DEED OF TAGGING AGREEMENT ON EXISTING


MORTGAGED PROPERTIES
THIS DEED OF TAGGING AGREEMENT ON EXISTING MORTGAGED PROPERTIES IS
EXECUTED ON THIS THE _________ DAY OF ________________, 2021 OF THE CHRISTIAN ERA.
EXECUTED BY:

NID no.- 2616220564853 son of Ambik Chandra Halder¸ Having present as well as
permanent address at Halder para. Village- Notun Bandura, P.S. Nawabgonj, District- Dhaka,
by Faith- Sonatan, by Profession- Business and by Nationality-Bangladeshi by birth, TIN no.
411466226084, hereinafter referred to as the Mortgagor (which expression shall unless
repugnant to the context shall mean and include his heirs, successors, legal representatives
and assignees) of the ONE PART.

SHAHJALAL ISLAMI BANK LIMITED,a Banking Company incorporated under the Company
Act. 1993 / 1994 having it’s registered Head Office at ‘ShahjalalIslami Bank Tower’, Plot No.
4, CWN(C), Gulshan Avenue, Dhaka-1212 with one of it’s Branch situated at Nawabgonj,
Dhaka, better known as BANDURA BRANCH, Dhaka, hereinafter referred to as the Mortgagee
Bank (which expression where the context so requires, include it’s successors-in-interest
and assignees) of the OTHER PART.
WHEREAS
A. The abovementioned MORTGAGOR-INVESTMENT CLIENT is the absolute owner of
the respective Scheduled Property mortgaged by the same in favour of the BANK
on deposit of title deed thereof for securing the Investment Facility of
Tk.800,000.00 (Taka Eight Lac) only (Hereinafter referred to as the “Previous
Investment Facility”), availed by me by executing Deed of Mortgage being No.
5503, Dated- 16/09/2015, registered with NAWABGONJ Sub-Registry Office,

Dhaka, to Mortgagee Bank for securing the financial assistance granted by the
Mortgagee Bank in favor of ‘‘GOBINDA SHOE STORE’’, Proprietor- Mr.
GobindaHalder, at Old Bandura Bazar, Nawabgonj, Dhaka.
B. AND WHEREAS, being in need of further financial assistance, the MORTGAGOR-
INVESTMENT CLIENT requested the MORTGAGEE BANK for sanctioning further
Investment Facility and pursuant such request, the MORTGAGEE BANK has
sanctioned has approved/ Sanctioned additional composite investment facility of
Tk 400,000.00 (Taka Four Lac) only comprising Bai-Muajjal Commercial TR
(Revolving) Investment Facility of Tk. 200,000/- (Taka Two Lac) only and Bai-
Muajjal (Term) of Tk. 200,000/- (Taka Two Lac) under SME to purchase different
types of Shoes items from local market for trading purpose in favor of ‘‘GOBINDA
SHOE STORE’’, Proprietor- Mr. GobindaHalder, at Old Bandura Bazar, Nawabgonj,
Dhaka vide Sanction Advice No. SJIBL/BAN/INV/2021/ , dated-15/09/2021
(hereinafter referred to as the ‘New Sanction Letter) on conditions inter alia, that
the MORTGAGOR-INVESTMENT CLIENT shall create tagging agreement on the
Scheduled Property, which had been mortgaged by the said registered mortgaged
deed with Power of Attorney for the purposes securing the entire liabilities,
whether existing or further and whether actual or contingent on the account of
MORTGAGOR-INVESTMENT CLIENT, in favour of the MORTGAGEE BANK as
security for repayment of the New Investment Facility along with profit and
charges due thereon and the said MORTGAGOR-INVESTMENT CLIENT shall not
redeem the aforesaid mortgage created earlier without full adjustment of New
Investment Facility;
C. AND WHEREAS, the MORTGAGOR-INVESTMENT CLIENT has accepted the
conditions and offered and agreed to create tagging agreement on the Scheduled
Property in favour of the MORTGAGEE BANK with a view to secure the repayment
of the New Investment Facility;
D. AND WHEREAS, the MORTGAGEE BANK has consented to such charge as per
section 53 (D) of the Transfer of Property (Amendment) Act, 2004 on Scheduled
Property and agreed to accept the Scheduled Property as security for adjustment of
the New Investment Facility sanctioned in favour of th MORTGAGOR-INVESTMENT
CLIENT.

