Sub: Constitution of Committee of Experts - Notice inviting applications

In pursuance of the scheme issued vide No. 011/VGL/094 dated 22.12.2014


(copy enclosed), the Commission proposes to constitute a Committee of Experts
for scrutinising the proposals of sanction for prosecution received in the
Commission for reconsideration from the Ministries / Departments.

Persons fulfilling the eligibility conditions and willing to be empanelled in


the Committee of Experts as per the terms & conditions laid down in the scheme
may submit their applications in the prescribed proforma addressed to the
Secretary, Central Vigilance Commission, Satarkta Bhawan, Block-A, GPO
Complex, INA, New Delhi-110023, latest by 19.01.2015. Applications received
after due date shall not be considered.

Sub: Scheme for enlisting of experts for scrutiny of prosecution sanctions by the
Commission

The Central Vigilance Commission tenders advice in respect of officers in cases in


which the sanction is required to be issued in the name of the President wherein the Central
Bureau of Investigation or any other Investigating Agency has recommended/sought sanction
for prosecution under PC Act, 1988. The DoPT OMs No. 134/2/85-AVD-I dated 17.10.1986
and 06.11.2006 provide the procedure to be followed in processing matters of sanction for
prosecution. In cases in which an authority other than the President is competent to sanction
prosecution and that competent authority does not propose to accord such sanction, are also
required to be reported/referred to the Commission alongwith the tentative views of the
competent authorities for resolution of difference of opinion as per extant procedure. In both
the above categories of cases, the Commission tenders advice to the concerned
Ministry/Department/Organisation. However, the Ministry/Department concerned sometimes
refer the case to the Commission for reconsideration of its advice tendered.

2. In order to examine such reconsideration proposals received and to assist the


Commission in arriving at a conclusion, a Committee of Experts in accordance with the
guidelines issued by the Department of Personnel & Training OM No. 399/33/2006-AVD-III
dated 06.11.2006 is envisaged. Accordingly, the Commission proposes to engage 6-8 persons
for empanelment as experts as per the following scheme:-

Eligibility

 Retired persons having held the position of Secretary or Additional Secretary to


the Government of India or equivalent and CMD or Managing Director/CEO or
whole time Director on the Board of Public Undertakings, Banks, and Insurance
companies shall be eligible for empanelment as experts.
 Should possess sufficient knowledge and experience in matters like vigilance and
investigation, criminal law, public administration, finance including banking &
insurance, tender & procurement etc.
 The age of the experts shall not exceed 70 years as on date of empanelment.
 Should be preferably residing in Delhi/Delhi-NCR region.

Selection method

 A Notice inviting application from eligible persons will be published on


Commission’s website.
 After due scrutiny and verification of the applications and documents by the
Commission, the applicants will be shortlisted for empanelment by the
Commission.
Terms & conditions

 The tenure of experts shall be of two years, extendable for a further period of upto
two years.
 The experts shall be provided a fee on per sitting basis at the rate of Rupees Five
Thousand only or as prescribed by the Commission from time to time.
 The experts will be provided secretarial assistance by the Commission as per
requirement.
 The experts will be provided fare, transport and accommodation as per their
entitlement in previous employment.
 The experts shall be required to give an undertaking regarding their conflict of
interest in any case/matter and to recuse themselves from the proceedings in such
a situation.

Procedure

 One of the Vigilance Commissioners will be the Chairperson of the Committee to


examine the reconsideration proposals of sanction for prosecution received.
 The Vigilance Commissioner will be assisted by two experts selected from the
panel.
 The date and venue of the meeting will be intimated to the experts in advance.
 The experts will also be provided input materials in advance for study.
 They will examine and scrutinise the proposal as referred to them and submit their
recommendation to the Commission expeditiously.
