Suit for the recovery of damages for breach of contract

Sir,

The plaintiff above-mentioned respectfully submits as under:

1. That the plaintiff is engaged in the manufacturing industry, and the

defendant is the manufacturer of t6he different kind of machinery.
2. On 15-6-2021, the plaintiff entered into contract with the defendant for the
purchase of the defendant’s machine for the manufacture of needles for a
total consideration of Rs 65,000. Under the said contract, the machinery was
to be delivered to the plaintiff on or before 15-7-2021. Here to annexed and
marked Exhibit A is a copy of the said contract.
3. That the defendant failed and neglected to deliver the said machinery to the
plaintiff on or before 15-7-2021. The plaintiff wrote registered letter to the
defendant, drawing his attention to the breach of the said contract. Hereto
 annexed and marked as B (collectively) is the copies of the said two letters
and postal acknowledgement.
4. That the defendant gave no reply and also not delivered the machine.
5. That the plaintiff submits that by failing to deliver the said machine in the
time, defendant has caused to the plaintiff a financial loss, which is
estimated to be Rs. 25,000 as per the details given in exhibit C hereto.
6. That the cause of the action accrued on 15-6-2021, when the delivery of the
machine was not made.
7. That valuation of the suit was Rs. 25,000 on which the requisite of the court
fee has been paid.
8. That this court has the jurisdiction as the cause of action accrued within the
territorial limit of the court.
9. That the suit has been filed within the period of limitation.

PRAYER

The plaintiff, therefore, prays for the following reliefs:

A. That defendant be ordered and directed to pay to the Plaintiff the said sum of
Rs 25,000/- being the loss suffered by the plaintiff;
B. The cost of the suit be allowed to Plaintiff ;
C. Such further and other orders as may be necessary and expedient.
