I,  SANTHOSH   GAJANAN   BHAT,   B.A.L.,   LL.B.,

I Addl. Sessions Judge, Kolar,  do hereby charge you

the above named accused as under: ­

That on 20.05.2018 at 11:00 p.m., near the house of

A2   –   Rajashekhara   situated   at   Khadripura   Village,   Kolar

Taluk, you A1 to A5 with common object had  agreed to do

an   illegal   act   to   wit   entered   into   criminal   conspiracy   of

committing murder of Sri. Bharath due to previous ill will,

and that you have thereby committed an offence punishable

under  Section  120B r/w Section 149 IPC  and within my

cognizance.

That   on   21.05.2018   at   around   8:30   a.m.,   near   Sri.

Savaramma Temple situated at Khadripura Village, you A3 –

C.   Venkateshappa   with   common   object   had   wrongfully

restrained  Sri.   Bharath   (deceased)   &  CW2   –   Sri.

Shyamasundar,   and   that   you   have   thereby   committed   an

offence   punishable   under  Section  341   r/w   Section   149

IPC and within my cognizance.

That on the  above said date, time & place,  you A4 –

Narayanamma  with   common   object  intentionally   insulted

and thereby gave provocation to Sri. Bharath (deceased) &

CW2 – Sri. Shyamasundar  intending that such provocation

would cause them to break the public peace, and that you

have   thereby   committed   an   offence   punishable   under

Section  504   r/w   Section   149   IPC  and   within   my

cognizance.

That on the above said date, time & place, you A1 to A5

with   common   object   committed   murder   by   intentionally

causing death of Sri. Bharath by you A1 – Shivaraj poking

with knife on his left abdomen and you A2 – Rajashekhara

poking   with   knife   on   his   right   abdomen   &   right   shoulder

and that you have thereby committed an offence punishable

under  Section  302   r/w   Section   149   IPC  and   within   my

cognizance.

That on the above said date, time & place, you A1 to A5

knowing that the offence viz., murder punishable with death

or imprisonment for life has been caused and with common

intention   caused   the   certain   evidence   connected   with   the

said offence to disappear to wit, washed the knives used in

the commission of offence with water with intent to screen

yourselves   from   the   legal   punishment   and   that   you   have

thereby   committed   an   offence   punishable   under  Section

201 r/w Section 149 IPC and within my cognizance.

That   you   A1   to   A5   committed   the   offence   of   murder

punishable   under   Section   302   IPC   and   that   you   A1   –

Shivaraj   &   A2   –   Rajashekhara   abetted   A3   to   A5   in   the

commission   of   the   said   offence,   which   offence   was

committed in consequence of abetment of A1 & A2 and you

A1 to A5 were present when the offence is committed, and

that   you   have   thereby   committed   an   offence   punishable

under Section 109 r/w Section 114 & 149 IPC and within

my cognizance.

And I hereby direct that you accused be tried by me on
the above said charges.
