THE BRIDGE AND ROAD TUNNEL SAFETY

MINISTER OF PUBLIC WORKS AND HOUSING


OF THE REPUBLIC OF INDONESIA,

Considering : a. in order to improve the implementation and development of the


bridge and road tunnel safety, special handling is required for
the bridge and road tunnel safety;

b. in order to increase bridge and tunnel reliability and to


accommodate technological developments, the participation of
experts in the field of bridges and tunnels is required;
c. based on the considerations as referred to in letters a and b, it is
necessary to stipulate a Regulation of the Minister of Public
Works and Housing of the Republic of Indonesia on the Bridge
and Tunnel Safety Commission;

Observing: 1. Government Regulation Number 15 of 2005 on Toll Roads (State

Number 4489) as last amended by Government Regulation
Number 43 of 2013 (State Gazette of the Republic of Indonesia

2. Government Regulation Number 34 of 2006 on Roads (State
Gazette of the Republic of Indonesia of 2006 Number 86,
Supplement to the State Gazette of the Republic of Indonesia
Number 4655);
3. Presidential Regulation Number 7 of 2015 on the Organization
of State Ministries (State Gazette of the Republic of Indonesia of

HAS DECIDED:

To Issue: REGULATION OF THE MINISTER OF PUBLIC WORKS AND HOUSING OF


THE REPUBLIC OF INDONESIA ON BRIDGE AND ROAD TUNNEL
SAFETY.
CHAPTER I

GENERAL PROVISIONS

Article1

In this Ministerial Regulation:

1. A bridge is a road located above the water level and/or above the ground level.

2. An arch bridge is a bridge with a semicircular structure and both of its ends
rest on abutments.

3. A cable-stayed bridge is a structure that has a row of straight cables and


supports rigid horizontal elements (beams, frames, or boxes). A cable-stayed
bridge consists of a structural system of continuous girders supported cables
that are installed at an angle and connected to pylons as the main support.

4. A suspension bridge is a bridge whose deck is suspended from vertical


suspender cables (hangers).

5. A road tunnel is a road that is located underground and/or in water.

6. Inventory Inspection is an inspection carried out to register all physical details


of bridges and road tunnels, namely length, width, construction type, traffic
function and so on and is carried out only once during the life of the bridge or
road tunnel.

7. Routine Inspection is an inspection that is carried out annually to ensure that


nothing unexpected happens and to check that routine maintenance is being
carried out effectively.

8. Detail Inspection is an inspection carried out to determine the condition of


bridges and road tunnels and their elements in order to prepare a handling
strategy for each individual bridge or road tunnel and to make a priority order
of bridges and road tunnels according to the type of handling.

9. Special inspection is an inspection carried out when the detailed inspection is


unclear or cannot accurately analyze the damage and its implementation
requires certain tools.
10. Routine maintenance is the activity of maintaining and repairing minor/simple
damages that occur to the bridge or road tunnel structure in order to obtain
the optimal condition so that it reaches the calculated design service life and
follows the applicable (laws and) regulations.

11. Periodic maintenance is an activity to deal with any damage that was taken into
account during the design process so when there is deterioration it can be
returned to its optimal condition according to the plan.

12. Rehabilitation of bridges and road tunnels is the act of repairing bridges or road
tunnels whose condition has deteriorated (stiffness, strength, soil/structure
stability, service life) so that the condition of bridges and road tunnels becomes
better.

13. An emergency action plan is a plan that provides instructions for emergency
action or action that is carried out in a hazard-prone area in the event of a
bridge or road tunnel collapse.

14. Special and non-standard traffic loads are traffic loads with axle configurations
and total tonnage outside of the standard rules for bridge and road tunnel
loading in Indonesia.

15. The owner of a bridge and road tunnel is an agency or legal entity that is
responsible for the assets of the bridge and road tunnel in accordance with its
authority based on the applicable laws and regulations.

16. The constructor of a bridge and road tunnel is a government agency, legal entity
or individual responsible for the operation of the bridge and road tunnel during
construction.

17. The manager of a bridge and road tunnel is a government agency, legal entity,
or individual who is responsible or given responsibility for the operation of the
bridge and road tunnel during the service life of the bridge.

18. Independent Inspectors are a group of experts or individual professional experts


in a particular field of knowledge from academics and practitioners who are
tasked with providing considerations regarding the safety of bridges or road
tunnels and in charge of supporting the Constructors or Managers of bridges
or road tunnels.
19. Bridge and road tunnel expert is an individual professional expert in the field
of bridges and road tunnels from academics and practitioners who are tasked
with providing considerations regarding the safety of bridges or road tunnels.

