1. Give an explanation of the difference between a contract and a construction
contract.

The difference of contract and construction contract is Contract is any


agreement or commitment made between two or more persons or organization
to carry out specified task written in the contract. Moreover, it serves as a
written record and outline of the commitments made by both parties.
Construction Contract, on the other hand, is a specific contract or agreement
between the client and the general contractor which specifies the scope of work
for the contractor as well as their authority to subcontract any of the work, how
and what they will charge for the job, and any blueprints or work orders that
maybe applicable.

2. What do the terms “General Conditions” and “Special Conditions” mean in a


construction contract?

General Conditions in a Construction contract serves as the backbone


of the entire contract because it contains the right, responsibilities, and
relationship of the parties involved, defines the duty and privileges of the party
involved and likewise the rules that will govern the relationship. Moreover, the
categories that may be included in the Construction are the following: Roles and
Work of Parties, Time, Price and Payments, Changes (can be change in order,
change in directive, and minor changes), Suspension and Termination, and
Claims and Disputes.
Special Condition are sometimes called special provisions or
supplementary general conditions/particular conditions because it covers
specific matters in the project or special circumstances associated with the non-
technical aspects of the project that is not covered in the general conditions. It
is sometimes called supplementary general conditions because it could either
add to or amend provisions written in the general conditions. An example of a
special condition are requirements for completion date, owner provided
materials, and the name and address of the professionals that designs the
project.

3. Give an explanation of the difference between Bill of Materials and Bill of


Quantities.

Bill of materials differs with Bill of quantities in the sense that Bill of
Materials refers to the list of raw materials, sub-assemblies, intermediate
assemblies, subcomponents, and pieces as well as the quantities of each that
are required to create a product while Bill of Quantities, on the other hand, is
the document used in construction tenders in which the total number of
materials, components, and labor along with their costs are listed. It provides a
clear outline for suppliers and tenders about the work to completed and helps
the project owners control the cost, cash flow forecast and likewise helps in
creating the schedule of payment.

4. Identify the basic contents of a letter of invitation to bid/tender.


An invitation to tender provides enough information about the products
or services that the tenderers need to be able to create an accurate tender in a
definite style that will be easy to compare with other bidders. It includes the
following:
a. Letter of invitation to tender.
b. Form of tender.
c. Preliminaries (including pre-construction information and site waste
management plan).
d. Form of contract, contract conditions and amendments.
e. Employer's information requirements and BIM protocol.
f. Tender pricing document (or form of contract sum analysis on design
and build projects)
g. Drawing schedule.
h. Design drawings.
i. Prescriptive or performance specifications (on public projects, tender
documentation may include an output-based specification rather
than prescriptive or performance specifications and drawings)
j. Instructions to tenderers explaining the tender process.
k. The timescale for the tender process (including the address and time
for the return of tenders).
l. An explanation of how queries will be dealt with.
m. The evaluation process and any evaluation criteria.
n. The submission required in response to the invitation to tender.
o. Policy in relation to alternative or non-compliant bids.
p. Policy for providing feedback to unsuccessful tenderers.
