Activity: Republic Act No. 4136

1. What is Republic Act No. 4136?

Republic Act No. 4136 is a consolidated body of legislation governing land transportation and traffic
regulations. Additionally, the Land Transportation Commission was established, among other things. The
Act is broken into five chapters, which are as follows:
• Chapter 1 (Preliminary Provision Article) – This chapter is referred to as the "Land Transportation
and Traffic Code." It is a provisional act that regulates the registration and operation of motor vehicles, as
well as the licensure of owners, dealers, and drivers, among other things.
• Chapter 2 (Registration of Motor Vehicles) – This chapter established the requirement for motor
vehicle registration. In accordance with the provisions of this Act, all motor vehicles and trailers of any kind
that are used or operated on any Philippine highway or road must be registered with the Bureau of Land
Transportation for the current year.
• Chapter 3 (Operation of Motor Vehicles) requires that anybody wishing to operate possess a valid
and current license. Unless this Act expressly indicates differently, it is unlawful for any individual to
operate a motor vehicle without a valid license or to drive a motor vehicle in his possession.
• Chapter 4 (Traffic Rules) — This chapter contains a summary of all traffic rules in effect, including
speed restrictions. Any person operating a motor vehicle on a highway is required to do so at a safe and
reasonable speed, not exceeding the posted speed limit, taking into account the traffic, the roadway's
width, and any other conditions that may exist at the moment.
• Chapter 5 (Penalties and Other Provisions) - This chapter establishes sanctions against violators.
2. What are violations under RA 4136?

Numerous violations of RA 4136 address all facets of land transportation. This includes the failing
to register motor vehicles and the violation of traffic restrictions. For example, anyone killed or injured in
an accident caused by negligence, irresponsible or excessively fast driving will face prosecution under the
Revised Penal Code upon conviction of those responsible for the accident. Additionally, for invalid and
fraudulent registration of a vehicle, a fine of three hundred pesos or a term of imprisonment of not more
than fifteen days shall be imposed.

3. What institution is responsible for implementing the Act, and how are they implemented?

Legislation 4136 was implemented by a single municipality or provincial board that was authorized
and approved by the Secretary of Public Works, the Secretary of Communication and Land Transportation,
and the Secretary of Public Works. The President of the Philippines then signs it as a seal of approval.

4. As the law requires all motor vehicles to be registered, and considering our country's current traffic
situation, what are the forms of violation can you see and what are types of vehicles that aren't
registered yet but already run-on Philippine roads?

A court may impose a fine of three hundred pesos or a maximum of fifteen days in prison for
driving a vehicle with a delinquent, suspended, or invalid registration, or without registration or the
required license plate for the current year. Additionally, the statute declared that it included fake license or
registration. If you use or attempt to use a driver's license, identity card, certificate of registration, number
plate, tag, or permit granted under this Act, or if you falsely or fraudulently portray any delinquent or
suspended or revoked driver's license as valid and in force, In that scenario, you will be fined a minimum of
1,000 pesos and imprisoned for a maximum of six months, or both, at the court's discretion. In other words,
the penalties under the Revised Penal Code for making, manufacturing, distributing, or selling a driver's
license, identity card, certificate of registration, number plate, tag, or authorization that is an imitation or
similitude of those issued under this Act.
