PATENTS

o A patent is a set of exclusive rights granted


by a state to an inventor or his assignee for
a fixed period of time in exchange for a
disclosure of an invention.

o The procedure for granting patents, the


requirements placed on the patentee and
the extent of the exclusive rights vary
widely between countries according to
national laws and international
agreements.

Non-Patentable Inventions
o Any invention which is contradictory to well established
natural laws
o Those inventions which are injurious to public health or
violate public morality or public interest.
o New method of agriculture or horticulture
o A process of treatment of human beings, animals or plants
o The mere discovery of scientific principles or the formulation
of an abstract theory (e.g.- theory of relativity)
o A substance obtained by a mere admixture resulting only in
the aggregation of the properties of the components thereof
or a process for producing such substance.
Non-Patentable Inventions
o The mere arrangement or rearrangement or duplication of known devices
each functioning independently of one another in a known way
o Scientific theories or mathematical methods
o Schemes, rules or methods, such as those for doing business, performing
purely mental acts or playing games
o Plants & animals other than micro-organism
o An invention which in effect, is traditional knowledge or which is an
aggregation or duplication of known properties of traditionally known
component or components.
o Inventions related to atomic energy, on the ground of national security.
o Things already existed in nature (patent not given for discovery of new
planet)
o Guillotine
