Eligibility for Review

 Inmate's conviction is final and


executory.
 He has served the minimum period of
the indeterminate sentence imposed
on him.

 Inmate is serving an indeterminate


sentence and the maximum sentence
of which exceeds 1 year.

 Inmate has no pending criminal case.


 Inmate is serving sentence in the
national penitentiary unless
confinement in a municipal, city,
district, city and/ or provincial jail is
satisfied.

 Whenever the Board of Pardons and


Parole finds that:
 there is a reasonable probability
that, if released,
 the prisoner will be law-
abiding and;
 that his release will not be
incompatible with the interest
and welfare of society and ;
 when a prisoner has already
served the minimum penalty
of his/her indeterminate
sentence of imprisonment.

Disqualifications

 Offenses are punishable by the death


penalty, reclusion perpetua or life
imprisonment.
 Convicted of treason, conspiracy or
proposal to commit treason or
espionage, misprision of treason,
rebellion, sedition or coup d’ etat and
piracy or mutiny on the high seas or
Philippine waters.
 Habitual delinquents.
 They escaped from confinement or
evaded sentence.

Disqualifications

 Those who were granted Conditional


Pardon and violated any of the terms
thereof.
 Those whose maximum term of
imprisonment does not exceed 1 year
or those who have definite sentence.
 Those convicted of offenses punished
with reclusion perpetua or whose
sentences were reduced by reason of
RA 9346.
 Those convicted for violation of the
laws on terrorism, plunder and
international crimes.

Disqualifications

 Those suffering from any mental


disorder as certified by a government
psychiatrist/ psychologist.
 Those who have pending criminal
case/s.
 Those whose conviction is on appeal.

Mandatory Conditions

 To report to the probation office


within 15 days.

 To report at least once a month for


those who are residing outside Metro
Manila, twice a month for those
residing within Metro Manila.