20. Bridge and road tunnel professional (expert) is an individual or a group of


individuals who are recognized as experts and experienced in the field of bridges
or road tunnels and provide planning, construction, and supervision services
for the construction of bridges or road tunnels.

21. The Bridge and Road Tunnel Safety Commission is an agency tasked with
assisting the Minister in carrying out the safety of bridges and road tunnels.

22. The technical implementing unit for bridge and road tunnel safety is a unit
formed to provide technical support to the Bridge and Road Tunnel Safety
Commission.

23. Minister is the Minister who carries out Government affairs in the field of Public
Works.

Article 2

Purpose, Objective, and Scope

(1) Safety regulation of bridges and road tunnels is intended to realize the orderly
operation of bridges and road tunnels which includes the stages of technical
planning, implementation/construction, management and maintenance to fulfill
the serviceability and improve the reliability of bridges and road tunnels, so as to
prevent or at least reduce risks of buildings/construction failure of bridges and
road tunnels.
(2) Safety regulation of bridges and road tunnels aims to maintain the function of
road bridges and tunnels as well as provide guarantees for the safety of bridges
and road tunnels and the public protection for their property around the bridge
and road tunnel from the potential risk of building failure.
Article 3

The scope of bridge and road tunnel safety regulation is the regulation of the
operation of bridges and road tunnels which includes:

a. Criteria and Conception of Bridge and Road Tunnel Safety;


b. Procedures for Operation, Maintenance and Monitoring of Bridges and Road
Tunnels;
c. Procedures for Evaluation and Assessment of Bridge and Road Tunnel Safety;
and
d. Inspection Procedures for Bridges and Road Tunnels.

CHAPTER II

CRITERIA AND CONCEPTION OF BRIDGE AND ROAD TUNNEL SAFETY

Part One

Classification of Bridges and Road Tunnels and Permit Application Process

Article 4

(1) Bridges and Road Tunnels regulated in this Ministerial Regulation include:
a. bridges with a span of at least 100 m;
b. arch bridges with a span of at least 60 m, suspension bridges and cable-
stayed bridges;
c. bridges with a total length of at least 3,000 m;
d. bridges with pillar heights above 40 m;
e. road tunnels with a closed section length of at least 200 m;
f. road tunnels that use drilling/jacking methods in their construction; and
g. bridges and road tunnels that have high structural complexity or have high
strategic value or are designed using new technology.
(2) The constructor and managers of bridges and road tunnels as referred to in
paragraph (1) must obtain approval from the Minister in the event that:
a. granting design approval, which includes:

1) construction execution;
2) changes of principle nature that affect the condition of the structure; and
3) rehabilitation design and rehabilitation permit;

b. approval of bridge and road tunnel functionality; and


c. approval of other activities that may affect the safety of the bridge and road
tunnel structures.
(3) Regulations for Bridges and Road Tunnels other than those referred to in
paragraph (1) are in accordance with the applicable laws and regulations.

Article 5

(1) The implementation of bridge and road tunnel safety is carried out based on the
concept of road bridge and tunnel safety and the rules of bridge and road tunnel
safety contained in the applicable Norms, Standards, Guidelines and Criteria
(NSPK).
(2) The concept of bridge and road tunnel safety as referred to in paragraph (1)
includes 3 (three) things, namely:
a. structural safety;
b. operation, monitoring, maintenance including user safety factors; and
c. emergency preparedness.

Part Two

The Implementers of Bridge and Road Tunnel Safety

Paragraph 1

General

Article 6

The implementers of bridge and road tunnel safety are:

1. Bridge and Road Tunnel Safety Commission;


2. Bridge and Road Tunnel Constructor; and
3. Bridge and Road Tunnel Manager.
Paragraph 2

Bridge and Road Tunnel Safety Commission

Article 7

(1) The Bridge and Road Tunnel Safety Commission as referred to in Article 6 is
based in Jakarta.
(2) The Bridge and Road Tunnel Safety Commission is non-structural, under and
directly responsible to the Minister.
(3) The organizational structure of the Bridge and Road Tunnel Safety Commission
consists of:
a. chairperson concurrently member;
b. secretary concurrently member; and
c. members.
(4) The position of the Chairperson of the Commission as referred to in paragraph
(3) letter a is held by the Director General of Highways.
(5) The position of the Secretary of the Commission as referred to in paragraph (3)
letter b is held by the Director of the Bridge.
(6) The members as referred to in paragraph (3) letter c consist of representatives of
government agencies, professionals and practitioners related to bridges and road
tunnels.
(7) When technical considerations are required, the Bridge and Road Tunnel Safety
Commission may appoint bridge and road tunnel experts.
(8) In carrying out its duties, the Bridge and Road Tunnel Safety Commission is
assisted by the Technical Implementation Unit for Bridge and Road Tunnel
Safety.
(9) The Technical Implementation Unit for Bridge and Road Tunnel Safety as
referred to in paragraph (8) is tasked with providing technical support for bridge
and road tunnel safety.
(10) The organizational structure and membership of the Bridge and Road Tunnel
Safety Commission and the technical implementing unit for Bridge and Road
Tunnel safety as referred to in paragraph (3) and paragraph (8) shall be
determined by the Minister.

