Students
Non-Resident Attendance
Children residing within the school district with either relatives or non-relatives, where it is the
intention of such relative(s), non-relative(s) and the child or the intention of the child’s parent(s) that
such residence is to be permanent, provided without pay and not for the sole purpose of obtaining
school accommodations, are entitled to attend school without charge.
The Board of Education does not allow attendance in the public school of non-resident
students except under the following circumstances:
1. A student may be placed into the district for special education by a Planning and
Placement Team (PPT) of another school district.
2. A student, whose family moves out of Hamden after February 1, may be allowed to
finish that school year in the Hamden Public Schools. A kindergartner, 6th, 8th, or
12th grader, whose family moves out at any time during the school year, may be
allowed to finish the school year. Parental written request and approval by the
Superintendent of Schools are required.
3. A student whose family is in the process of moving into Hamden may be allowed to
enroll in the Hamden Public Schools in September. Parental written request and
approval by the Superintendent of Schools are required.
Transportation for non-resident students allowed to attend the Hamden Public Schools will be the
responsibility of the individual student or the sending school district and not the Hamden Board of
Education.

a. When a Principal suspects that a student enrolled in his/her school does not
live in Hamden.
b. When school staff, during the registration process, learns that a student is
living in Hamden with someone other than his/her parents.
a. The Board shall give such person a hearing within ten (10) days after receipt
of the written request.
b. The hearing will be a formal hearing before the Board. The requesting party
shall be given a statement of the time, place and nature of the hearing. Both
sides have the right to be represented by counsel, to present evidence and to
cross-examine witnesses. The hearing will be conducted in accordance with
all applicable statutes (Connecticut General Statutes Sections 4-176e to 4-
180a, inclusive, and section 4-181a.
c. The Board shall make stenographic record or tape recording of the hearing.
d. The Board shall issue its finding within ten (10) days after the hearing.

h. If after the hearing before the Hearing Board of the State Board of
Education, it is determined that the child was incorrectly denied school
accommodations, the Hearing Board shall order the Hamden Board to make
such arrangements as necessary to enable the child to attend school. Such
arrangements shall be completed no later than fifteen (15) days after the
receipt of the order.

A. Resident Students
1. When a student is placed into the district for special education by a Planning and Placement
Team (PPT), the sending district will be responsible for paying tuition plus all special
education related costs, and transportation for the student.
2. When a student's family moves from one elementary school area to another or out of
Hamden during the school year, and the parents want the student to remain in the school for
the balance of the school year:
The Principal will tell the parent to make the request by letter to the Superintendent
and stipulate in this letter that he or she will guarantee to provide transportation for
the student while living outside the district.
NOTE: The above applies only after February 1 except in the case of
kindergartners, sixth graders, eighth graders and twelfth graders who may apply at
any time during the school year for this permission.
3. When parents who are in the process of moving into Hamden wish to start their children in
Hamden schools in September to avoid disruption:
The Principal will tell the parent to make the request by letter to the Superintendent, enclose
with it documentation, such as a rent receipt or mortgage document, to substantiate the
move, and stipulate that he or she would provide transportation. The Principal may also tell
the parent that this permission will not be considered unless the parent has documentation
that this move will take place prior to December 1.

Hamden.
(a) The Principal will request the Attendance Counselor visit the Hamden address for
verification.

(b) If the visit confirms the student does not live at that address, the Principal will
question the student in school for the student's correct address.
(c) This information will be given to the Superintendent who will send a letter (FORM
A) to the student's parents, with a copy to the Principal, advising them that the
student must be withdrawn from the Hamden Public Schools on a date set one week
hence.
2. When school staff registering a student learns that a student is living in Hamden with
someone other than his/her parents.
(1) The student will not be registered and admitted to school until the Resident
Status Report and Application (Form B) has been completed in full and
approved by the Superintendent.
(2) This form will be forwarded to the Superintendent for approval with
recommendation from the Principal.
(3) If approved by the Superintendent, the original copy will be returned to the
Principal, who will then admit the student and refer a copy to the Attendance
Counselor.
(4) The Attendance Counselor will visit the Hamden address of the student
some time during evening or early morning hours when a resident student
would be at home. If the student is not present, the Attendance Counselor
will notify the Principal and the Superintendent.
(b) If a visit by the Attendance Counselor does not find the student in residence, the
Superintendent will send a letter to the student's parents (FORM C) with a copy to
the Principal stating this fact and enclosing forms to be completed for documentation
(FORMS D and E).