NOW THIS DEED OF AGREEMENT WITNESSES AS UNDER:
1. That in consideration of the further above New Investment Facility of Tk.
400,000.00 (Taka Four Lac ) only given to the MORTGAGOR-INVESTMENT
CLIENT by the MORTGAGEE BANK under the terms & Conditions of Sanction Letter
mentioned above. The MORTGAGOR-INVESTMENT CLIENT do hereby create
further/Additional charge on the Schedule Property together with all rights, profits,
easements and structures appertaining thereto as security for repayment of the
aforesaid New Investment Facility given by the MORTGAGEE BANK to the
MORTGAGOR-INVESTMENT CLIENT.
2. That the Scheduled Property shall stand charge to the Bank and shall continue as a
security for repayment of the New Investment Facility and adjustments of all
liabilities whether existing or future and whether actual or contingent in the
MORTGAGOR-INVESTMENT CLIENT’s account with profit, commission & other
charges;
3. That all the terms and conditions of the said registered mortgage deeds mentioned
above executed in respect of the Scheduled Property in favour of the MORTGAGEE
BANK shall hold good, remain valid and be binding on the MORTGAGOR-
INVESTMENT CLIENT forth the entire liabilities with MORTGAGOR-INVESTMENT
CLIENT;
4. That the MORTGAGOR-INVESTMENT CLIENT do hereby also admit and confirm
that the registered Deed of Mortgage through made for a less amount of New
Investment Facility shall cover the entire liabilities with profit and other charges of
the Investment Facility;
5. That the security hereby created is in addition to and in continuation of the said
earlier registered mortgage created by the same which are not substituted rather
shall continue in full force for the existing and New Investment Facility and
liabilities on the account of same with profit and other charges;
6. That on repayment of the New Investment Facility and on payment of all profit and
other charges due thereon the MORTGAGOR-INVESTMENT CLIENT shall be entitled
to redeem the scheduled Property at their own costs from the MORTGAGEE BANK

free from all encumbrances and charges accruing on the MORTGAGEE BANK and on
such redemption this mortgage shall be deemed to have been extinguished.
7. That the MORTGAGOR-INVESTMENT CLIENT hereby also agree and declare that
the terms and conditions contained in the Sanction Letter including any
amendment thereof or addition thereto, from time to time, or renewal if any shall
be deemed and be taken to be part of these presents.
8. That it is agreed that in case of negligence or failure of the MORTGAGOR-
INVESTMENT CLIENT to repay the New Investment Facility and adjust all the
liabilities on the account of the MORTGAGOR-INVESTMENT CLIENT with the Bank
within the time allowed by the Bank in writing, the Bank shall have the option to
sell out or dispose to the schedule properties either by private negotiation or by
public auction without the intervention of any court of law and the shortfall if any
shall be recovered from the MORTGAGOR-INVESTMENT CLIENT by sale of the
other properties of the MORTGAGOR-INVESTMENT CLIENT.
9. That in the event the MORTGAGEE BANK suffers any loss or damage caused due to
any false statement, misrepresentation or concealment of facts regarding the right,
title, interest and possession of the mortgaged properties, the MORTGAGOR-
INVESTMENT CLIENT shall be bound to refund the mortgage value to the
Mortgagee Bank upon immediate demand and the exercise of the right under this
provision shall under no circumstances prejudice the MORTGAGEE BANK from
taking any other recourse against the MORTGAGOR-INVESTMENT CLIENT for
recovering of its dues.
10. That all the terms and conditions of this Agreement shall remain effective and
binding upon the parties till full and final adjustment of the New Investment Facility
availed by the MORTGAGOR-INVESTMENT CLIENT from the MORTGAGEE BANK.

S.A. 175, R.S. 46, Mutation Khatian No. 769, Jote No. 771, Plot No. C.S. & S.A. 230 (Two
Hundred Thirty), R.S. 180 (One Hundred Eighty), Area of land 12 (Twelve) decimals &
structure thereon. Boundary- On the North- 10 feet wide Union Council Road, On the South-
Gobinda Chandra Road, On the East- Mr. SumonHalder, On the West- Mrs. Shushila&Sukuma

IN WITNESS WHEREOF THE MORTGAGOR-INVESTMENT CLIENT AND THE MORTGAGEE
