a) Examine the different legal thoughts in Islamic law
b) Using relevant examples, give the main reasons for the
conflicting legal rulings
INTRODUCTION
The Islamic legal schools of thought were Founded considerably
during the period after the death of the prophet. That is to say,
during the era of the righteous caliphs. During this period, the
Islamic legal school of thought was one and was that of each of
the righteous caliphs since the final say in legal matters rested
with them.

We should bear in mind that these schools are not sects, they are
methods of interpretation. Therefore, we see that in the later
years after the prophet’s death, there emerged a number of legal
schools of thought of which the most outstanding were four
which existed until present day.
These include the following,
1) The Hanafi school of thought
2) The Malakite school
3) The shafite school
4) The Hambalite school

THE HANAFI SCHOOL OF THOUGHT (699-767 A.D)


This was the earliest school founded by Imaam Abu Haneefer.
Biography
His real name was Nuuman Bin Thabit Bin Zuutwa. He was born in the
year 702 AD in Kufah in Iraq. He was born to Zuutwa a muslim silk
merchant of Persian origin.
He acquired knowledge from a great scholar Hamad Bin Zayd for a
period of 18 years whom he succeeded at the age 40 hence becoming a
prominent scholar in Kufah.
His formation of the school
Imaam Abu Haneefah based on the principle of group discussion as his
teaching method, in other words he would present alegal problem to
his students for debate and discussion and emphasized in the end to
record its solution whenever they arrived at a unified position. This
would be appropriate to say that the Hanafi school of thought was as
much a product of Abu Haneefahs students effort because of their
interactive approach to making legal rulings as well as aproduct of Abu
Haneefahs effort.
