LAW 220: Land Law One
SEMINAR QUESTIONS
INSTRUCTIONS:

i. These are group questions although individual effort is


required.
ii. Each question carries 15 marks distributed to the participants
basing on their active participation both in preparation of work
and presentation of the same.
iii. No marks will be given to a student who absents
himself/herself from the presentation.
iv. Seminar questions are to be attempted by all students on each
stream, i.e. every group in every stream shall work on similar
questions, for example question one is to be attempted by
group one in stream A to D, similarly to the rest of the
questions.
v. Each group which is expected to present in a respective week
(preferably three groups per week) shall submit the printed
work every Monday and get prepared for oral presentation on
week days as schedule in the master time table.
vi. Leaders of streams may seek oral clarity in case of any need.
QUESTION ONE
Freehold system is a land tenure that was introduced by German
into Tanganyika territory. Discuss how the Government of TANU
preserved this system and how it abolished it.

QUESTION TWO
Discuss the relevance of these cases in land law:Mtoro Bin
Mwambav AG [1953]2 TLR 327&Muhena Bin Said v Registrar of
Title [1948]16 EACA 79.

QUESTION THREE
The Imperial Decree of 1895 and The Land Tenure Ordinance of
1923 were the foundation of legal framework on land law and they
were the best legislations ever seen. Critically discuss.

QUESTION EIGHT
Analyze the characteristics of freehold tenure and lease hold tenure
and explain how these tenures were adopted in colonies. Outline
the reasons behind the adoption both by British rulers and
independent Tanganyika.