Article 8

(1) The Bridge and Road Tunnel Safety Commission organizes bridge and road tunnel
safety by assisting the Minister in handling road bridge and tunnel safety.
(2) In order to assist the Minister as referred to in paragraph (1), the Bridge and Road
Tunnel Safety Commission is tasked with:
a. conducting an assessment of the bridge and road tunnel safety evaluation
carried out by the constructors or managers of bridges and road tunnels;
b. providing recommendations on the bridge and road tunnel safety; and
c. carrying out bridge and road tunnel inspections.
(3) The assessment as referred to in paragraph (2) letter a is carried out in a
discussion session attended by the Bridge and Road Tunnel Safety Commission,
Bridge and Road Tunnel Owners, Bridge and Road Tunnel Constructors or
Managers, and related Service Providers.
(4) Provision of recommendations regarding the bridge and road tunnel safety as
referred to in Article 4 paragraph (2) letter b is submitted to the Minister.
(5) Bridge and road tunnel managers are required to carry out routine and periodic
inspections of bridges and tunnels.
(6) The bridge and road tunnel managers as referred to in paragraph (2) shall report
the results of the bridge and tunnel inspection to the Bridge and Road Tunnel
Safety Commission.
(7) The Bridge and Road Tunnel Safety Commission shall carry out the inspection
as referred to in paragraph (2) letter c, in the event that:
a. The results of inspection report of the Bridge and Road Tunnel Manager or the
community report indicate that it is necessary to carry out an inspection by
the Bridge and Road Tunnel Safety Commission;
b. request of the Constructor or Manager of the bridge and road tunnel; and/or
c. If necessary, the Bridge and Road Tunnel Safety Commission can conduct
random inspections to ensure the safety of built bridges and road tunnels.
Paragraph 3

Bridge and Road Tunnel Constructors and Managers

Article 9

(1) The bridge and road tunnel constructor carries out the construction of
Bridges and road tunnels by:
a. Preparing a safe design;
b. Carrying out construction in accordance with the design and NSPK;
c. evaluating the bridge and road tunnel safety; and
d. having an emergency preparedness plan.

(2) The bridge or road tunnel manager organizes the bridge and road tunnel
management by:
a. carrying out monitoring, operation and maintenance;
b. Evaluating the bridge and road tunnel safety; and
c. managing emergency preparedness.

Article 10

The design of safe bridges and road tunnels as referred to in Article 9 is made based
on the conception of bridge and road tunnel safety and NSPK.

CHAPTER III
PROCEDURES FOR OPERATION, MAINTENANCE AND
MONITORING OF BRIDGES AND ROAD TUNNELS
Part One

General

Article 11

(1) The Bridge and Road Tunnel Manager is responsible for the operation and
maintenance of bridges and road tunnels.

(2) The operation and maintenance of bridges and road tunnels as referred to in
paragraph (1) shall be carried out with reference to the bridge and road tunnel
management plan.
(3) The bridge and road tunnel management plan as referred to in paragraph (2)
contains guidelines for the operation and maintenance of bridges or road tunnels
which at least includes:
a. monitoring procedures;
b. bridge and road tunnel operation procedure; and
c. road bridges and tunnel maintenance procedures.
(4) The guideline as referred to in paragraph (3) also contains a description of:
a. operation and maintenance organization and its duties and functions:
b. the relationship of the operation and maintenance organization with other
related organizations;
c. staff training requirements;
d. reporting;
e. documentation system; and
f. updates.

Article 12

The guideline as referred to in Article 11 paragraph (3) is reviewed and evaluated at


least 1 (one) time in 5 (five) years by the bridge or road tunnel manager.

Part Two

Bridge and Road Tunnel Operation

Article 13

The bridge and road tunnel operation is the regulation of the use of bridges and road
tunnels based on the capacity and traffic load.

Article 14

(1) Bridge and road tunnel operation is carried out under the following operating
conditions:
a. normal operations;
b. special and non-standard traffic load operations; and
c. emergency operations.
(2) Normal operations as referred to in Article (1) letter a, are carried out by
monitoring the traffic passing through the bridge or road tunnel as well as traffic
under the bridge or above the road tunnel.
(3) Special and non-standard traffic loads operations as referred to in Article (1) letter
b, are carried out by performing initial inspection first and processing the permit
procedure in accordance with applicable (laws) and regulations.
(4) The emergency operations as referred to in Article (1) letter c, are carried out in
emergency situations so that it is necessary to close part or all of the traffic on
the bridge or road tunnel, prepare alternative routes and safeguard the
environment around the bridge or road tunnel.

