To, ‘The Member Secretary, National Board of Accreditation 4th floor, East Tower, NBCC Place, Bhisham Pitamah Marg Pragati Vihar, New Delhi 110003, INDIA Subject : Regarding appeal to cancel the visit of NBA/AICTE & UGC Team to MGM's Jawaharlal Nehru Engg. College, Aurangabad, (Maharashtra) Respected Sir, We on behalf of Acting President & Unit President of Bhartiya Kamgar Sena (BKS), MGM JNEC Unit, bring to your kind notice some of the serious issues of all Teaching & Non-teaching employees of MGM's Jawaharlal Nehru Engg. College, Aurangabad. (Maharashtra). All employees working here are facing many problems and serious consequences in day to day working. The major problems are as below- 1) The Management is not giving salary to all its employees as per the norms of UGC/AICTE or State Govt despite the order of Hon. Supreme court given at the time of 5" pay & 6" pay. 2) Each time the employees have to file a case in the honorable court for Pay implementation. All the employees of JNEC have filed a writ petition under the banner of Bhartiya Kamgar Sena (BKS) union & fought a case in Hon, Bombay High Court, at Aurangabad Bench & later on in the Hon. Supreme Court for both 5 pay & 6" Pay implementation & both time the Hon. Supreme Court result was in favor of employees. 3) Every time after the final decision & contempt of court petition , of Hon. Supreme court, the management had implemented the pay scale with mutual compromise agreement. 4) But cach time after few days of mutual agreement, management had stopped implementation of DA & other allowances including yearly increment. 5) Same thing happened both time in case of 5" Pay as well as 6" Pay implementation & ater on stopped the implementation. 6) Bach time employee have to go to the Hon. High Court, & then to the Hon. Supreme Court for their payment related issues and demands. 8) During the entire process of court matter many employees have retired from thelr servies, many have left job and many took early retirement. = 3 9) There is no yearly increment since 2017 to all teaching & non teaching staff. a 10) DATA/HRA & other allowances are not revised since 2017 (ie. since the day of compromise at the time of 6® Pay) 11)Now we have filed a writ petition in the Hon. Bombay High Court, at Aurangabad bench for implementation of 7" pay commission& the matter is sub-judice. 12)The AICTE & DTE are the main parties in all our court matter i sabe college working time is 9.30 to 5 for teaching faculties & from 9.00 to 5.35 for non- teaching employees, The working hours of employees are against the UGC/AICTE norms. 14) There is no holiday for second & fourth Saturday. 15) No mid term & end term vacations to teaching facult 16) Yearly ear leaves, medical leaves & casual leaves are not given as per the AICTE/UGC norms. 17) All national & state govt. holidays are not given. Only 3-4 govt. holidays are 18) The cancelled national & state govt. holidays are not added to leave. 19) The college was working with full strength (100% teaching & hon teaching) during the complete national & state govt. lockdown during the Covid pandemic for complete working n, hours i.e. more than 8 hours. ; 20) There is acute shortage of teaching faculties as well as technical assistant, lab assistant and other non-teaching staff such as attendant and peons. 21) Due to acute shortage all are overloaded and unable to take emergency leave as well any other leave. No alternate persons areavailable at most of the places. 22) Without altemate arrangement the authorities do not sanction the leaves and their salary was deducted. , 23)Now the college has applied for NBA accreditation for its 04 branches & have given 04 tentative visit dates. The first tentative date given by the institute is 22 & 23 April 202 24)They are also preparing for AICTE/UGC Committee visit which is scheduled during the same period ie. 21 to 23 April 2022. 25)Their intention for going to NBA/AICTE & UGC committee visit is to increase the tuition fees & other fees. Every time they increase the tuition fees immediately after the committee visit irrespective of accreditation 26) Under the name of committee visit, the management, the Principal, the Vice Principal, NBA co-coordinator & HODs are giving lot of humiliation and harassment to all the working employees. 27) The process of NBA here is going since last 4-5 years. Utider the name of NBA/ /AICTE/UGC the management and the authorities are trying to give daily harassment to its employees since last 5 years. No five day week. No public holidays and even no vacations. Lot of humiliation and mental torture to employees working here. 2s) During both covid-19 wave & complete lockdown period, they have called all (100% strength) employees on duty for all working days (i.e. Mon to Sat from 9am to Spm). The Principal & others have called employees on Sunday also for NBA work. Ladies faculties are also not left and given excuse for work on Sunday & govt. holidays. as a ven to those who are covid positive and underwent treatment, 23) Bven sa) We Mfolation of Covid guidelines by this institute. They have not followed ae pal distancing, no sanitization and no thermal checking norms at any place in the any s00' covid treatment was not given to the employees in MGM hospital which is one ef biggest hospital of Aurangabad city. They do not took-condolence meeting a employees who have lost their life during the covid. This is very unfortunate & cruel for the humanity and the whole mankind, . ! sn) Actually there is no co-ordination among Principal, Vice Principal, NBA coordinator & the Heads of Department. Everybody is so much casual and irresponsible and all of them have their own agenda. But they held employees responsible for their failure. 31) All the employees working here are fed up of their daily harassment. : 32) Now they have made it mandatory to work beyond the working hours including Sunday & Govt. holidays, Every time they draw a circular for cancellation of all leaves and ask the employees not to take any leave till the visit of NBA/AICTE/DTE committee visit. 33) They have cancelled mid-term & end term vacation of faculties & reduced the yearly leaves such earn leave, casual leave & medical leave. 34) Even emergency leaves & genuine medical leaves are also not sanctioned by the authorities. 35) Many staff have much eam balance leaves at the time of retirement. But compensation of nota single earn leave was given to any employees. Alll the balance leaves including earn leaves are lapsed. Considering the above grievances ofall employees & the worst situation they are facing, ‘we appeal you to look into the matter and do not arrange any NBA/AICTE visit to the institute till redressal of all the above grievances.
