1. Juan and Pedro borrowed Php150,000 from Ana, Lorna, and Fe in solidum. Eventually, Ana validly
condones or disregards the debt in the amount of Php100,000 as she feels indebted to Juan and Pedro
for their parents’ benevolence when both of her parents died in an accident since Juan’s and Pedro’s
parents provided moral and financial support to Ana after the tragedy.

a. What kind of obligation is involved in the problem?

The obligation involved in the problem is Solidary Obligation it means that each of the debtors is
bound to pay, and each of the creditors has the right to demand full compliance from any of the debtors. This
means that any in Ana, Lorna and Fe may demand the payment of P150,000 from Juan and Pedro, and the
creditors may ask the creditor, who requested payment from the debtors for their respected shares. The “in
sodium” word means for the whole as a whole. In this case, Ana, Lorna, and Fe are the creditors of Juan and
Pedro where each of them has the rights to claim their respective shares.

b. What is the effect of Ana’s act of condoning the debt in the amount of Php100,000 with
respect to Juan’s and Pedro’s debt? With respect to Lorna’s and Fe’s credit?
In this case, Ana is liable for the corresponding shares of its co-creditors because if Ana
ignores the P100,000 debts of Juan and Pedro, means that the only remaining amount is only P50,000 that
Juan and Pedro need to pay.

2. William and Harry obliged themselves to deliver to Elizabeth a bullet-proof car on her birthday. William
and Harry agreed in front of Elizabeth to contribute the amount that will be used to buy the car.
However, Harry failed to give his contribution to the purchase price of the car, hence, the car was not
delivered to Elizabeth on her birthday.

a. What kind of obligation is involved in the problem?

The obligation involved in the problem is Obligation with period because William and Harry
agreed to deliver the bullet-proof car to Elizabeth, but Harry was unable to make his contribution to the purchase
of the car, and in the Term or Period Classification. According to the source of the term or period, there is a
conventional or voluntary agreement where they have agreed and they have agreed to do so in front of
Elizabeth, so they have responsibility to fix the situation.

b. What should Elizabeth do?

Elizabeth needs to talk to William and Harry because they both agreed and if Elizabeth wants to
give her bullet –proof car her birthday she needs to cooperate with William and Harry. They need to talk what
plan they need to do in order to deliver the bullet-proof car in her birthday.
