, sections or parts which shall continue to be in
full force and effect.

SECTION 7. Applicability Clause. All other related matters not


specifically provided in this Ordinance shall be governed by the
pertinent provisions of existing applicable laws and ordinances.

SECTION 13. Effectivity Clause. This Ordinance shall take effect


after publication in a newspaper of general circulation.
