PLAINT
3. That, the Plaintiff’s claims against the defendant are for the orders that the
Defendant has breached the contract, payment of Tshs 200,000,000/= two
hundred millions being money payable to the plaintiff In respect of arreas of
rent due to the plaintiff and costs of this suit.
4. That, the plaintiff owns residential houses in temeke, kinondoni and ilala
district in dar-es-salaam region. Copies of the titles to these properties are
hereto annexed and marked as annextures “A”, “B”, “C” respectively. The

Plaintiff shall crave leave of this Honourable Court to refer it as part of this
plaint.
5. That, the plaintiff has rented the said properties to Tumaini University
College. A Copy of the agreement is hereto annexed and marked
‘ANNEXTURE D’ and the Plaintiff shall crave leave of this honorable Court
to refer to it as part of this Plaint.
6. That, the Defendant did not honor or discharge his obligations under the
agreement for neglecting or refusing to pay for the arrears of rent amounting
to 200,000,000/= two hundred Millions.
7. That the Plaintiff has for several times and occasions been demanding his
money from the Defendant through demand notes without success. A copy of
Demand note dated 16/2/2009 is hereto annexed and Marked as Annexture
‘E’, the Plaintiff shall crave leave of this Honorable Court.
8. That the Plaintiff owns residential houses in Temeke, Kinondoni and Ilala
District in Dar-es-salaam region and for Purposes of Pecuniary Jurisdiction
and Terrirorial Jurisdiction, the suit and the amount claimed squarely falls
within the Jurisdiction of this Court.
(c) Any other relief(s)that this honourable court may deem fit to grant.
