Grievance Description

Kindly consider this is of extreme importance as it is related to misappropriation of public funds, inefficiency, underperformance
and corruption in CGST and Customs.

Sir, in attachment we have enclosed an online petition which have received more than 3000 signatures against the undemocratic
and unsuitable cadre restructuring proposal prepared by the CBIC without the active participation of Group-B cadre officers. The
list of signatories and their comments are also enclosed which are surely be helpful in understanding what is going on in the
department.

Sir, the IRS cadre officers have formed a dominant and powerful group in CBIC and do not allow the talented Group-B cadre
officers to climb up in the higher positions of the department so that they can rule over the organisation by cornering all the
resources for their luxurious facilities, taking the credit of the work of Group-B cadre and shifting all the responsibilities to the
Group-B cadre officers in an event of lapse. This has resulted in unequipped and discouraged Group-B officers which is a root
cause of corruption and inefficiency.

Sir, almost 100 percent IRS officers are not performing the role of quasi-judicial authorities as they are not drafting their
adjudication orders. Most of the IRS officers are incapable of drafting their adjudication order as right from the beginning of their
career due to their stronghold in the department they get well-drafted order from the Group-B officers and put their sign on it.
The same issue was raised by a superintendent which was taking into consideration by the then Revenue Secretary, Shri
Hasmukh Adhiya ji. He had called for report in the matter but no action was taken later on. The Copy of the letter is enclosed.
Sorry to say, but Indian Revenue Officers indeed have no original revenue-related work in the CGST and C. Excise department.

Sir, in the administrative front- the HR policy of Group-B officers is miserable and a complete mess. The same has generated
huge frustration and resulted in the wastage of enormous public as well as individual resources on unending innumerable court
cases. Further, on infrastructure front, the Group-B officers are severely deprived with the supporting infra for performing their
duties as the most of the resources are being spent on luxuries of IRS offices.

Sir, The list of unethical practices is below because of grouping of IRS cadre officers:
(a) Unethical capturing of operational vehicles for personal use,
(b) Illegal capturing of Guest Houses,
(c) Illegal and unethical capturing of big size luxury rooms (usually 2-4 times against the norms),
(d) Over costly and luxury furniture installed in the cabins of Group-A officers
(e) Forcing subordinates to use their own resources for office work like to get clerical support for overburdening work and
conduct of Physical verification,
(f) Forcing Group-B officers to draft the adjudication orders review orders and refund orders that are supposed to be written by
quasi-judicial authority,
(g) Forcing Group-B officers to quote their DIN in the official communication done by the IRS officer for shifting responsibility in
notices and letters
(h) Taking illegal Guard of Honour, salute and Escort in khaki Uniform from the Group-B officers
(i) To maintain VIP Culture in the department by forcing Gr.B officers to give salute, escorts and Guard of Honor to IRS cadre
officers in public and private spaces.
(j) Forcing Group-B officers to sit in narrow and dirty spaces to keep them in low morale
(k) Forcing Group-B officers to use their laptops, vehicles and smartphones for official work as all the resources are being used to
provide luxuries to the Group-A cadre officers, resulting in an ill-equipped Group-B officer.
(l) Forcing Group-B cadre officers to withdraw Secret Service Fund (SSF) for spending the same for luxuries to Group-A officers.
