This declaration is made regarding the internship report which has been prepared and drafted
under the supervision of Adv. Agyay Trivedi, Chamber, Lawyers' Chamber, High Court of
Chhatisgarh, 474005. It contains the work accomplished during the internship which was
assigned during the internship. This work was done in respect of the partial fulfilment of the
requirement for the award of degree of LL.B.

This internship report has not been submitted either in whole or in part to any other Law
University or affiliated Institute, recognized by the Bar Council of India for the award of any law
degree or diploma within the territory of India.

Through this detailed Internship Report, it is aimed to give a brief summary about the
professional workspace experience in the legal field.

About
the workplace

THE HIGHCOURT OF CHHATISGARH

The present state of Chhattisgarh is newly born state, created on November 2000 by Madhya Pradesh
reorganization act 2000 hereinafter referred as act of 2000. The High court of Chhattisgarh was
established with the act of 2000 which was allotted temporary building in the Gandhi Chowk
Bilaspur. Later the Permanent campus of 77 Acres has been allotted to the Chhattisgarh High court .

The High Court of Chhattisgarh is one of the most beautiful campus having really enriched Library
well efficient court halls and Lawyers Chamber in Bar Room. The High court start its working in
10.30 AM so we were expected to report at court at 10.00 AM. We were expected to seniors
chamber in Bar Room and thereafter court rooms were allotted to each of the intern where they will
have to observe the proceeding and watch for our office case, duty also includes to call senior when

his turn of argument comes.
The High Court has beautiful canteen of Indian Coffee House where one can have his lunch we
usually visit to canteen during lunch.

OFFICE
The office cum residence of Advocate Rupesh Trivedi is situated at Agyay Vihar Road Bilaspur
. The office is based on two big room one a conference room and another room dedicated for seniors
chamber including space for the interns which have few computer to work.
We were expected to report office at 6.30-7.00 PM and to stay office till 10.PM. The working in
office includes taking dictations from senior participating in client conference and researching of the
upcoming cases which has been listed in the week.
The environment of office is learning friendly having a very good library which have books on
Arbitration, Interpretation,Service Laws and has a good collection of Journals A.I.R, SCC and
CGLRJ.
The senior used to have discussion on recent legal debates in law at the end of the day and takes brief
updates about the work performed by the Intern in whole day.
INTRODUCTION

Internship fulfil an important component of both academic and practical education in law. The
integration of professional experience into the learning process is highly effective in developing
your understanding of the law in actions, as you are able to observe and perceive
the relevance and application of theory to practice. Consequently, the program is not simply
'work experience' but a significant educational experience.
In a workspace setting you are exposed to the reality of the practice of law in all its dimensions -
the integration of different areas of law, policy issues; the application and development of skills
to analysis and resolution of client concerns; ethical responses to situations which arises
unexpectedly and spontaneously, issues of professional responsibility including responsibility to
clients and case management; and the operation of the government and court system in the legal
process.
Since the inception of LL. B program at the Faculty of Law- Guru Ghasidas Vishwavidyalaya2, a
practical experience component i.e., internship has been part of the compulsory subject and thus
of the LL. B degree. The Legal Internship Program is not designed to teach students how to be
good lawyers (or how to be lawyers at all) it takes more than study at university to do that. The
objectives are to-

 Expose you to the law in operation in contexts where you will come to perceive aspects
of law which cannot be learned from reading or hearing about it;

 Allow you to perceive ways in which the formal leaming you acquire at university may
be applied in practice and thereof to develop an appreciation of the practical
dimensions of legal principles:

 Enable you to relate the different areas of legal practice to the importance of developing
the skills of legal research, communication, drafting, practice management and problem-
solving; and

A central University
 Enable you to observe and reflect upon the values, ethical standards and conduct of the
legal profession in practice and to develop your own attitudes of professional
responsibility.

