WARNING ACKNOWLEDGMENT / ASSUMPTION OF RISK

AND RELEASE FORM

1. WARNING: This activity including but not limited to SCUBA Diving or Snorkeling in or outside a cage
among SHARKS and other CREATURES of the sea is inherently dangerous and can result in serious injury or
death. THE MARITIME AQUARIUM AT NORWALK, INC hereby disclaims all liability associated with your
participation in this activity. Only those individuals who are in good health, physically fit, experts in SCUBA
diving and who are actively and regularly engaged in SCUBA diving should consider engaging in this activity.
The use of a cage does not minimize or eliminate this risk of serious personal injury and/or death.

2. RELEASE OF LIABILITY: The undersigned, being an adult and possessing the necessary health, fitness,
experience, expertise and training to engage in this activity, in consideration of being permitted to participate in
the diving expedition hereby gives up and releases all rights and claims which I or my heirs, executors,
administrators and assigns may have to make a claim against or sure THE MARITIME AQUARIUM AT
NORWALK, INC or its agents, servants, employees, their assigns or anyone else for any reason, including
personal injury, property damage or wrongful death, which I might suffer as a result of engaging in this activity
including but not limited to SCUBA diving. This means that if anything goes wrong or if I suffer any injury of
any kind or any damage to property or any kind that neither I nor anyone acting on my behalf or on behalf of my
hers or estate can make a claim against, sue, or recover any money from THE MARITIME AQUARIUM AT
NORWALK, or its officers, directors, agents, dive leaders, instructors, captains, servants, employees or
members in general because of my participation in this activity and related activities.

3. ACKNOWLEDGMENT AND ASSUMPTION OF RISK: I acknowledge that I have been informed that a
risk of injury and death exists and I alone assume this risk of participating in this three-dimensional sport of
SCUBA diving, snorkeling or swimming among SHARKS and other CREATURES of the sea. I acknowledge
that I have read this document in its entirety and have been fully and completely advised of the potential dangers
of engaging in this activity and that I am not relying on any statements, written or oral, or promises of any kind
made to me by anyone, including but not limited to THE MARITIME AQUARIUM AT NORWALK, INC and
its agents, servants, and employees about any matter or anything in deciding to engage in this activity and to
execute this document.

4. The undersigned hereby agrees to follow the rules and regulations of THE MARITIME AQUARIUM AT
NORWALK, INC which are part of this agreement. This document applies to all and any further activities in the
aquarium.
