INTERRELATIONSHIP

These three fields are inherently linked even though they are very different. Law and
politics cannot be separated.
• Law governs politics, and the law is the product of the political process.
• Politics is the product of negotiation, bargaining, persuasion, and ultimately
majority preference, which is expressed through the ballot box.
• Judges and justices interpret and apply laws, and in doing so, they invariably
shape and limit political and public policy.
INTERRELATIONSHIP
• Miro Cerar* (2009), melihat perpektif adanya hubungan antara politik [politics] dan
hukum [law]:
➢ “Law and politics as social phenomena are two emanations of the same entity (a monistic
ontological conception), regarding which their separate existence is only a consequence of a
human dualistic or pluralistic perception of the world (a dualistic ontological conception).”
➢ Furthermore, the difference between law and politics is, from a deeper ontological
perspective, in fact only illusory, for reason of which also in the fields of legal and political
theory and philosophy there are conclusions regarding the partial or complete overlapping of
law and politics, sometimes even the equating of the two that raises a crucial question of
how both notions are defined.

• Hubungan antara politik dan hukum memiliki fungsi progresif dan fungsi
perlindungan. Hukum dan politik, secara terpisah atau bersama-sama, keduanya
mendorong dan menekan pengembangan hubungan masyarakat, sementara
keduanya juga berfungsi untuk mewujudkan keadilan dan ketertiban. Inti dari
"terpisah dan terhubung" tetapi tidak keberadaannya adalah untuk membantu
mengatur perbatasan satu sama lain. Perbatasan ini mencegah keberpihakan satu

• However, law is never a pure form through which political content would be
realized, since it is in the very nature of law to be relatively autonomous or
independent.
• Politics cannot exist without the law, since the law forms it and keeps it within
certain limits that are dictated above all by the ideas of justice and social order.
But, law could not exist without politics, since politics gives law its driving force
and its "rough content" or substance, which law then adapts to its autonomous
framework and develops its final form, expressing it in a specific normative
manner.

Changing the nature of critical legal position

• The Politics of Law [D. Kairys ed. 1982] is that discussion is moved to a
fundamentally different plane. In consonance with a growing movement in the
social sciences, these essays mark a greater refinement of critical reflection.
Arguments are becoming increasingly concrete and analytically precise.
• Most significantly, this development indicates not merely that critical legal positions have
attained greater clarity but that their nature has changed. While still affirming that legal
decision-making does involve subjective choice and does reflect dominant economic interests,
the new positions cannot be typified this transparently.
• These essays attest that the days of the monolithic characterization-the law as nothing but
subjective choice, the law as nothing but a reflection of an underlying economic base-may
swiftly be passing. The concreteness and precision of these essays aid not simply the
demystification of law but the demystification of the critical stance taken toward law. This is a
major advance, and it makes a critical legal position much more compelling.

THE LAW’S CLAIM TO OBJECTIVITY
2. Aspek kedua dari model objektivitas hukum adalah bahwa objektivitas yang
diklaim tidak sekadar formal tetapi juga netral nilai.
• Perdebatan di sini adalah bahwa Objektivitas hukum memerlukan perlakuan
yang sama secara formal untuk semua. Ini adalah karakterisasi umum dari
hukum dan negara sebagai penengah yang netral, bebas nilai, independen
dari dan tidak terpengaruh oleh hubungan sosial dan ekonomi, kekuatan
politik, dan fenomena budaya.

EARLY CRITIQUES
• Criticism of the value-neutrality of the law springs in large part from Marxian
sources. Here the argument was that the law is not at all subjectively capricious, a
matter of individual judicial choice. Rather, the view was that the interests of
capital determine the logic-and results of legal decision-making. [W]hether
employees had won or lost a case [in labor law], doctrinal developments were
viewed as 'expressions’ or 'emanations' of a unified, pre-given historical subject
(e.g., 'monopoly capitalism'). The law was said to be merely reflective of the
power of the ruling class in the state or of the inevitable logic of capitalism.