The classroom study and practical training in the field of law is considered as two sides of coin.
The legal profession is one of the professions which are considered incomplete without the
practical training. An additional benefit of the internship program is that to provide you with an
opportunity to observe the way in which law operates in a practical milieu, and so may assist you
in making future career choices.

Report
As per our syllabus, I may classify this internship diary in to two components:

1. Factual and Analytical information about the internship


2. Legal Drafting
3. Client Dealing and;
4. Cases

Daily Internship Duties:

 I was assigned to read minimum of five case files to learn how files are maintained
and how the records are maintained.
 I was assigned to observe the proceedings during the Examination-in- chief, Cross
Examination and Final Arguments Supporting the lawyers that come into the office and
program.
 Sitting in on meetings and appointments and offering required assistance.
 Office type organizational work photocopying, organizing papers, keeping files in order,
organizing the desk.
 Reading any suggested law related materials for my own benefit. Helping clients
if possible and if I am able to since I don't know much about the field yet.
 Interacting to various lawyers in our office and provide assistance to them.
 Research on judgments that are related to facts of case.

Case Dealing (Types)

The office mainly dealt with Criminal, Civil, Service and Family Matters. With the due guidance
of the office associates I was working with service matters then civil and after learning the
basics I was comfortably dealing with all types of matters.

Trial Observation

Two cases from the internship office are mentioned below with necessary details and
observations

CASE – I

Virendra Jatav Vs. State of Chhatisgarh. [ 890/2020 (Writ Appeal)]3

Date – 10|12|2020

Facts-

1. Appellant appointed as the constable in the police force at Chhatisagarh,


2. Appointment of the appellant got cancelled due to his ongoing case
3. The ongoing case against the appellant was under 363,366,506,34 of IPC, in which he
got acquittal after filing of this case.
4. The subject matter for the on-going case was –

0Appellant and accused were in relationship from class 10th. The girl was patidar
Both of the got married when girl was 18 ½ years old with the due rituals of Arya Samaj, but
it was the case of inter-caste marriage, and due to family pressure girl false claimed about
the forced marriage and rape by the accused.
Matte went into the investigation, and evidences like love letters written by blood,
intimate WhatsApp chats were observed.
By observing the case with all the evidences, the Trial Court denied the charges by the
Petitioner (Girl)
The petitioner then went to the Hon’ble High Court of Madhya Pradesh, Bench at
Gwalior and in regard of that the appointment of boy was cancelled.
5. The current Writ Appeal was filed to quash the order of cancellation for the appointment5.

6. The final hearing date and the judgement of the court is yet to come.

Cases Referred –

1. Avtar Singh vs Union of India [2016 (8) SCC 471]

2. R.P Kapoor vs Union of India [ AIR 1964, SC 787]

Current Position of the Case –

Currently the case is filed and two hearing have happened in which the facts and the matter was
briefly presented before the Hon’ble Justice.

Defendant side was constantly referring the rule book of services and certain guidelines and
conditions of the appointment whereas the petitioner’s side was giving focus on two major key
points i.e.

accused is acquitted after full consideration of prosecution evidence and that the prosecution had miserably failed to prove the
charges levelled against the accused
2- Moral turpitude 7

Personal observation on the case

In 2014, the Delhi Commission of Women put out a report stating that 53.2% of rape cases filed
between April 2013-July 2014 were false8. This statistic was cited gleefully by men’s rights
activists and the like to decry that woman speaking out about rape or sexual violence were, in all
probability, lying or taking revenge on men. This sentiment is not new – women have constantly
been disbelieved when speaking out about gender-based violence.

Therefore, a strict ruling to protect the rights of innocent citizen shall be made. As such cases are
increasing in numbers.

Also, a strict punishment can also be implemented to reduce such cases as because men can be
seen becoming easy victim of this false claims.

CASE – II

Malkhan Singh Rathore Vs. State of Chhatisgarh [2021 CRR]9

Date – 05|01|2021

Facts-

1. Malkhan Singh Rathore, co-accused along with Gaurav Singh Tomar co-accused

2. Both the accused gave the statement as follows –

Both of them were walking down the street on the Nehar Road10 where they saw

deceased standing with his pulsar bike.

