Problem: The Accountability of MONUSCO peacekeepers while respecting Troops Contributing
Country’s sovereignity
Solution:
1. Commission on the Prevention and Anticipation of Misconduct Against Civilians in
Congo (CO-VI ANAN) (the “subsidiary organ”) with the mandate as follows:
a. This subsidiary organ will ensure the implementation of standards of conduct of the
UN;
b. This subsidiary organ will work on several core issues under the standards of conduct
such as:
i. Illegal exploitation of Congolese natural resources (tin, tantalum, tungsten,
gold, diamonds, cobalt, and coltan, as well as cocoa, charcoal, timber, and
wildlife) involving any parties;
i. Child labor;
ii. Gender-based and sexual violence;
iii. International crimes or jus cogens violations such as human trafficking,
genocide, war crimes, crimes against humanity;
iv. Violation against non-derogable rights such as torture and extrajudicial
killings;
v. Human rights issues;
b. If there is a victim/party who is affected with violations under the sub-section a, the
victim may file a report to the subsidiary organ;
c. For the SEA cases/point no. ii, the subsidiary organ would submit the case to the
African Union and the African Union will assist the case;
d. The subjects that can be reported are as follows:
i. MONUSCO troops/members;
ii. Terrorist organizations;
iii. Congolese troops; and/or
iv. Other parties that are involved with the violations under sub-point i;
e. After the subsidiary organ processes the investigation, the subsidiary organ must
determine whether the case can be brought into the following:
i. Conduct and discipline unit of MONUSCO;
ii. Relevant government authorities of the perpetrator;
iii. Domestic court of the perpetrator;
iv. Military tribunal; and/or
v. Regional or International tribunal;
f. Possible course of actions that might be considered by the countries who are targeted
by the report established by the subsidiary organ is as follows:
i. Repatriation of troops;
ii. Adjudication in their own countries; and/or
iii. Relevant tribunals.

2. Ensuring the well-being of Peacekeeping forces. To guarantee the safety of each


nation’s troops, which includes:
a. Referring to the three basic principles of peacekeeping as stated by United
Nations;
b. Allocating enough budget to fulfill the troops’ basic needs, including but not
limited to the health facility.
