It was 2:30 in the afternoon when Acting Vice Mayor Alberto T. Ungab called
the session to order. The invocation was led by Councilor Louie John J. Bonguyan and
by the singing of the Philippine National Anthem and “Tayo’y Dabawenyo”.
Upon the direction of Temporary Presiding Officer Alberto T. Ungab, Ms. Charito
N. Santos, Secretary to the Sanggunian, called the roll which established that twenty-
two (22) Members of the Body were present, thus, mustering a quorum.
Floor Leader (FL) J. Melchor B. Quitain Jr. reminded the august body that Davao
City has always been at the forefront at helping others in times of need. Unfortunately,
the calamity was experienced by Davao City itself since certain areas of the City were
flooded the night before.
Upon call of the Executive Department, the special session was held to declare
certain barangays to be under a State of Calamity and for authority to release
emergency funds to those barangaysas well as for the Province of Ilocos Norte.

For the financial assistance to be given to Barangays Los Amigos, Tugbok Proper,
Talomo and Wangan, this City, the requirements such as the Certificate of Urgency, the
Certificate from the City Treasurer’s Office, the recommendation from the City Disaster
and Risk Reduction and Management Office (DRRMO) to extend financial assistance to
the affected barangays, the Resolution of the Davao City Risk Reduction and
Management Council approving such recommendation, have been submitted and
scrutinized by the committee, the only lacking document was the Resolution declaring
that those barangays are under a state of calamity and the Ordinance authorizing the
utilization of a portion of the Quick Response Fund.
The flooding in Davao City affected other Barangays, nonetheless, only four (4)
barangays have been identified by the Risk Reduction Management Council to qualify
for financial assistance to be sourced from the Quick Response Fund.

The total amount of Fifty Million Pesos (PHP 50,000,000.00) to be given as
financial assistance to the aforementioned four (4) barangays of Davao City shall be
broken down as follows:
PHP 50,000,000.00
At this point, Councilor Jesus Joseph P. Zozobrado III requested to the august
body to allow the representative of Disaster Risk Reduction and Management Office
(DRRMO) to give a short presentation regarding what happened on the evening of
August 28, 2019 and to answer questions like what are the barangays affected and how
the amount to be given as financial assistance was reached. Consequently, Councilor
Dayanghirang moved, duly seconded by Councilor Jesus Joseph P. Zozobrado III, for
the suspension of rules to allow the representative of DRRMO to speak before the City
Council. With that, the motion was carried and the rules were suspended.
SUSPENDED RULES
Councilor Ralph O. Abella manifested that barangays also have their own
Barangay Disaster Risk Reduction Management (BDRRM) and he wanted to know if the
other members of the City Council would allow the barangays to use their own funds
provided they will submit a Resolution to that effect to the City Council.
Upon being duly recognized by the Temporary Presiding Officer, Mr. Rodrigo C.
Bustillo, the Officer-in-Charge of the DRRMO, reported to the august body that localized
thunderstorms fell upon Davao City, especially on the area near Talomo River, on the
August 28, 2019. The localized thunderstorms brought about torrential rains that led to
the flashflood that affected many of the residents of certain areas such as Barangay Los

Amigos, Tugbok Proper, Talomo, Wangan, Balengaeng, Catalunan Pequeño, and
Manambulan.
At the instance of the Temporary Presiding Officer, Mr. Bustillo clarified that he
was referring to Barangay Talomo Proper of the 1 st District and not Barangay Talomo
Riverside.
As early as 4:00 in the afternoon of August 28, 2019, the DRRMO already called
for pre-emptive evacuation. Unfortunately, many of the residents did not heed the call.
At around 5:30 that same afternoon, another call was made, this time, for forced
evacuation. Still, some residents did not heed the call. Due to the failure to respond to
the call of DRRMO, some residents were trapped in their own houses but, thankfully,
they were successfully rescued by DRRMO. Mr. Bustillo surmised that the reason why
the residents did not heed DRRMO’s call for evacuation might have been because the
rains were not as heavy in the low lying areas which were the ones severely affected
than in the uplands which were not as severely affected. For instance, Barangay
Calinan Proper was hit by heavy rains but there was no flood. The low lands like
Barangay Talomo Proper, the main impacted area, suffered more. The water from the
heavy rain in Barangay Calinan Proper went to Barangay Los Amigos, where the City
has a huge relocation area, then to Tugbok District then it flowed to Barangay Talomo
Proper, already in the 1st District.
Of all the barangays, Barangay Talomo Proper was the one most severely
affected as 2,030 families were evacuated. The table below shows the data on how
many people and families were affected:
Councilor Jesus Joseph P. Zozobrado III took the floor and asked Mr. Bustillo for
the time when the rain started in Barangays Subasta, Sirib and Wangan. Mr. Bustlllo
answered that the rain started at around 3:00 in the afternoon. The Councilor then
asked for the time the flood started in Barangay Talomo Proper and what time the call
for evacuation was made. To this, Mr. Bustillo answered that it started at around 4:20
that same afternoon. The Councilor then inquired why Barangay Talomo Proper was
informed ahead of Barangay Los Amigos and Mr. Bustillos explained that, essentially the
announcement was done simultaneously because the system of DRRMO is made in such
a way that the announcement made using the radio could be received by all barangays,
including the Punong Barangays, simultaneously. Furthermore, at 4:40 in the
afternoon, DRRMO already informed barangay officers, especially those barangays
around Talomo River, to conduct pre-emptive evacuation.