Deceased asked for the Matchbox to light up his cigrate in reply of which the Accused

denied.

On denial for the Matchbox, deceased started hitting them and beating them up.

To save himself (Private Defence) and in the heat of the moment co accused Malkhan

Singh hit the deceased with his katta (local made gun), which hit the deceased on chest

and caused his death.

Gun was recovered with the fingerprints.

Current Position of the Case –

Currently the case is filed and one hearing has happened in which the facts and the matter was
briefly presented before the Hon’ble Justice and motion hearing is yet to be started.

Personal Observation on the Case

After many sittings and interaction with client and associates I observed that unnecessary delay
making practices were happening by the defendants, it is the case of private defense where a
person shot the other. the case is not open and shut types, there are several aspects into it , a lot
of cross examination needs to be done.

At the end rule of law and the spirit of justice should prevail.
Client Dealing

One thing you must always remember while dealing with clients is to be always on their side,
understand what they are going through and to think from their point of view. Also, to survive in
this field one needs to have excellent relations with everyone (even if you know they’re on the
wrong side)

The internship also taught me a great deal of professional ethics. One must sympathize with their
clients and make sure that they are satisfied with the work. Working directly under a Supreme
Court advocate gives you an opportunity to learn more as you can have his full attention. He
advised us on how to deal with clients, how to be professional about it and how to act in front of
the Hon’ble Judges of the Supreme Court.

There were times when I was given clerical work like typing and also, it used to get monotonous
as we only got research work related to Criminal matters. However, I was lucky enough to get
some drafting work and was asked to file a reply for a matter related to Consumer Protection
Act.
Pre-Trial Preparation

The pre-trial phase of a criminal proceeding starts with the filing of the first information report
(FIR) and ends with the filing of the chargesheet with the Magistrate if the investigation
conducted has convinced the investigating officer to bring the matter to trial. We shall now delve
into this pre-trial phase by analyzing the various steps which lead to the filing of the chargesheet.

With all the hard procedure and structure following the law has provided many rights for the
persons involved in the pre-trial process and mainly for the accused. As, the accused is the one
that has a lot of rights about to get violated.
CONCLUSION AND RECOMMENDATIONS

People are more than happy to give you work and teach you how it is done. If you wait for work
to be given to you, you’ll end up sitting idle and learn nothing. The law is not what we learn
from our books, it is much beyond that. Internships are an opportunity to apply the knowledge of
the law practically.

Another important lesson that I learned while I was interning under Mr. Sharma was to have
“patience”. As you know, they say, “Rome wasn’t built in a day.” It takes time to get to the top.
He once said: If you want to get noticed and be successful you must have patience and while
you’re at it keep on learning.

Work Experience

It provides a person with real life work experience in a prospective career field. It gives you a
close look at what you are really getting into, so it is very important to choose an internship
which interests you the most. The key to making the most out of an internship is to work to the
best of your abilities and you will shine in the world like bright stars in the sky.

Work environment really matters a lot. If you have cooperative and helpful people around you, it
gets easier to get the job done. Most of the work was given to me by Mr.Trivedi himself. He
used to make sure that I always have some or the other work to do and was always happy to
teach us something new. If you are honestly sincere and hardworking, he makes sure that you
get a lot of work. Another good thing about this internship was there was no workload. He
believed
in getting the work done at your own pace, but if you’re taking your own time, you cannot make
any mistakes. If you get it wrong, you are asked to do it all over again. The work done should
be crisp and quality work.

Adv. Rupesh Trivedi is a great source of inspiration. According to him the more we read, the
more we learn. He used to share his experiences of how things actually work in the legal world,
his struggles and how he became a successful lawyer. There were times when he used to quote
Shakespeare in order to keep us motivated. One of the inspirational quotes was: “Ignorance is
the curse of God; Knowledge is the wing wherewith we fly to heaven”.
