1.a) Decide the case filed against Cabrera and any penalty to be.
 The case filed against Cabrera for immorality by complainant Escolano to the PRC will not prosper
since Cabrera is not a registered Professional Teacher.

b) Can Gumaca National High School terminate Cabrera and Escolano? Explain
 Gumaca National High School cannot terminate Cabrera and Escolano but they can be terminated by
the DepEd Investigating Committee (under Rep. Act No. 4670 the CSC (under P.D. No. 807) had
jurisdiction to try the administrative case. RA 4670 Section 9 The Magna Carta for Public school orders
of his employer or representative in connection with his works

2. a) If you are the Principal of Morelo National High School, what would your decision be for the two
teachers if Pentinio will file an administrative complaint against them? Explain

 If I am the principal of Morelo National High School I will file an Administrative charges against two
teacher b) Are the acts of the two treachers punishable under RA 7610? Explain

3 B.) The acts of the two teachers are punishable under RA 7610 because the act is concerning
about Child abuse who are persons below 18 years old. Barros is a senior high school student.
A regular senior high school student has an age of 16-17 years old. Cadag-Marin violated

 The dismissal of the two teachers valid under RA 4670, and under RA 7836 Sec. 23 Revocation of the
Certificate of Registration, Suspension from the Practice of the Teaching Profession, and
Cancellation of Temporary or Special Permit. — The Board shall have the power, after due notice
and hearing, to suspend or revoke the certificate of registration of any registrant, to reprimand or to
cancel the temporary/special permit of a holder thereof who is exempt from registration, for any of
the following causesb) If you are the principal of said school, what would be your action when your
teachers would have such kind of relationship.
 If I am the principal I will review to them the RA 4670 or the Magna Carta for public school
Teachers as well as the RA 7836 or the Revocation of the Certificate of Registration
Suspension from the Practice of the Teaching Profession, and the Cancellation of Temporary
or Special Permit for them to realize what they are doing is wrong.

4. a) Will the criminal case of sexual harassment prosper against principal Siena?

 According to RA 7877 or "Anti-Sexual Harassment Act of 1995." Section 7 that Any action
arising from the violation of the provisions of this Act shall prescribe in three (3) yearsb) What
about the case filed before DepEd? If you are the chairman of the investigating committee ,
what would be your decision?
 The case filed before DepEd will prosper. If I am the chairman of the investigating committee I
will verdict him guilty of grave misconduct under RA 4670 Section 7 or the Code for
Professional Conduct for Teachers.

5. a) Can Asuncion be dismissed from his work as public school teacher if the case was filed within
the DepEd? Explain.

 Asuncion cannot be dismissed from his work as public school teacher if the case was filed within the
DepEd. According to RA 7610 Article I sec 3. (b) "Child Abuse" refers to the maltreatment, whether
habitual or not, of the child which includes any of the following: (2) Any act by deeds or words
 which debases, degrades or demeans the intrinsic worth and dignity of a child as a human
being; But the action of Asuncion does not debase, degrades or demeans the intrinsic worth
and dignity of a child as a human being.

b) Will the defense that the students continuously playing ML the whole duration of his class, a
ground for Asuncion to shout at them in said manner? Explain.

 The action of Asuncion may not display a good deed of a professional teacher but as a human
being irritated by the bad attitudes of her learners, we cannot blame Asuncion for doing such
action because they are not anymore obeying their teachers. 6. a) Will the two cases prosper?
Explain
 The first case will not prosper because embracing and kissing during special occasion doesn’t
show sexual harassment. It is just his way of greeting. The next case however will prosper and
President is liable on being charged from sexual harassment because he is already massaging
her back without permission then fondling her breast. b.) What if the case is for disgraceful and
immoral conduct? Will the two case prosper? Explain.
 If the case is for disgraceful and immoral conduct then the two cases will prosper. According to
RA 11313 Section 2 Declaration of Policies. -It is the policy of the State to value the dignity of
every human person and guarantee full respect for human rights. It is likewise the policy of the
State to recognize the role of women in nation-building and ensure the fundamental equality
before the law of women and men. The State also recognizes that both men and women must
have equality, security and safety not only in private, but also on the streets, public spaces,
online, workplaces and educational and training institutions.
