Carmen Carunungan or Order the principal sum of Five Hundred Thousand Pesos
(500,000.00), Philippine Currency, without need of demand on or before March 1, 2020.
In addition to the foregoing, I promise to pay annual interest at the rate of Ten (10%)
percent, without need of demand, starting from the month of March until this note is fully
paid.

WE, CARMINA COROMINAS, Business Partners, CELESTE COROMINAS, all


of legal ages, Filipinos and residing at Surigao City, after having been duly sworn
in accordance with law, hereby depose and state:

PRELIMINARY STATEMENT

The person examining us is ATTY. RICHARD DANO, at his office at 2nd Floor,
ABC Building, Surigao Ciy. The examination is being held at the same address.
We are answering his questions fully conscious that we are under oath and may
face criminal liability for false testimony and perjury.

PURPOSES

The witnesses are being presented to:

a. Prove that the Accused, CARMINA CORMINAS and CELESTE CORMINAS


did not commit the acts constituting the crime of Estafa through falsification of
commercial document.

b. Rebut all the allegations of the Plaintiff

c. That they will identify the pertinent documents relative to his testimony; and

d. Such other relevant matters.

QUESTIONS & ANSWERS

Q1: Please state your name and other personal circumstances for the record.
A1: We, Carmina Corominas, Business Partners, Celeste Corominas, married, all
of legal ages, Filipinos and residing at Narciso Street, Taft, Surigao City.

Q2: Are you the same Carmina Corominas and Celeste Corominas the accused
in this case?
A2: Yes. Sir.

Q3: How do you know the complainant in this case, Ms. Carmen Carunungan?
A3: She has been our client for a long time.

Q4: When was the last time you talked to Ms. Carunungan?
A4: During Valentines Day Party last year.

Q5: During occasion?


A5: Yes, we had a chat for a while.

Q6: What did you talk about?


A6: That we would like to borrow money from her.

Q7: Did she agree?


A7: Yes, Sir.

Q8: When was the loan contracted?


A8: After almost a month on March 1.
Q9: Did you have evidence on the loan?
A9: Yes, we executed a promissory note and issued a post dated check in her favor.

Q10: Did you agree with the interest?


A10: Yes, we agreed on a 10% interest.

Atty. Dano: Witness is presenting a copy of post dated check along with the promissory
note expressly indicating therein that the coupled postdated check shall be served only
as security for the contracted loan.

Q11: Did you immediately issued the check?


A11: Yes, sir.

Q12: Was there any other agreement aside from the check and promissory note?
A12: None, sir.

Q13: What are you asking from this Honorable Court?


A13: That the case filed against me be dismissed and for the private plaintiffs be
condemned to pay us moral damages in the amount of at least 50,000 each
defendant and attorney’s fees and other costs of litigation of at least 50,000
plus 5,000 per court appearance.

Q14: Do you want to add more in your testimony?


A14: No more for now, Sir.

“TRANSFEROR”);

CARMEN CARUNUNGAN, of legal age, Filipino, married, and a resident


of Surigao City, Philippines, (hereinafter referred to as the “TRANSFEREE”);

WITNESSETH: That-

WHEREAS, the TRANSFERORS had secured a loan from the TRANSFEREE


and as a security for the payment thereof, they offer a Honda CRV which they jointly
owned, more particularly described as follows:

accepted by the TRANSFEREE.

NOW THEREFORE, for and in consideration of the foregoing stipulations and


covenants and for the full acqittance of the obligation of the TRANSFEROR in favor of
the TRANSFEREE , the TRANSFEROR does hereby CEDE, TRANSFER and
CONVEY the aforementioned parcel of land together with the improvements found
thereon in favor of the TRANSFEREE.

title to the property is transferred to the names of the buyers.

NOW THEREFORE, for and in consideration of the sum of THREE MILLION (P


3,000,000) Philippine Currency, had paid by the vendee to the vendor, the SELLER DO
HEREBY SELL,TRANSFER, and CONVEY by way of Absolute Sale unto the said
BUYERS, his heirs and assigns, the certain parcel of land together with all the
