GOVERNMENT“: deine he” CHIEF, PHILIPPINE NATIONAL POLICE CHIEF, BUREAU OF FIRE PROTECTION ALL LOCAL GOVERNMENT UNITS ALL PNP REGIONAL DIRECTORS AND BFP ATIN fl REGIONAL DIRECTORS SUBJECT : GUIDELINES FOR THE CONDUCT OF VALIDATION OF LGU COMPLIANCE WITH ROAD CLEARING JAN 19 2021 In line with DILG Memorandum Circular 2020-145, issued on October 28, 2020, which provides for the continuation of Road Clearing by all local government units, the Validation of compliance therewith for all Provinces, Cities, and Municipalities shall be conducted on FEBRUARY 16 to MARCH 2, 2021. ‘This Memorandum is being issued to provide guidelines for the conduct of the said Validation. A. Designation of Road Clearing Focal Persons 4. All DILG Regional Directors shall each designate ONE Road Clearing Focal Person for the Region, who shall be responsible in coordinating with the DILG Central Office during the Validation Period. — The name and contact information of the Road Clearing Focal Person shall be submitted by accomplishing the Focal Person Information Form, accessible through =the _—_—link. bit.ly/RoadClearingFocal (case-sensitive), on or before FEBRUARY 2, 2021. Creation and Cross-posting of Validation Teams, . All DILG Regional Directors, in coordination with the Philippine National Police and the Bureau of Fire Protection, are hereby directed to create Validation Teams for each Province, City, and Municipality within their Region. To ensure the impartiality of the validation process, the teams shall be cross-posted; i.e., their LGU of assignment during the Validation must not be their original LGU of designation or residence. . Pursuant to DILG Memorandum Circular 2020-027, the Validation ‘Teams shall be composed of: a. One (1) representative from the DILG b. One (1) representative from the Philippine National Police c. One (1) representative from the Bureau of Fire Protection d. One (1) representative from a civil society organization (CSO). Validation Teams for Component Cities and Municipalities may be cross-posted within their respective Provinces. Validation Teams for Provinces, Highly Urbanized Cities (HUCs), and Independent Component Cities (ICCs) may be cross-posted within the Region To reduce the risk of exposure to COVID-19 and other health risks, DILG Regional Directors are also enjoined to consider the minimization of travel in the cross-posting of the Validation Teams. For the National Capital Region, the Regional Office may directly send its own DILG representatives to the Validation Teams in lieu of cross-posting DILG representatives from different cities. All DILG Regional Offices shall submit to the Office of the Secretary, through the Bureau of Local Government Supervision, a directory of the members of all Validation Teams, using the template herein rovided as Annex “A” of this Memorandum, on or before FEBRUARY 9, 2021. _ C. The validation of local government units that are under a state of calamity at the time of the Validation Period shall be temporarily suspended and shall be scheduled to commence at least seven (7) days after such issuance or proclamation is lifted. 3, The Validation of all local government units performing PARTIAL IMPLEMENTATION (ie. those under a General Community Quarantine at least 14 days prior to the date of Validation) shall be conducted by accomplishing the Validation Form herein provided as Annex “B-1" of this Memorandum. a. In line with Memorandum Circulars 2020-036 and 2020- 445, Annex °B-1" provides for the Validation of two components: The actual removal of road obstructions through Road Clearing Operations (Road Clearing Component) The LGU's compliance with the ban on, tricycles along National Roads. b, The LGU's compliance with the Road Clearing Component shall be determined by the Validation Team by selecting three (3) to ten (10) local roads (provincial, city, municipal, or barangay) within the LGU and assessing whether road obstructions exist along or within the entirety of the selected roads. ¢. The Validation Team may coordinate with the local goverment unit in selecting the local roads to be assessed. The schedule of such assessment, however, shall be determined solely by the Validation Team. d. The LGU's score for the component shall be determined by: i, Identifying the road length and the number of obstructions present along each local road assessed i. Determining the total deductions for each local road assessed, which shall be one (1) point for every major obstruction present, such as an improperly- or illegally-parked vehicle, or an unauthorized