Article 15

(1) In the event of extraordinary situations, the operation of road bridges and tunnels
and their auxiliary structures is prioritized for the purpose of bridge and road
tunnel safety.
(2) The situations as referred to in paragraph (1) include but are not limited to:
a. big flood;
b. earthquakes;
c. landslides;
d. fire; and/or
e. other situations that threaten the bridge and road tunnel safety.

Part 3

Bridge and Road Tunnel Maintenance

Article 16

(1) The maintenance as referred to in Article 11 paragraph (3) letter c is carried out
with the following activities:
a. preventive maintenance carried out to prevent undue deterioration of quality
or prevent damage to bridges or road tunnels;
b. rehabilitation in the form of capacity building or strengthening; and/or
c. emergency maintenance, outside the planned schedule, carried out to repair
any damage that occurs.
(2) Preventive maintenance as referred to in paragraph (2) letter a is carried out
routinely and periodically in accordance with the maintenance program to extend
the service life of bridges and road tunnels and avoid unexpected repairs.
Part Four

Bridge and Road Tunnel Monitoring

Article 17

(1) Bridge and road tunnel monitoring as referred to in Article 11 paragraph (3) letter
a is carried out:
a. During the construction of bridges and road tunnels; or
b. Operation and maintenance phase of bridges and road tunnels.
(2) The bridges and road tunnel monitoring as referred to in paragraph (1) is carried
out with the aim of:
a. finding out early on the possibility of behavioral deviations of bridges and road
tunnels or the existence of problems that are developing; and
b. so that behavioral deviations or problems that are developing in bridges or
road tunnels can be handled quickly and appropriately before they develop
into a real threat to the bridge and road tunnel safety.

Article 18

The bridge and road tunnel monitoring as referred to in Article 17 paragraph (1) is
carried out by:

a. Observation and measurement of bridge geometry and the environment around


the bridge;
b. Inspection of the bridge and road tunnel condition; and/or
c. Functionality test of bridges and road tunnels.

Article 19

(1) Observations and measurements of bridge geometry and the influential


environment around the bridge as referred to in Article 18 paragraph (1) are
carried out, among others, on the middle span of the bridge deck, bridge pillar
heads, pylon heads, cables and bridge abutments.
(2) The influential environment around the bridge as referred to in paragraph (1) is
the environment at the farthest radius of 100 meters from the bridge.
(3) Observation and measurement of bridge geometry as referred to in paragraph (1)
is intended to determine indications of bridge behavior.
(4) The frequency of observations and geometric measurements is determined by
taking into account:
a. bridge type;
b. bridge condition;
c. bridge age; and
d. the importance level of the bridge in accordance with the operating and
maintenance guidelines.

Article 20

(1) The inspection of the bridge and road tunnel condition as referred to in Article 18
letter b is carried out on the structure of the bridge or road tunnel and other road
buildings as well as the watershed around the bridge.
(2) The inspection as referred to in paragraph (1) consists of:
a. Inventory inspection;
b. Routine inspection;
c. Detailed inspection; and
d. Special inspection;
(3) The inventory inspection as referred to in paragraph (2) letter a is carried out for
the first time on bridges and road tunnels right when they are newly constructed.
(4) The inventory inspection as referred to in paragraph (2) letter a is carried out to
obtain:
a. administration data;
b. geometry data;
c. material data;
d. general conditions;
e. traffic capacity; and
f. load capacity.
(5) The routine inspection as referred to in paragraph (2) letter b is carried out every
year to ensure that the bridge and road tunnel is in a safe condition and to
determine the need for emergency action.
(6) The detailed inspection as referred to in paragraph (2) letter c is carried out at
least once in five years or in accordance with the operating and maintenance
guidelines
(7) The detailed inspection as referred to in paragraph (2) letter c aims to obtain the
value of the bridge and road tunnel condition.
(8) The special inspection as referred to in paragraph (2) letter d is carried out if:
a. there are special events that threaten the bridge and road tunnel safety caused
by external factors or natural forces; and/or
b. routine/detailed inspection reports indicate that further information is needed
regarding the bridge and road tunnel condition.

