1. Juan and Pedro borrowed Php150, 000 from Ana, Lorna, and Fe in solidum.

Eventually, Ana
Validly condones or disregards the debt in the amount of Php100, 000 as she feels indebted to
Juan and Pedro for their parents’ benevolence when both of her parents died in an accident
Since Juan’s and Pedro’s parents provided moral and financial support to Ana after the tragedy

a. What kind of obligation is involved in the problem?

The type of obligation involved in the problem is collective obligation.
Because there are two or more debtors and two or more creditors involved. The
defendants in this case are Juan and Pedro, and the creditors are Ana, Lorna, and Fe.

b. What is the effect of Ana’s act of condoning the debt in the amount of Php100, 000 with respect
to Juan’s and Pedro’s debt? With respect to Lorna’s and Fe’s credit?
I believe Ana's act of condoning or disregarding the debt in the amount Juan and Pedro
will be favoured because they have a debt of Php100, 000 will not be able to repay the
entire amount of money that they borrowed with the amount Instead; they will only pay
the remaining Php50, 000 in cash. Ana also feels obligated to Juan and Pedro because
their parents assisted her. For her moral and financial assistance. But with respect to
Lorna’s and Fe’s credit, believe it is not in their favour because it is their own money and
they lent it money in full, so it must also be paid in full. Furthermore, Ana should discuss
her decision with Lorna and Fe first, because it is their money, not just hers. Despite her
good intentions, she makes the wrong decision.

2. William and Harry obliged themselves to deliver to Elizabeth a bullet-proof car on her birthday.
William and Harry agreed in front of Elizabeth to contribute the amount that will be used to buy the car.
However, Harry failed to give his contribution to the purchase price of the car, hence; the car was not
delivered to Elizabeth on her birthday.

a. What kind of obligation is involved in the problem?

The kind of obligation that is involved in this problem is an obligation with a period.
More particularly, it is an obligation that is demandable after the lapse of a given period,
and hence it is a suspensive period. In this instance, William and Harry had agreed to
deliver the car to Elizabeth on her birthday. As a result, Elizabeth was able to make use
of the car on her birthday. It was also a unilateral obligation because it imposed an
obligation on only Harry and William to deliver the car on Elizabeth's birthday, while
there was no obligation imposed on Elizabeth. Elizabeth did not have anything to do in
order to be entitled to the money. An obligation with a period is defined as an obligation
whose fulfilment is done when a certain day has been fixed on which the obligation is
demandable when that day comes. The consequences of this obligation are subject to
the expiration of the agreed period.
B. What will Elizabeth do?
Elizabeth can demand that William and Harry deliver the bullet-proof car because the
obligation is fixed and demandable on Elizabeth's birthday.