vending stall; and half-point (0.5), for every minor obstruction present, such as structural encroachments, outposts or markers, debris and waste materials, and the like. Obstructing posts, trees, and other structures, the removal of which the LGU may not easily cause or requires coordination with any other government instrumentality or private company, shall not count as deductions, provided that a proof of the action taken by the LGU is presented to the Validating Team. Otherwise, they shall count as a quarter-point (0.25) deduction. iv. The LGU's raw score for each local road shall be computed through the formula: (Road length in kms / Total length of all roads assessed in kms) x (50 — Deductions). v. The LGU’s score for the Road Clearing component shall be determined by computing for the sum of all raw scores for all local roads assessed. For the ban on tricycles along National Roads, the Validation shall be conducted by the Validation Team by assessing the report and MOVs submitted to them by the Tocal government unit, vis-A-vis the requirements provided in DILG Memorandum Circular 2020-036. Template for the said report, to be accomplished and submitted by the local government unit to the Validation Team within the Validation Period, is herein provided as Annex “C.” Other technical instructions for the Validation Team in conducting the Validation are provided in the Validation Form (Annex “B-1"). 4. The Validation of all local government units performing FULL IMPLEMENTATION (i.e, those under a Modified General Community Quarantine or Post-Quarantine Scenario at the time of Validation) shall be conducted by accomplishing the Validation Form herein provided as Annex “B-2" of this Memorandum. a. In line with Memorandum Circulars 2020-036 and 2020- 4145, the said Validation Form provides for the Validation of seven components i. The actual removal of road obstructions through Road Clearing Operations (Road Clearing Component) ji. The enactment of an enabling ordinance (Ordinance Component) il, The conduct of an inventory of road obstructions (Inventory Component) iv. The crafting and implementation of a displacement plan (Displacement Component) v. The rehabilitation of cleared roads (Rehabilitation Component), and vi, The creation of a grievance mechanism (Grievance Mechanism Component) The LGU's compliance with the ban on tricycles along National Roads vii b. For the Validation of the LGU's compliance with the Road Clearing Component and the ban on tricycles along National Roads, the guidelines provided in C.2. shall also apply. c. The Validation of the LGU's enabling ordinance (Item C.3.aii. of this Memorandum) shall be conducted by the Validation Team by assessing such ordinance vis-a-vis the requirements provided in DILG Memorandum Circular 2020-027. The Validation Team shall coordinate with the LGU and its Sanggunian in obtaining a copy of the said ordinance. d. The Validation of all other components (Items C.3. C.3.a.vi.) shall be conducted by the Validation Team by assessing the reports and MOVs submitted to them by the local government unit vis-A-vis the requirements provided in DILG Memorandum Circular 2020-027. Templates for the said reports, to be accomplished and submitted by the local government unit to the Validation Team within the Validation Period, are herein provided as Annexes “D" to “G," respectively. STRICTLY NO REPORT, NO SCORE. fe. Other technical instructions for the Validation Team in conducting the Validation are provided in the Validation Form (Annex “B-2". . All DILG Regional Offices are enjoined to provide the necessary logistical support chargeable against available funds subject to the existing budgeting, accounting, and auditing rules and regulations. . Validation Guidelines for Local Government Units Local government units are hereby enjoined to coordinate fully with the Validation Teams in the conduct of Validation provided in this Memorandum. They are expected to provide the Validation Teams all the information and documents required to establish their compliance. Within the Validation Period, local government units shall submit to the Validation Team reports detailing their compliance to the components of Road Clearing. STRICTLY NO REPORT, _NQ SCORE. Templates for the said reports are herein provided as follows’ a. Annex °C" — Template for the LGU Report on Tricycle Ban along National Roads b. Annex "D" - Template for the LGU Report on Inventory Component c. Annex “E” — Template for the LGU Report on Displacement d, Annex °F" — Template for the LGU Report on