Article 21

(1) The functionality test of bridges and road tunnels as referred to in Article 18 letter
c is carried out on all elements of bridges and road tunnels including the integrity
of the structural system
(2) The functionality test of bridges and road tunnels as referred to in Article 18 letter
c is carried out by comparing the bridge and road tunnel construction to the
planning documents and if necessary special inspections can be carried out.
(3) The functionality test of bridges and road tunnels as referred to in paragraph (1)
is intended to determine the stability of the structure before the bridge or road
tunnel is used for public post-construction or post-rehabilitation.

Part Five

Operation, Maintenance and Monitoring Report of Bridges and Road Tunnels

Article 22

(1) The results of the operation, maintenance and monitoring of road bridges and
tunnels are compiled by the Bridge and Road Tunnel Manager in the Operation,
Maintenance and Monitoring Report of the bridge or road tunnel.
(2) The monitoring report as referred to in paragraph (1) includes:
a. the routine monitoring report includes observations and measurements of
bridge geometry;
b. the annual monitoring report is a summary of the geometric report, condition
report, report on the results of the one-year functionality test and its
evaluation.
c. inventory inspection report;
d. detailed inspection report;
e. special inspection report; and
f. emergency response reports if needed.
(3) Operation reports and maintenance reports as referred to in paragraph
(1) at the end of the year, are summarized into an annual operation report and
an annual maintenance report.
(4) The annual operation report and annual maintenance report as referred to in
paragraph (3) together with the annual monitoring report are compiled in one
annual operation, maintenance and monitoring report.
(5) The annual operation, maintenance and monitoring report as referred to in
paragraph (4) is submitted to the Bridge and Road Tunnel Safety Commission for
review.

Part Six

Document Management

Article 23

(1) Bridge and road tunnel documents are required to support the bridge and road
tunnel safety evaluation.
(2) The documents as referred to in paragraph (1) include but are not limited to:
a. feasibility study documents;
b. technical planning stage documents;
c. construction stage documents; and
d. operational and maintenance management stage documents.
(3) The bridge and road tunnel owner is responsible for the management of all the
bridge and road tunnel documents as referred to in paragraph (2).
(4) Document management as referred to in paragraph (3) is carried out by:
a. documentation of each activity and its results;
b. document storage;
c. document maintenance; and
d. updates.
(5) The bridge and road tunnel owner is required to provide bridge and road tunnel
documents at least 3 (three) copies and 3 (three) digital copies, each of which is
stored at:
a. the office of the bridge and road tunnel owner;
b. bridge or road tunnel management office; and
c. Bridge and Road Tunnel Safety Commission.
(6) The bridge and road tunnel manager is responsible for updating, filing and
making available a set of documents in his office, as well as submitting an
updated record to the Bridge and Road Tunnel Safety Commission.
(7) Bridge and road tunnel documents must remain in place for the service life of the
bridge and road tunnel.

CHAPTER IV

PROCEDURE FOR EVALUATION AND ASSESSMENT OF ROAD BRIDGE AND


TUNNEL SAFETY

Part One

Bridge and Road Tunnel Safety Evaluation

Paragraph 1

General

Article 24

(1) The bridge and road tunnel safety evaluation as referred


to in Article 9 paragraph (1) letter c and Article 9 paragraph (2) letter b is carried
out at every stage of construction and management of bridges and road tunnels.
(2) The bridge and road tunnel safety evaluation as referred to in paragraph (1) is
carried out on:
a. technical planning;
b. construction;
c. operational and maintenance management including monitoring; and
d. enhancement or rehabilitation;
(3) The bridge and road tunnel safety evaluation is carried out until the end of
construction and management stages.
(4) The bridge and road tunnel safety evaluation as referred to in paragraph (2) letter
a and letter b is carried out by the Bridge and Road Tunnel Constructor.
(5) The bridge and road tunnel safety evaluation as referred to in paragraph (2) letter
c and letter d is carried out by the Bridge and Road Tunnel Manager.
(6) The evaluation results as referred to in paragraphs (4) and (5) are submitted to
the Bridge and Road Tunnel Safety Commission for review.
(7) In evaluating the bridge and road tunnel safety, the Constructors and Managers
hire bridge or road tunnel experts.

Article 25

(1) In evaluating the construction and management of bridges and road tunnels with
certain criteria, the constructors and managers are obliged to appoint
independent inspector(s).
(2) Bridges and Road Tunnels with certain criteria as referred to in paragraph (1)
include:
a. bridges with a span of at least 150 m;
b. bridges with pillar heights above 60 m;
c. road tunnels with a closed section length of at least 500 m;
d. other bridges that have complex technical problems, in accordance with the
recommendations of the Bridge and Road Tunnel Safety Commission.
(3) Independent inspector(s) appointed by the Bridge and Road Tunnel Constructor
and Manager must be recognized and approved by the Bridge and Road Tunnel
Safety Commission.

