1. Juan and Pedro borrowed Php150,000 from Ana, Lorna, and Fe in solidum. Eventually, Ana validly
condones or disregards the debt in the amount of Php100,000 as she feels indebted to Juan and Pedro
for their parents’ benevolence when both of her parents died in an accident since Juan’s and Pedro’s
parents provided moral and financial support to Ana after the tragedy.
a. What kind of obligation is involved in the problem?
The term “in solidum" denotes that Ana, Lorna, and Fe are considered Juan and Pedro's solidary
creditors. Each of them is considered an agent of the other as solidary creditors. As a result, each of
them may seek P150,000 in compensation from Juan.
Pablo, and then the other solidary creditors, may seek payment from the creditor who requested
payment from the borrowers for their individual portions.
b. What is the effect of Ana’s act of condoning the debt in the amount of Php100,000 with respect to
Juan’s and Pedro’s debt? With respect to Lorna’s and Fe’s credit?
If Ana has agreed to forgive the sum of P100,000. This means that only P50,000 will be obtained from
Juan and Pedro's hands. In accordance with the Civil Code, it is now the responsibility of the borrower
who made the condonation is responsible to his co-creditors for their respective parts. In this case, as
long as the debt is less than P150,000, the each creditor's equivalent part will be P50,000. Ana is
answerable to her co-creditors for their individual shares, thanks to Lorna and Fe's forgiveness.
2. William and Harry obliged themselves to deliver to Elizabeth a bullet-proof car on her birthday.
William and Harry agreed in front of Elizabeth to contribute the amount that will be used to buy the car.
However, Harry failed to give his contribution to the purchase price of the car, hence, the car was not
delivered to Elizabeth on her birthday.
a. What kind of obligation is involved in the problem?
Obligation with a period because William and Harry committed to give the bullet-proof to Elizabeth,
but Harry was unable to contribute to the car's purchase, and because of the Term or Term
Classification, the obligation has a period. There is a traditional or voluntary arrangement, according
to the source of the term or period, where they have agreed and have agreed to do so in front of
Elizabeth, so that they must fix the situation.
b. What should Elizabeth do?
Elizabeth must speak with William and Harry because they both agreed in that situation in front of
