AMENDING PRESIDENTIAL PROCLAMATION NO. 121, SERIES OF 1955, AND


RESERVING LOT 843-B OF THE CADASTRAL PLAN OF ZAMBOANGA CITY,
COVERED BY TCT NO. T-10,936, OF THE PRIVATE DOMAIN OF THE
GOVERNMENT SITUATED IN THE CITY OF ZAMBOANGA, FOR PUERICULTURE
CENTER PURPOSES, AND FOR THE BENEFIT, USE, AND ADMINISTRATION  OF
THE ZAMBOANGA PUERICULTURE CENTER ORGANIZATION NO. 144, INC. FOR
ALL ITS OBJECTIVES AND PUROSES.

WHEREAS, under Act No. 2633 of 1916, the State has adopted a policy of encouraging
works for the protection of early infancy in the local government units;

WHEREAS,  under Section 4 of Act No. 2988 of 1921, for the purpose promoting the
protection of early infancy in the local government units, the State has mandated the
establishment and maintenance of Maternity Hospitals, Puericultural institutions, dispensaries,
hospitals, and other establishments for the care of children;

WHEREAS, Department Order No. 10, dated July 29, 1921, issued by the Secretary of
the Department of the Interior, entitled: INSTRUCTIONS CONCERNING THE WORKS
RELATED TO MATERNITY, CHILD HYGIENE AND WELFARE, in order to promote and
implement the policy of the law for the protection of early infancy and childhood, authorized the
creation of institutions in the local government units to be known as Puericulture Centers;

WHEREAS, under the said Department Order No. 10, the Puericulture Centers for the
local government units were constituted into corporate entities whose By-Laws declared among
their purposes (1) the protection of infancy and childhood and guidance of the women towards a
sound and intelligent motherhood and (2) the establishment of mutual cooperation between 
public & private organizations working for social betterment;

WHEREAS, pursuant to the declared policy and declared instructions above-stated, as


early as October 1917, the CENTRO DE PUERICULTURA DE ZAMBOANGA with
Registration Number P.W.C. Center No. 144 was organized and which, through 100 years of
existence, has evolved into what is now the ZAMBOANGA PUERICULTURE CENTER
ORGANIZATION NO. 144, INC., duly registered with the Securities and Exchange
Commission, as non-stock, non-profit, charitable institution, which include among its purposes
all the mandated purposes of the Puericulture centers;

WHEREAS, on February 26, 1955, then President Ramon Magsaysay, issued


PRESIDENTIAL PROCLAMATION NO 121, RESERVING FOR CERTAIN SPECIFIC
PUBLIC PURPOSES CERTAIN PROPERTIES OF THE PRIVATE DOMAIN OF THE
GOVERNMENT SITUATED IN THE CITY OF ZAMBOANGA, which included, among
others, LOT 843-B, of the cadastral plan of Zamboanga City, for the exclusive use of the
Zamboanga Puericulture Center Org. No. 144, Inc. under the administration of Zamboanga City,
and which Lot 843-B, containing an area of 7,573 sq. m., more or less, is now covered

by Transfer Certificate of Title No. T-10,396, of the Register of Deeds of Zamboanga City
issued on May 30, 1969, and registered under the name of the Republic of the Philippines;

WHEREAS,   Zamboanga Puericulture Center Organization No. 144 Inc. uses a major


portion of Lot 843 for the Puericulture Maternity Lying-in Hospital, early childhood and
elementary education school, school of allied medicine, office and laboratory spaces and for its
livelihood program to help generate funds for its operations;

WHEREAS, under Section 12 of Article II of the 1987 Constitution, it is the declared


policy of the State to recognize the sanctity of family life; protect and strengthen the family as a
basic autonomous social institution; protect the life of the mother and the life of the unborn from
conception and under Section 11 of Article XIII, it is likewise the policy of the State make health
and other social services available to the people at affordable cost, giving priority for the needs
of, among others, the under-privileged, women, and children - policies which are sub-served by
the purposes of Zamboanga Puericulture Center above-stated;

WHEREAS, the Zamboanga Puericulture Center Organization No. 144, Inc. does not
receive subsidies from the government and in order to better sustain its services to the people of
Zamboanga and its environs, it needs a stable and increasing source of funds, especially in view
of ever increasing cost of maintaining the operation of the maternity hospital and its allied
facilities;

WHEREAS, the Zamboanga Puericulture Center Organization No. 144, Inc. has marked
its centennial or 100 years of existence in the service of the people since it’s founding in October
1917;

NOW, THEREFORE, I, RODRIGO ROA DUTERTE, pursuant to the authority vested in


me by law as President of the Philippines, and upon the recommendation of the Secretary of
Environment and Natural Resources, do hereby amend and modify Presidential Proclamation
No. 121 Series of 1955, signed by then President RAMON MAGSAYSAY, and hereby
withdraw from sale or settlement and reserve for all the purposes of the ZAMBOANGA
PUERICULTURE CENTER ORGANIZATION NO. 144, INC., that certain parcel of land
known as LOT 843-B of the Cadastral Plan of Zamboanga, of the private domain of the
Government situated in the City of Zamboanga and registered under Transfer Certificate of Title
No. T-10,936 of Registry of Deeds of Zamboanga City in the name of the Republic of the
Philippines, for the all the objectives, purposes, benefit, and exclusive possession, use,
enjoyment, and administration, of the Zamboanga Puericulture Center Organization No. 144,
Inc., Provided: That, for the purpose of sustaining its operations, Zamboanga Puericulture Center
Organization No. 144, Inc. may use any portion of the said property for raising or generating
funds or income by carrying out therein any legitimate livelihood or business activities, either on
its own initiative or in cooperation, partnership or other arrangements with private persons or
legitimate business entities under reasonable terms and conditions as the Board of Trustees may
determine. Provided, further, that the Zamboanga Puericulture Center Organization No. 144, Inc.
shall not sell, mortgage, convey or dispose any portion of the said property or any part thereof.
Provided, finally, that all the provisions of Proclamation No. 121, Series of 1955, inconsistent
herewith insofar as Lot 843-B is concerned are hereby deemed amended modified and
accordingly rendered of no effect.

IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the
