Enumerate the kinds of DEFECTIVE CONTRACTS arranged according to decreasing validity.

Rescissible Contract
A valid contract but can be rescinded.

Rescissible Contract
A defective contract which is entered into by guardians whenever the wards whom they represent suffer
lesion by more than one-fourth of the value of the things
which are the object thereof.

Rescissible Contracts
Those agreed upon in representation of absentees, if the latter suffer the lesion stated in the preceding
number.

Rescissible Contracts
Those undertaken in fraud of creditors when the latter cannot in any other manner collect the claims due
them.

Rescissible Contracts
Those which refer to things under litigation if they have been entered into by the defendant without the

However it can not be annulled if already ratified.

fraud.

Unenforceable contract
A contract that can not be enforced, unless ratified. It may also be called validable or meaning, it has no
effect now but may be effective upon ratification. Compared
to voidable contract, which has effect now but it may be
invalidated or valid until annulled.

Unenforceable contract
A defective contract which is entered into in the name of another person by one who has been given no
authority or legal representation, or who has acted beyond
his powers.

Unenforceable contract
A defective contract where both parties are incapable of giving consent to a contract.
Unenforceable contract
A defective contract that do not comply with the Statute of Frauds.

Void Contract
A contract that has no effect at all; It can not be ratified or validated since it is inexistent and void from the
beginning. Neither can the right to set up the defense of
illegality be waived.

Void Contract
A defective contract whose cause, object or purpose is contrary to law, morals, good customs, public order
or public policy.

Void Contract
A defective contract which is absolutely simulated or fictitious.
