RESOLUTION CONDEMNING ALL FORMS OF ATROCITIES, ABUSES, AND ACTS OF TERROR AND
VIOLENCE AGAINST INDIGENOUS PEOPLE, UPHOLDING AND PROTECTING THEIR RIGHTS
AGAINST COMMUNIST TERRORIST GROUPS (CTGs)

WHEREAS, Article Il, Section 5 of the 1987 Philippine Constitution provides that the
Maintenance of peace and order, the protection of life, liberty, and property, and the
promotion of the general welfare are essential for the enjoyment by all the people of the
blessings of democracy;

WHEREAS, Article Il, Section 22 of the same constitution provides also that the State
recognizes and promotes the rights of indigenous cultural communities within the
framework of national unity and development;

WHEREAS, Section 2 of RA8173, otherwise known as the Indigenous Peoples' Rights


Act of 1997 provides that the state shall recognize and promote all the rights of Indigenous
Cultural Communities/Indigenous Peoples (CCs/IPs) enumerated therein within the
framework of the Constitution;

WHEREAS, Executive Order No. 70, series of 2018 was issued by the Office of the
President to institutionalize the "Whole of Nation Approach" in attaining inclusive
sustainable peace, creating a National Task Force to End Local Communist Armed Conflict
(NTF ELCAC) and directing the adoption of a national peace framework;

WHEREAS, the "Whole of Nation Approach" is the government's policy for the
attainment of sustainable peace through addressing the root causes of insurgencies, internal
disturbances and tensions, and other armed conflicts and threats by prioritizing and
harmonizing the delivery of basic services and social development and packages by the
government, facilitating societal inclusivity and ensuring active participation of all sectors of
the society in the pursuit of the country's peace agenda;
WHEREAS, Section 21 of IPRA provides that consistent with the equal protection
clause of the Constitution of the Republic of the Philippines, the Charter of the United Nations
(UN), the Universal Declaration of Human Rights, the Convention on the Elimination of
Discrimination Against Women and International Human Rights Law, the State shall, with
due recognition of their distinct characteristics and identity, accord to the members of the
ICCs/IPs the rights, protections, and privileges enjoyed by the citizenry. It shall extend to
them the same employment rights, opportunities on basic services, educational and other
rights and privileges available to every member of the society;

WHEREAS, according to the data and information from the National Task Force to
End Local Communist Armed Conflict, more or less seventy per cent (70%) of PAs are
reported to be IPs. This is partly because of the CTGs program of establishing purported IP
schools for radicalization;

WHEREAS, it was reported and confirmed by the Armed Forces of the Philippines
Intelligence Unit, IP Youth/Students, and Former Rebels that these purported IP schools have
been the venues for teaching radicalization to IP students in parts of the country, during
and after which the IP minors are trafficked to various places in furtherance of the CTGs'
activities. The CTGs put up, sponsored, and opened these IP schools integrating the
Pambansang Demokratikong Paaralan in their curriculum and applied for permits or
accreditation with the Department of Education in a deceitful attempt to create a picture of
legitimacy;

WHEREAS, considering the complexities in addressing the abovementioned


problems and in line with the "Whole of Nation Approach" there must be concerted actions
with the other agencies in the Executive Branch, as well as responsive laws from the
Legislative Branches and supporting processes from the judiciary laws to reinforce IPRA and
other existing laws that safeguard and protect the ICCs/IPs.

NOW THEREFORE, on motion of Sangguniang Barangay Member DARYL D. ODRONIA,


Committee on Peace and Order, duly seconded by all present;

BE IT RESOLVED AS IT IS HEREBY RESOLVED to CONDEMN ALL FORMS OF


ATROCITIES, ABUSES, AND ACTS OF TERROR AND VIOLENCE AGAINST INDIGENOUS
PEOPLE, UPHOLDING AND PROTECTING THEIR RIGHTS AGAINST COMMUNIST
TERRORIST GROUPS (CTGs)

RESOLVED FINALLY, that copy of this resolution be known and forwarded to


concerned offices/agencies in support to the rights of the Indigenous Cultural
Communities/Indigenous People.
