JUDICIAL AFFIDAVIT OF GLENDA FLORINO LURA

I, GLENDA FLORINO LURA, of legal age, Filipino Citizen,

married and a resident of Linan St. Mambusao, Capiz state under oath as
follows:

PRELIMINARY STATEMENT

The person examining me is ATTY. MA. JUNA V. DIETA with

address at Borres Law Office and Associates, Fortune St., Banica, Roxas
City. The examination is being held at the same address. I am answering her
questions fully conscious that I do so under oath and may face criminal
liability for false testimony and perjury.

This affidavit of Petitioner Glenda Florino Lura is being offered to

prove that the First Name of Isidoro Nelson P. Florino was erroneously
entered in the Transfer Certificate of Title No. T-20343. The petitioner’s
testimony is also offered directing the Registry of Deeds of the Province of
Capiz to cause to be made the correction of the erroneous FIRST NAME and
issue another owner’s copy bearing the true name of ISIDORO NELSON P.
FLORINO.

A. I am Glenda Florino Lura, 45 years old and a resident of
Mambusao, Capiz
2. Q. Are you the same Glenda Florino Lura, the petitioner in this
case?
A. Yes ma’am.
3. Q. Do you know Isidoro Nelson P. Florino?
A. Yes ma’am. He is my father.
4. Q. Do you have proof that you are the daughter of the Isidoro
Nelson P. Florino?
A. Yes Ma’am. I have the copy of my certificate of live birth
issued by the Philippine Statistics Authority.
5. Q. Do you know the registered owner of the property located at the
Municipality of Mambusao, Capiz with Transfer Certificate of
Title No. T-20343?
A. The Registered Owner of the property covered by Transfer
Certificate of Title is my father Isidoro Nelson P. Florino.
6. Q. Do you have any proof that Isidoro Nelson P. Florino is the true
and lawful owner of the property covered by TCT No. T-
20343?
A. Yes ma’am, the copy of the Transfer Certificate of Title No.
T-20343.
7. Q. Who has been paying the Real Property Tax of the said
property?
A. My father was paying the real property tax when he was still
alive.
8. Q. Do you have proof that your father was paying the real property
tax?
A. Yes, Ma’am. I have the copy of the Tax Declaration No. 19-
0011.
9. Q. Where is your father right now?
A. He died on August 20, 2019.
10.Q. Do you have proof of his death?
A. Yes ma’am, I have the copy of the death certificate of my
father.
11.Q. Who owns the property now?
A. The said property was extrajudicially settled by and between
me and my siblings, GARRY L. FLORINO and GRACE
MARIE FLORINO BESA and equally shared
among us.
12.Q. Do you have any proof that the property was equally shared
between you and your siblings?

 A. Yes ma’am. The Extrajudicial Settlement and Partition of
Estate of the Late Isidoro Nelson Florino executed on
September 25, 2020 and was published at the The Capiz Times
Publishing for three consecutive weeks.
13.Q. Are the information in the Transfer Certificate of Title correct?
A. No ma’am.
14.Q. What particular information in the Transfer Certificate of Title
is erroneously entered?
A. The name of my father.
15.Q. What Name of your father was erroneously entered in the TCT?
A. The first name Nelson. This should be Isidoro Nelson.
16.Q. Do you have any proof that it should be Isidoro Nelson?
A. Yes ma’am. The Certificate of Live Birth of my father and his
Identification Cards, Taxpayer’s identification card and Voter’s
identification card bearing his complete name.
17.Q. When did you discover that the name of your father was
erroneously entered in the Transfer Certificate of Title?
A. When I was processing the estate tax of the property after my
siblings and I executed the extrajudicial settlement of estate?
18.Q. Where are your siblings right now?
A. They are currently working outside the country.
19.Q. What made you decide to correct the name of your father in the
Transfer Certificate of Title No. T-20343?
A. I have to fix the name in the Transfer Certificate of Title so
that we can appropriately share the property among my siblings.