Article 26

(1) The independent inspectors as referred to in Article 25 may consist of:


a. experts in structure;
b. experts in geotechnics;
c. experts in earthquakes;
d. experts in geology;
e. experts in material and testing;
f. experts in hydraulics;
g. experts in road tunnels;
h. experts in aerodynamics;
i. other experts as needed.
(2) The independent inspectors as referred to in paragraph (1) must meet the
following requirements at least:
a. have a certificate of expertise in their field issued by an authorized institution
in accordance with the applicable laws and regulations; and
b. have experience in the field of planning or implementation or operation and
maintenance in accordance with the field they will be handling; or
c. have experience in handling similar problems to the problems of bridges or
road tunnels to be handled; or
d. other experts who have certificates of primary expertise and experience in
handling bridge or road tunnel problems.

Article 27

(1) The independent inspectors as referred to in Article 25 has the task of providing
more in-depth technical considerations regarding the bridge and road tunnel
safety.
(2) More in-depth technical considerations as referred to in paragraph
(1) are prepared in the form of a report consisting of, among others:
a. a review of design criteria;
b. a review of geotechnical parameters;
c. a review of wind tunnel test results;
d. a review of the magnitude of the subgrade movement parameters;
e. a review of structural damping coefficients;
f. a review of the mathematical model of the bridge;
g. a review of structural systems and stages of construction methods;
h. a review of construction loads and their application to the calculation;
i. a review of full live load including wind and earthquake;
j. a review of construction in critical cases of applied loads;
k. a review of large deflections during construction;
l. a detailed design review of important structural elements such as cables,
anchors, foundations and others; and
m. a review of design drawing.
(3) The technical consideration report as referred to in paragraph (2) shall be
submitted to:
a. The bridges or road tunnel owner;
b. The bridges or road tunnel constructor;
c. The bridges or road tunnel manager;
d. Bridge and Road Tunnel Safety Commission.
Paragraph 2

Evaluation of Bridge and Road Tunnel Construction Planning

Article 28

(1) Evaluation of construction planning as referred to in Article 24 paragraph (2) letter


a is carried out on bridge or road tunnel technical planning documents.
(2) The evaluation of the bridge or road tunnel design as referred to in paragraph (1)
is carried out on the bridge or road tunnel structure safety which includes:
a. safety of the superstructure;
b. safety of the substructure;
c. safety of the bridge foundation;
d. safety of the river bank protection;
e. safety of the road tunnels; and
f. safety of other road facilities.
(3) In order to meet the safety of the bridge and road tunnel structure as referred to
in paragraph (2), the bridge and road tunnel must meet the criteria set out in the
NSPK.

Article 29

(1) The evaluation of the bridge or road tunnel design as referred to in Article 28
paragraph (1) is carried out on the bridge and road tunnel technical planning
documents.
(2) The design document as referred to in paragraph (1) shall at least contain a
report:
a. surveys and investigations;
b. loads and design life of bridges and road tunnels;
c. structural analysis calculations;
d. dimensions of each bridge and road tunnel element;
e. implementation method of each stage;
f. final design of road bridges and/or tunnels;
g. technical and special specifications that must be met to achieve the required
quality of work and equipment used in construction;
h. budget plan for the construction of bridges and road tunnels along with
volume calculations; and
i. technical drawings of planning results.

Article 30

The design evaluation as referred to in Article 29 paragraph (1) shall at least contain
a brief description and evaluation of:

a. the design criteria, standards and guidelines used;


b. primary surveys include: traffic surveys, geological surveys, geodetic surveys,
hydrological surveys and other required surveys;
c. earthquake load and earthquake micro zoning;
d. materials analysis;
e. wind tunnel test results;
f. structural design of bridges and road tunnels;
g. design of other road complementary facilities;
h. volume and cost estimation;
i. construction methods and schedules; and
j. conclusion.

Article 31

(1) The design document and the results of the design evaluation are submitted to
the Bridge and Road Tunnel Safety Commission.
(2) The design document and the results of the design evaluation as well as technical
considerations from the independent inspectors as referred to in paragraph (1)
are used as study material for the Bridge and Road Tunnel Safety Commission in
preparing technical recommendations for design approval and construction
permits by the Minister.

