EX-PARTE MOTION TO RELEASE BAIL BOND

Accused-movant, through the undersigned counsel, unto this

Honorable Court, most respectfully moves for the release of his Cash Bail
Bond posted by him in the above-captioned case, alleging as follows that:

1. The herein accused-movant has posted his Cash Bail Bond for
his provisional liberty during the pendency of the above-
captioned case;

2. The Honorable Court in its Order ordered the dismissal of the

instant case for Violation of R.A. 11332. The dispositive portion
of which reads as follows, to wit:

“WHEREFORE, given the foregoing

premises, this instant criminal case against
ABCD Y. DELA CRUZ, is hereby DISMISSED.

SO ORDERED.”

3. The aforesaid Order of the Honorable Court, however, failed to

provide for the release of the Bail Bond posted by the herein
accused-movants;

4. Hence, this Motion.

PRAYER

WHEREFORE, in view of the foregoing, it most respectfully prayed

unto this Honorable Court that the Cash Bail Bond posted by the herein
accused-movant be released.

Other relief just and equitable are likewise prayed for.
