Marsinah's Case in Human Rights Violations

Marsinah is a person who can be called as a defender of human rights


(Human Rights) as well as a mover of labor in Indonesia. Marsinah is one of the
movers of the demonstration at PT. Catur Surya in May 1993. This demonstration
was in order to demand that the wages of workers be increased. On 3 and 4 May
1993, Marsinah and other workers became representatives of the negotiations with
PT. CPS. However, starting on May 6, Marsinah just disappeared mysteriously.
Then, on May 8, Marsinah was found dead in the forest, lying all over her body,
full of bruises, marks from being hit by a hard object and covered in blood all
over her body.

In this case, it is a serious human rights case because it contains elements that
give rise to gross human rights violations, namely Article 9 of Law No. 26 of
2000 which contains elements of human crimes and also contains elements of
human rights violations. The legal basis that is violated in the second precept is
"just and civilized humanity". In it there are crimes such as murder, extermination,
slavery, torture. And persecution of a person or group based on political equality,
race, nationality, ethnicity, culture, religion, gender which has been universally
recognized as prohibited under international law.
In the Marsinah case, there have been many criticisms from various parties,
that the Marsinah case has been around for a long time, but the killer doesn't know
where. It should be seen that the incident is still mysterious until now to avoid the
case from happening again, there should be special actions from government law
to provide a deterrent effect for the perpetrators.

As social beings, we must be able to fight for our own human rights. Besides
that, we must also be able to respect and protect the human rights of others so that
they do not violate human rights. And don't let our own human rights be trampled
on by other people. So we must be able to harmonize and balance our human
rights with the human rights of others.