Paragraph 3

Construction Evaluation
Article 32

(1) The construction evaluation as referred to in Article 24 paragraph


(2) letter b is carried out during and at the end of construction.
(2) The construction evaluation as referred to in paragraph (1) is carried out on:

a. conformity between the construction and the design approved by the Minister;

b. conformity between the quality control test results and the technical
specifications contained in the design document;

c. results of foundation construction and pile test results;

d. safety of the bridge and road tunnel structures in the event of a change to the
design parameters, including: installed material parameters, applied loads
and others;

e. adjustments or changes to construction methods;

f. handling of special events;

g. emergency action plans and preparedness;

h. document management and easy access to the documents;

i. completeness of the final construction report; and

j. follow-up on suggestions that have been submitted by the Bridge Safety


Commission;

k. evaluation of the safety plan and work procedures;

l. evaluation of environmental plan recommendations

(3) In the event that during construction, additional investigations and design
changes are made, the bridge and road tunnel constructor evaluates the
additional investigations and design changes.

(4) The report on the construction evaluation results as referred to in paragraphs (2)
and (3) and the construction progress shall be submitted by the bridge and road
tunnel constructor to the Bridge and Road Tunnel Safety Commission on a
regular basis at least once every 6 (six) months.

(5) When the construction is completed, the report on the construction evaluation
results as referred to in paragraph (3) is compiled into a final construction report.
(6) The final construction report as referred to in paragraph (5) shall at least contain:

a. a description of the aims and objectives of the bridge and road tunnel
construction;

b. the construction method used;

c. construction quality in accordance with technical specifications and special


specifications that have been used to achieve the required work quality;

d. safety analysis calculation of the built construction structure;

e. foundation repair and pile test results;

f. as built drawings;

g. a description of design revisions during construction;

h. design note consisting of design criteria, explanatory note and design


calculation note used in the preparation of the revision;

i. construction evaluation results; and

j. functionality test results.

(7) The bridge and road tunnel constructor submits a final construction report to the
Bridge and Road Tunnel Safety Commission.

(8) The final construction report along with its complementary documents as referred
to in paragraph (6) is a study material for compiling technical recommendations
for the granting of operational permits of bridges and road tunnels.

Paragraph 4

Operation and Maintenance Evaluation


Article 33

(1) Evaluation of operational and maintenance management as referred to in Article


24 paragraph (2) letter c is carried out on the results of monitoring, operational
and maintenance management of bridges and road tunnels.
(2) Reports on operational, maintenance and monitoring management and
evaluation results are submitted to the Bridge and Road Tunnel Safety
Commission.
Article 34

Reports on monitoring as referred to in Article 22 paragraph (2), operational and


maintenance management of bridges and road tunnels, as well as the evaluation
results as referred to in Article 24 paragraph (6) shall serve as study material for
the Bridge and Road Tunnel Safety Commission.

Paragraph 5

Evaluation of Improvement or Rehabilitation of Bridges and Road Tunnels

Article 35

(1) The evaluation of improvement or rehabilitation as referred to in Article 24


paragraph (2) letter d is treated as an evaluation of the construction and
management of bridges or road tunnels as referred to in Article 24 paragraph (2)
letter a, letter b, and letter c.

(2) The evaluation of improvement or rehabilitation as referred to in paragraph (1)


includes:

a. evaluation of design improvement or evaluation of rehabilitation design;

b. evaluation of construction improvement or evaluation of rehabilitation


construction; and

c. evaluation of the operation and maintenance of bridges and road tunnels after
the improvement or rehabilitation.

(3) evaluation of the improvement design or evaluation of the rehabilitation design


as referred to in paragraph (2) letter a shall be carried out with the provisions as
referred to in Article 29 to Article

(4) Evaluation of construction improvement or evaluation of rehabilitation


construction as referred to in paragraph (2) letter b shall be carried out following
the provisions as referred to in Article 32.

(5) Evaluation of the operation and maintenance of bridges and road tunnels after
improvement or rehabilitation as referred to in paragraph (2) letter c is carried
out in accordance with the provisions as referred to in Article 33 and Article 34.
Paragraph 6

Emergency Measures

Article 36

Emergency preparedness as referred to in Article 9 paragraph (1) letter d and Article


9 paragraph (2) letter d is carried out in accordance with the applicable laws and
regulations.

Part Two

Bridge and Road Tunnel Safety Assessment

Article 37

(1) The Bridge and Road Tunnel Safety Commission conducts road bridge and tunnel
safety assessments on design documents, construction documents, operation
and maintenance documents and bridge and road tunnel safety evaluation
reports submitted by the Bridge or Road Tunnel Constructor or Manager.

(2) The bridge and tunnel safety assessment as referred to in paragraph (1) is carried
out to:

a. Ensure that the construction and management of bridges and road tunnels
has been carried out in accordance with the conception of the bridge and road
tunnel safety and the rules of the bridge and road tunnel safety contained in
the norms, standards, guidelines and manuals.

b. Preparation of recommendations from the Bridge and Road Tunnel Safety


Commission to the Minister regarding permits and approvals for construction,
alteration and management of bridges or road tunnels.

