“An Act Provision will be set for equal and just rights for all the People With Disability or the PWD’s Member.”
Section 1: PWD's Equal Working Rights
Section 2: Giving PWDs enough rights to work at companies that they really want to help their families and gain more work experience that will help them when they are looking for work. Section 3: The HUMSS Bill No.001 will ensure that our PWDs have the opportunity to work and exercise their talents and abilities. This Bill also provides for less discrimination on the part of PWDs in all aspects of their lives, particularly in the workplace. Section 4: The opportunity to fully participate in mainstream society by granting them at least a 20% discount exemption from value added tax on the sale of certain goods and services identified under republic act no: 9442 for the exclusive use, enjoyment, or availment of persons with disabilities It is the state's declared policy to support the improvement of well-being and integration into mainstream society of persons with disabilities. Section 5: A donation, bequest, subsidy, or financial aid made to government agencies engaged in the rehabilitation of disabled persons and organizations of disabled persons shall be exempt from the donor's tax subject to the provisions of Section 94 of the National Internal Revenue Code (NIRC), as amended, and shall be allowed as deductions from the donor's gross income for purposes of computing the taxable income subject to the provisions of Section 29 (h) of the Code. (b) Donations from foreign countries are free from import taxes and duties, subject to the requirements of Section 105 of the Tariff and Customs Code of the Philippines, as amended, Section 103 of the NIRC, as amended, and other relevant laws and international agreements. (c) Local manufacturing of technical aids and appliances used by disabled people will be considered a favored sector of investment, subject to the provisions of the Executive Order. Order No. 226, also known as the "Omnibus Investments Code of 1987," and as such, shall enjoy the rights, privileges, and incentivesThe Convention on the Rights of Persons with Disabilities, which was adopted in 2006 and came into force in 2008, signaled a "paradigm shift" away from traditional charity-based, medical-based approaches to disabilities and toward one based on human rights. Section 6: For the first violation, a fine of not less than 85,000.00 (eighty five thousand pesos) but not exceeding (P125,000.00) one hundred twenty five thousand pesos or imprisonment for not less than nine months but not more than three years, or both at the discretion of the court, and for any subsequent violation, a fine of not less than P125,000.00 but not exceeding P225,000.00 or imprisonment for not less than nine months but not more than three years, or both at the discretion of the court. Any person who abuses the privileges given herein shall face imprisonment for not less than eight months or a fine of not less than 8,000 pesos (P8,000.00) but not more than 70,000 pesos (P70,000.00), or both, at the discretion of the court.
