Real Estate Mortgage

KNOW ALL MEN BY THESE PRESENTS:

This Real Estate Mortgage, made by and between:

FEDERICO GOMEZ, of legal age, married, and a resident of Brgy. Sasa Maydolong Eastern


Samar, Philippines (hereinafter known as the MORTGAGOR);
- and -
SEBASTIAN DIAZ, of legal age, married and a resident of Brgy. Matina, Borongan City,
Philippines (hereinafter known as the MORTGAGEE);

WITNESSETH; That:

The MORTGAGOR is indebted unto the MORTGAGEE in the sum of ONE-MILLION


PESOS (P1,000,000), Philippine Currency, receipt of which is acknowledged by the
MORTGAGOR upon the signing of this instrument, payable to the order of the within a
period of THREE YEARS at Twenty-Eight Thousand (P28,000) starting on February
22,2018 and on every month thereafter until fully paid, with interest thereon at the rate of five
percent (5%) percent per month.

NOW, THEREFORE, for and consideration of the afore-mentioned indebtedness, and to assure


the performance of said obligation to pay, the MORTGAGOR does hereby convey and
DELIVER by way of MORTGAGE unto the MORTGAGEE, (his/her) heirs, successors and as
signs, the following parcel of land, together with all the improvements found and standing
thereon, more particularly described as follows:

“A parcel of land (Lot No. 2927-A, Psd-07-020869, being a portion of


Lot No. 2927), situated in Mabini Street. Bounded on the E, along line 1-2 by
Mabini Street; on the S, along line 2-3 by Lot 2927-C; on the W, along line 3-4 by
Lot 2927-B; on the N, Barangay 9 x x x containing an area of twenty-two square
meters (22 sq. m.) more or less, covered by Transfer Certificate of Title No. T-
16747 in the name of Sebastian Diaz.”
That it is the condition of this Mortgage that should the MORTGAGOR perform
the obligation to pay the afore-cited indebtedness of ONE-MILLION PESOS (P1,000,000)
together with accrued interest thereon, within the agreed term, this Real Estate Mortgage shall be
discharged and shall at once become null and void and of no effect whatsoever, otherwise, it
shall subsist and remain in full force and effect and be subject to foreclosure in the manner
and form prescribed by law.

IN WITNESS WHEREOF, the parties have these deed of Real Estate Mortgage to be signed on
January 25, 2018 at Borongan City, Eastern Samar.