(3) The document as referred to in paragraph (1) is reviewed by the Bridge and Road
Tunnel Safety Commission based on the report as referred to in Article 22
paragraph (2).

(4) In the event that the results of the study on the report as referred to in paragraph
(3) conclude that there is a threat to the bridge and road tunnel safety, the Bridge
and Road Tunnel Safety Commission will determine the follow-up action.
(5) The follow-up action as referred to in paragraph (4) may be in the form of:
a. advice to the bridge and road tunnel Constructor or Manager to take
immediate action to overcome the problems that are occurring;
b. inspection by the Bridge and Tunnel Road Safety Commission.
(6) The results of the study as referred to in paragraph (3) are discussed with the
bridge and road tunnel builder and/or manager concerned in the session of the
Bridge and Road Tunnel Safety Commission.

Article 38

(1) The bridge and road tunnel safety assessment as referred to in Article 36
paragraph (1) is carried out on the evaluation report prepared by the bridge and
road tunnel Constructor or Manager.

(2) The bridge and road tunnel safety assessment as referred to in Article 36
paragraph (1) is supported by documents in accordance with the stages of
construction and road bridges and tunnel management, namely:

a. the construction planning stage in the form of a design document;

b. the construction stage in the form of a final construction report; and

c. the operation and maintenance stage in the form of an annual report on the
bridge operation and maintenance as well as a monitoring report on the bridge
and road tunnel.

(3) In the event of improvement or rehabilitation work, the bridge and road tunnel
safety assessment is carried out according to the stages as referred to in
paragraph (2).

(4) Rehabilitation as referred to in paragraph (3) is rehabilitation related to or


affecting the stability of the bridge and road tunnel structure.
CHAPTER V
BRIDGE AND ROAD TUNNEL INSPECTION PROCEDURES

Article 39

(1) The bridge and road tunnel inspection as referred to in Article 8 paragraph (2)
letter c is carried out to:
a. obtain an overview of field conditions related to the bridge and road tunnel
safety;
b. collect field data;
c. monitor the construction and management of bridges and road tunnels in the
safety aspects of bridges and road tunnels; and
d. verify reports on the construction and management of bridges and road
tunnels.

(2) The inspection activities of bridges and road tunnels as referred to in paragraph
(1) are carried out to support the bridge and road tunnel safety assessment

(3) (2) The bridge and road tunnel inspection as referred to in paragraph (1) shall be
carried out by performing:

a. inspection at the design stage;


b. inspection at the construction stage;
c. annual inspection; and
d. special inspection.

(4) Inspections by the Bridge and Road Tunnel Safety Commission are carried out
on the basis of a request or without a request from the bridge and road tunnel
Constructor or Manager.

(5) In conducting inspections, the Bridge and Road Tunnel Safety Commission is
represented by several commission members based on their fields of expertise in
accordance with the problems encountered in the field.

(6) The Bridge and Road Tunnel Safety Commission may appoint a bridge and road
tunnel safety inspection team consisting of the necessary bridge and road tunnel
experts to assist with the bridge and road tunnel inspection.
Article 40

(1) If requested by the bridge and road tunnel Constructor or Manager, the Bridge
and Road Tunnel Safety Commission may carry out bridge and road tunnel
inspections.

(2) The costs incurred by the bridge or road tunnel inspection at the bridge and road
tunnel Constructor or Manager as referred to in paragraph (1) shall be the
responsibility of the bridge and road tunnel Constructor or Manager.

CHAPTER VI
TRANSITIONAL PROVISIONS

Article 41

(1) At the time this Ministerial Regulation comes into force, all regulations governing
bridge safety remain in force as long as they do not conflict with this Ministerial
Regulation.
(2) At the time this Ministerial Regulation comes into force:
a. For bridges and road tunnels whose construction has been completed at the
time this regulation comes into force, the provisions as referred to in Article 4
paragraph (2) letter b shall apply.
b. For bridges and road tunnels that are still under construction at the time this
regulation comes into force, the provisions as referred to in Article 4 paragraph
(2) shall apply.
c. The Technical Implementing Unit for Bridge and Road Tunnel Safety as
referred to in Article 7 paragraph (8) is formed within 1 (one) year at the latest
since this Ministerial Regulation is promulgated.
d. Until the Technical Implementation Unit for Bridge and Road Tunnel Safe is
established, the Bridge and Road Tunnel Safety is carried out by the
Directorate General of Highways.
CHAPTER VII
CLOSING PROVISIONS

Article 42

This Ministerial Regulation comes into force on the date of its promulgation.

In order that this law is known to the general public, it is ordered this Ministerial
Regulation be promulgated in the state gazette of the Republic of Indonesia.
