REQUEST FOR EXPRESSION OF INTEREST FOR THE CONSULTANCY SERVICES TO UNDERTAKE CONSTRUCTION SUPERVISION OF THE INTERIM INTERVENTION/
REHABILITATION OF THE KAMPALA – MALABA METER GAUGE RAILWAY LINE – CONSULTING FIRMS . PROC.REF.No. URC/CONS/2021-22/00148
1. Introduction:
Uganda Railways Corporation (URC) is a body corporate established
by the Uganda Railways Corporation Act, Cap 331 to Construct,
Operate and Maintain Railway, Marine and Road services both inside
and outside Uganda for the carriage of passengers and goods.
The Uganda Railways Corporation has allocated funds to be used for
the Procurement of Consultancy Services to undertake Construction
Supervision of the Interim Intervention/Rehabilitation of the Kampala
– Malaba Railway Line. URC now invites sealed expressions of
interest from eligible Consulting firms for the provision of the above
Consultancy Services.
The overall objective of the assignment is for the consultant to
supervise and monitor the physical progress and financial status of
the construction/rehabilitation works on behalf of Uganda Railways
Corporation with the objective of ensuring that the works are completed
on time, within budget while meeting engineering and safety standards.
The Consultant shall be shortlisted in accordance with the Public
Procurement and Disposal of Public Assets Regulations, 2014, and
the selection criteria set out in this notice.
2. Scope of the Assignment:
The Assignment shall comprise but not necessarily be limited to the
following tasks:
2.1 Check and establish that the contractor mobilizes and supplies to site
all plant, equipment and machinery that has been committed in the
tender and ensure that all such terms of plant remain on the contract
until their release has been authorised
2.2 Evaluate and approve the Contractors work programme, method
statement and material sources
2.3 Prepare quality assurance plan and make arrangements to check
the quality of materials brought to site, ensure that the quality of
construction is consistent with the specifications and maintain test
records
2.4 Assist the Contractor to establish a Quality Management System.
2.5 Check that all project documents are complete and accurate before
being issued to the contractor
2.6 Support the Client to prepare for and facilitate a pre-construction
meeting with the works contractor. Cary out quality audits of materials
and works at regular intervals
2.7 Develop Key performance Indicators and a work plan to monitor all
aspects of the quality of the works as well as environment and social
management plan to be reported on a monthly basis
2.8 Be responsible for all administration work related to the project
supervision requirements including proper conduct, attendance and
performance of duties of the staff
2.9 Approve and/or issue working drawings, approve the setting out of the
works and give appropriate instructions to the Contractor
2.10
Prepare Engineers Instructions (EI) and Variation Orders (VO)
as recommended or necessary, complete with the associated
measurement and payment instructions,
2.11 Make and maintain continuous accurate records and measurement
throughout the duration of the project to facilitate agreements on the
Contractor”s final account.
2.12 Prepare and submit the Final Completion Report (FCR)
3. Performance Period:
The exercise shall be undertaken in a period not exceeding sixteen (16)
months comprising a construction/rehabilitation period of ten (10)
months and a defects liability period of 6 months.
4. The Consultant’s staffing, qualifications and Experience:
The key staff positions listed below are considered essential and will
be the basis for the evaluation of the consultant’s proposed staffing.
