STATEMENT OF FACTS

ABOUT UNION OF DIANA

Union of Diana is a democratic republic country which is located in South Asia. Diana has
second largest population in the world with total population of 130 crore people. Diana has 15
states and 5 Union Territories. Diana is included in the list of five largest producers of
pharmaceuticals as its supply of generic drugs constitutes around 20% of the global export.

OUTBREAK OF DOVID-19

In January, 2020 a pandemic arose because of the virus named DARS- CoV-2 or Doronavirus.
The disease caused by this virus was named as Dovid- 19. Diana faced a rapid increase in the
cases of Dovid-19. The people suffering from Dovid-19 faced mild respiratory problems and did
not require any special treatment. Only people suffering with serious medical problems like
cancer, diabetes, chronic respiratory disease and cardiovascular disease faced serious problem.
The Union of Diana was hit by the second wave of pandemic in March 2021 and there was
sudden rise in Dovid-19 cases. Second wave is more contagious and severe and is more prone to
the younger generation. In the Union of Diana, a State named Ariana recorded constant increase
in Dovid-19 cases in the quarter of January to March 2021. High number of deaths were also
recorded due to Dovid-19 in the state.

MEASURES ADOPTED BY CENTRAL & STATE GOVERNMENT

Diana did not has adequate health facilities to fulfill the need of its large population and many
thought that the development of vaccine as the only way to save life of people of Diana. So the
Central Government along with the research institutes, private companies worked thoroughly and
maximized the strength of vaccine manufacturing to meet the demand of the people of Diana. In
order to distribute the Dovid-19 vaccine earliest, Diana relaxed the regulatory approval process.
On 1st January, 2021 a vaccine named ‘Hivovi’ that was developed and manufactured by
Myhealth Pvt. Co Ltd was approved. On 10th January, 2021 the vaccine process started in the
country which was controlled by Central government. The vaccination process was only
available to the citizen above the age of 45 years. In the following months vaccine of other
private manufactures were also given the approval for emergency use which were available for
free. The Central Government made a contract with various private manufacturing companies for
the production of sufficient vaccine by 1st March, 2021 for the vaccination of the entire
population by November 26, 2021. The government was of the view that it was important to
protect the vaccine manufactures from the lawsuits of adverse effects as well as silly claims so
that they can focus on the production of vaccines, so on 5th March 2021, the Epidemic Disease
Act, 1897 was amended to grant immunity to the manufactures and provide compensation to the
people who suffered from vaccination (“Annexure A”). In order to protect the younger
generation from the second wave of Dovid-19 the central Govt. allowed the vaccination for the
citizen above the age of 18 on 15th March, 2021. The Chief Minister of Ariana on 30 March 2021
in a press conference stated that the only way to stop the spread of Doronavirus is by providing
immunity to the entire population through vaccination. But even after making the vaccines
available to the adult population there were very few people who turned out. So on 03rd April
2021, the Govt. of Ariana by exercising its power under the Epidemic Act 1897, issued a
regulation making vaccination mandatory for performing certain activities (“Annexure B”).

ATEREFFECTS OF VACCINE

There is an unavoidable risk of adverse side effects such as seizures and allergic reactions in case
of vaccines worldwide. On 26 January, 2021 Mr. X, an individual took a dose of the vaccine and
developed serious side effects including fever, headache and nausea immediately after the
vaccination. He was admitted in the hospital for fifteen days and lost his memory partially. So on
18th February, 2021 he sued the vaccine manufacturer for compensation of 1 Crore rupee in a
civil court of Diana.

SUIT FILED BY FREEDOM FOR ALL

A non-governmental organization, “Freedom for All” challenged both, the act passed by the
Centre and the imposition of the mandatory vaccination certificates by the State of Ariana by
filing a writ petition before the Supreme Court of Diana.