Rehabilitation Component fe. Annex "G" — Template for the LGU Report on Grievance Mechanism Component. LGUs performing PARTIAL IMPLEMENTATION shall only submit ‘Annex “C.” LGUs performing FULL IMPLEMENTATION shall ‘Submit Annexes “C” to ‘G." The said reports shall be submitted to the Validation Team strictly within the Validation Period. These reports shall be accomplished by the LGU Department Head or Official in-charge and duly noted by the Local Chief Executive. LGUs performing FULL IMPLEMENTATION shall also provide the Validation Team a copy of its Road Clearing Ordinance for assessment, strictly within the Validation Poriod. . LGUs are also enjoined to submit to the Validation Team, as attachments to the reports, photographs, videos, presentations, reports, and other means of verifications (MOVs) that support their compliance. Local government units may not interfere with the Validation being conducted by the Validation Team, unless to bring up a mistake on the part of the latter. The Local Chief Executive may interface with the Validation Team after the Validation is completed, to be informed of the key findings and points for improvement determined. Considerations and constraints in compliance determined by the local government unit, if any, may be communicated through the Validation Team, which shall then note the same through the Validation Form. The effect of such factors on the assessment of the LGU's overall compliance with the Road Clearing policy, however, is within the discretion of the Management of the DILG Submission and Consolidation of Validation Results The DILG Regional Directors and the BARMM Minister of Local Government shall be responsible in consolidating all submissions from the Validation Teams within their Region. Further, they are responsible in ensuring the submitted forms, reports, and validation findings are complete and accurate. Regional Offices, through the Road Clearing Focal Persons identified as provided in Item A of this Memorandum, will be given access to soft copies of Regional Consolidation Spreadsheets, Which they shall then use to input and consolidate the results and findings of all Validation conducted within their Region. All Regional Offices shall submit the following not later than MARCH 9, 2021, 5:00 PM: a. The fully accomplished Regional Consolidation Spreadsheet, in Microsoft Excel (.XLSX) format b. Link to a cloud-based folder, containing: i. Scanned copies (in .PDF format) of all signed and accomplished Annex “B-1" and “B- organized by Province/HUC/ICC ji, Scanned copies (in .PDF format) of all submitted copies of ordinances and Annexes "C,” *D,” F, and 'G," together with attached MOVs submitted by the LGU, organized by Component City/Municipality, then by Province/HUC/ICC c. Transmittal Memorandum for the Secretary, through Vivian 9, OIC-Director, Bureau of Local Government Supervision, duly signed by the Regional Director, containing the link to the said cloud-based folder. Submissions shall be made through electronic mail, to roads.dilg@amail.com. 4. No Regional Office, Field Office or Validation Team_will_be allowed to resubmit, revalidate, ANY of their submissions beyond the March 9, 2024 deadline. F. Observance of COVID-19 Health Protocols, 1. Submission of reports and forms are encouraged to be conducted electronically. For all face-to-face activities conducted in compliance with this Memorandum, wearing of masks and social distancing shall be STRICTLY observed. Further, said activities shall not exceed ten (10) in-person attendees. 2. In cases of interzonal movement (Validation Team from an LGU under GCQ assigned to validate an LGU under MGCQ, or vice versa), Members of the Validation Teams from the DILG, PNP, and BFP, being government officials and/or goverment frontline personnel, are classified as Authorized Persons Outside of Residence (APORs) and hence shall be permitted movement regardless of community quarantine classification, in line with Item 2, Section [7] of the Omnibus Guidelines on the Implementation of Community Quarantine in the Philippines, as amended. 3. Members of the Validation Teams from civil society organizations (CSO), who are considered non-APORS, shall likewise be permitted interzonal movement subject to reasonable regulations imposed by the LGU concemed, in line with Item 3, Section {7] of the same Omnibus Guidelines, as amended LGUs that impose such restrictions on non-APORs are nonetheless enjoined to allow the Validation Team member unhampered entry, provided that health protocols are strictly followed, G.