Mr. Bustillo also clarified that there were no casualties to the flood, contrary to
the earlier reports. Also, only Barangays Los Amigos, Tugbok Proper, Talomo and
Wangan were severely affected and qualified for financial assistance. Barangays
Balingaeng, Catalunan Pequeño, Calinan Proper and Riverside were excluded because
they were not affected as severely.
When Councilor Zozobrado III asked for the data on how many people were
affected in Barangays Balingaeng, Catalunan Pequeño, Calinan Proper and Riverside,
Councilor Dayanghirang suggested that the representative from the City Social Services
and Development Office (CSSDO) may answer the question.
As such, the Temporary Presiding Officer recognized Ms. Marilyn Agonia as the
representative of CSSDO and she proceeded to explain that, indeed, there were other
barangays that were heavily hit by the flood, however, these barangays did not comply
with the requirements to declare a state of calamity.
Ms. Agonia noted that pursuant to Memorandum Order No. 60, Series of 2019, of
the National Disaster Risk Reduction and Management Council, a State of Calamity can
be declared when at least 15% of the forcasted affected population based on science-
based projection are in need of emergency assistance.
Councilor Conrado C. Baluran manifested that it was not right to exclude other
affected barangays. He reported that arounf 1,200 households were affected at
Barangay Riverside and another 1,000 in Barangay Manambulan. Both barangays were
not included in the list of barangays to be given financial assistance.
Councilor Dayanghirang then stated that even if some barangays were not
included in the list, the City still had available funds and the City had always been
generous especially to those in need. He further said that the City Council could pass
another Resolution regarding extending financial assistance to other affected
barangays.
Councilor Bonifacio E. Militar countered that he was told by the City Budget
Officer that the Calamity Fund only had Php 54,000,000.00 left after deducting the
proposed final assistance of Php 50,000,000.00. He agreed to pass another Resolution
for the other affected barangays if the City Government could find another way to fund
it.
Ms. Agonia stated that the proposed financial assistance was only for the
barangays that complied with the requirements; this did not mean, however, that the
other affected barangays would not be given the same assistance. Affected barangays

not included in the list in the proposed Ordinance may be given financial assistance to
be sourced from the Crisis Intervention Fund.
Acting Vice Mayor Alberto T. Ungab established that the time element in times of
disaster and the assistance extended is very important. The shortest time possible is
the best. Hence, the City Government must act according to what data is available.
Councilor Militar asked for an assurance from the City Budget Officer that other
affected barangays will be given the same financial assistance but from another source,
the Crisis Intervention Fund. Councilor Myrna G. L'Dalodo-Ortiz then requested that the
City Budget Officer be allowed to speak before the City Councnil.
Upon the recognition of City Budget Officer Ermelinda Furog, Councilor L'Dalodo-
Ortiz asked her for the appropriated amount for the calamity fund in the Annual Budget.
Ms. Furog answered that the calamity fund is 5% of the Annual Budget and 30% of
that is allocated for the Quick Response Fund. She expounded that the crisis
intervention program under the CSSDO is intended for food and non-food assistance.
The fund may be augmented if necessary. The program is already listed under the
Investment Plan.
The Floor Leader then asked what would happen if another calamity would befall
the City and would the City would be able to give another financial assistance. Ms.
Furog replied that assistance may be sourced from the Crisis Intervention Program.
Councilor Baluran wanted to find out who identified which barangay should
receive financial assistance from the City. At this point, the Temporary Presiding Officer
pointed out once again the importance of extending timely help to the City’s affected
residents and that the City Government should act according to the data given.

Councilor Mahipus Jr. suggested that the CSSDO should have emergency disaster
packs where each pack will contain all the food and non-food assistance and ready for
distribution.
Councilor Militar took the floor and requested for a reconsideration on the
approval of the Resolution giving the PHP 50,000,000.00 assistance. Councilor
Dayanghirang so moved, duly seconded by Councilors Mary Joselle D. Villafuerte, Edgar
P. Ibuyan Jr. and Ralph O. Abella; the motion was approved and the approval of said
Resolution was reconsidered.
Ms. Agonia of CSSDO was recognized once again to answer the querries of
Councilor Militar. The Councilor asked what kind of assistance will be given and how
such assistance will be distributed. Ms. Agonia explained that the City will give food
and non-food assistance, consisting of clothing, beddings, kitchen utensils and hygiene
kits, to those residents who were affected by the flood. As to exactly how the
assistance will be distributed, the staff of CSSDO are the ones who knew the exact
procedure.
Councilor Militar requested Ms. Agonia to furnish the City Council with the copy
of the rules of procedure for the distribution of the assistance. He then asked if CSSDO
also distributes medicine and medical supplies. Ms. Agonia replied that it is the City
Health Office (CHO) that distributes those. Councilor Militar then asked why there is a
ten percent (10%) retention everytime the City Councilors have purchase requests and
he asked for its legal basis. Since the City Budget Officer was more adept at answering
this question, she was called to answer it on the floor
Ms. Furog stated that the 10% retention was a requirement for all purchase
requests and that it was based on a Resolution issued by the Local Finance Committee.
This 10% retention serves as buffer for budget control. It is utilized once the City
Treasurer’s Office has achieved its projected collection for the year.

Councilor Dayanghirang then gave an input that the 10% retention was legal
because the purchase request is already in the budget.