(2) The number of visits to be made by the Attendance Counselor will vary
depending upon the results. If the student is present on the first visit and the
Attendance Counselor believes the student to be a permanent resident, he
may opt to validate the case.
(3) If the student is not present at the first, second or third visit, the Attendance
Counselor will then notify the Principal and Superintendent.
(c) The Superintendent will write to the parents (FORM F) giving them a withdrawal
date for the student and notifying them of their rights to appeal and of the right of
the Hamden School System to bill them for tuition if their appeal is rejected. A copy
of this letter will be sent to the Principal and to the Superintendent of the school
system where the student should be enrolled.

I have been informed that you do not live in Hamden and must therefore direct that your
son/daughter (NAME) be withdrawn from the (SCHOOL) on or before (ONE WEEK HENCE).
Under Connecticut law, a student is entitled to a free public education only in the town where
he/she resides. Therefore, unless (NAME) is withdrawn from our school by (ONE WEEK
HENCE), I will have to seek his/her exclusion from our school system on the basis of non
residence. By copy of this letter, I am notifying (CITY) of its responsibility to educate your
son/daughter.

reasons:
Within five (5) days, we will send you a request to document residency for the student/s named
above, including an affidavit of residency to be completed by the parent or guardian, the relative or
non-relative with whom the student resides, and the student if an emancipated minor or eighteen
(18) years of age or older. If a student does not meet residency requirements as outlined in
the first paragraph of this letter, you should withdraw the student from the (name) school
system immediately and enroll him/her in the school district of actual residence.

LETTER TO PARENTS
Dear
When your son/daughter (NAME) entered (SCHOOL) a Residential Status Report and Application
Form was completed because he/she lives with someone other than his/her parents in Hamden.
As required by our regulations, a visit was made to the student residence, (HAMDEN ADDRESS)
by our Attendance Officer, (NAME). (NAME) was not present. Based on that visit, we believe
(NAME) is not entitled to attend the Hamden Public Schools but should be attending the public
schools in (CITY). A child's residence in Hamden must be permanent, provided without pay and not
for the sole purpose of obtaining school accommodations in order to qualify for admission to the
Hamden Public Schools.
At this time, it is necessary for us to require from you documentation relative to your son/daughter's
residence in Hamden. The enclosed Parent's Statement and Guardian's Statement must be
completed, notarized and returned to me by (ONE WEEK HENCE).
If I have not received the documents by that time, the Board of Education will institute procedures
for your son/daughter's exclusion from the Hamden Public Schools.

Dear
Under Connecticut law, a student is entitled to a free public education only in the town where
he/she resides. This law states the residence must not be for the sole purpose of obtaining school
accommodations; it must be permanent and it must be provided without payment. From all
indications, your son/daughter does not meet those requirements and is, therefore, not eligible for
schooling in Hamden. Unless you withdraw him/her from (SCHOOL) by (ONE WEEK HENCE), I
will have to seek his/her exclusion from our school system on the basis of non-residency. By copy
of this letter, l am notifying (CITY) of its responsibility to educate your son/daughter.
Because this denial is based on an issue of residency, I must inform you that you have the right to
request a hearing before the Board of Education. If you desire such a hearing, you must make that
request in writing to the Board of Education prior to (TEN DAYS HENCE).
For your information, I am enclosing a copy of the law concerning school accommodations in which
you will find a procedure governing a hearing, should you request one. You will note that in the case
of an appeal that is denied, there is provision under the law for the Hamden Board of Education to
assess tuition against the parent, guardian or emancipated minor for the time spent attending school
in the district.