Experience of the firm in at least two assignments of a similar nature in
the last 10years, fluency in the English language and registration with
the relevant professional bodies (for the key staff) will be considered
essential
i) Resident Engineer/Team Leader (Registered) – Relevant Bachelor’s
Degree in Engineering with 15 years experience in leading and
managing roads/Railway construction projects and 10 years’
demonstratable experience in contract management specifically in
measurement and claims management
ii) Materials Engineer (Registered) – with a relevant Bachelor’s Degree
or equivalent. 15 years relevant experience in leading material
testing and investigations on roads and/or rail projects and ten years
experience in preparation of quality management/assurance plans and
undertaking quality audits
The Following Non Key Staff shall be required;
(a). Survey Assistants (2No) – Diploma in Survey (minimum) and 6 years
experience in roads construction and/or rehabilitation projects
(b). Laboratory Technicians (2No) – Higher Diploma in Civl Engineering
and 6 years specific experience in laboratory material testing and field
material investigations and testing
(c). Works Inspectors (2No) with a higher Diploma in Civil
Engineering(minimum) and 6 years experience in the supervision of
Railway maintenance or rehabilitation works
5. Candidature
Only Consulting firms, Consortiums, Joint ventures or Associations of
firms may apply. The Consortium, Joint venture or Association may be
permanent or a temporary grouping, legally established for the specific
purpose of this tender procedure. All members of the Consortium,
Joint Venture or Association shall be jointly and severally liable to the
Procuring and Disposing Entity. The participation of an ineligible party
will result in automatic disqualification
6. Number of Applicants
No more than one application can be submitted by a party or firm
whatever the form of application (as an individual firm or member of
a Consortium, Joint Venture, Association). In the event that a party
submits more than one application, applications in which that person
has participated will be excluded.
7. Code of Ethical Conduct.
As part of the application, applicants must submit a signed Code of
Ethical Conduct for Bidders issued as per Guideline 4/2014 of the PPDA.

8. Number of applicants to be shortlisted.
The shortlist shall to the extent possible, have six (6) Consultants.
9. Selection Criteria.
The following Criteria will be applied.
(1). Eligibility of the Consultant.
This is to be evidenced by submission of the following documents as part
of the application.
• A Notarized or certified copy of the Trading Licence for 2021 or its
equivalent.
• A Notarized or certified copy of the Certificate of Registration of the
Consultant or its equivalent.
• A signed statement indicating that the Consultant does not have a
conflict of interest in the subject of the procurement.
• A copy of the Consultant’s annual Tax Clearance Certificate for the
previous financial year, or a transaction Tax Clearance for the year
2021 addressed to Uganda Railways Corporation for the purpose of
this procurement.
• A Power of Attorney of the authorised signatory to the proposal
registered with the Uganda Registration services Bureau.
Firms that are registered with PPDA on the register of providers
shall not be required to submit a Trading Licence or Certificate of
Registration, but shall be required to provide evidence of registration
by PPDA for the year 2021.
Where the business of a Consultant is not registered in Uganda and a
document required to evidence eligibility is not available in the country of
the Consultant, the Consultant shall submit an alternative document or a
statement affirming that the document is not available in the country of the
Consultant.
For a Joint venture, Consortium, or Association, the documents to
evidence eligibility, shall be required for each member of the Joint Venture,
Consortium or Association and the following additional documents shall be
required:
a). A certified copy of the Joint Venture, Association or Consortium
agreement which is legally binding on all parties/partners, showing:
i. All parties/partners, Associates shall be jointly and severally liable for
the execution of the contract in accordance with the Contract terms;
ii. One of the parties, partners or Associates will be nominated as being in
charge, authorised to incur liabilities, and receive instructions for and
on behalf of any and all partners of the joint venture, association or
consortium; and
iii. The execution of the entire Contract, including payment, shall be done
exclusively with the party, partner or associate in charge.
iv. A Power of Attorney from each of the parties to the JV/Association
authorising the formation and/or entering into the JV
b). Power of Attorney (notarized/certified if copy) of the signatory(ies) of
the bid authorising signature of the bid on behalf of the Joint Venture,
Consortium or Association.
2. Technical Capacity.
The Consultant shall possess the required staff with qualifications and
experience as defined in 4 above.
If more than six eligible Consultants meet the above criteria, the relative
strength and weaknesses of their application shall be re-examined to
identify the best six applications for the tender procedure. The factors
which will be considered during this re-examination are:
The number of similar assignments shall be evidenced by copies of
reference letters or recommendations from Clients related to specific
assignments.
10. Submission of Applications
Applications should be in English, clearly marked “Expression of
Interest to Provide Consultancy Services for the Interim Intervention/
Rehabilitation of the Kampala – Malaba Railway Line,’’ indicating
the procurement reference number and the name of the applicant and
be submitted at the address below by Friday 12th, November 2021 at
3:00pm.
