1 Two MS/TP FLN Connections Supported on PXC Modular and PXC-36

Section 1 - New Features and Enhancements


This section describes new features, system enhancements, and information about
resolved defects delivered with this revision, including:
● Enhancements to Applications [➙ 8]
● General Enhancements [➙ 13]
For detailed information on any of these features and enhancements, please see the
online help system.

Two MS/TP FLN Connections Supported on PXC Modular


and PXC-36
Insight Revision 3.14 and later supports two physical MS/TP FLN connections on PXC
Modular and PXC-36 field panels. This feature requires Firmware Revision 3.4 or later.
The following user interface enhancements have been made in order to support two
physical MS/TP FLN connections:
● The BACnet Field Panel Definition dialog box has been updated to allow users to
configure two MS/TP FLNs when either a PXC Modular or PXC-36 field panel is
defined.
● The Database Transfer Backup and Restore operation has been updated to
support the transfer of configuration data for two MS/TP FLNs for PXC-36 and PXC
Modular field panels from the field panels to the database and vice-versa.

MS/TP Routed and Ethernet/IP FLNs Supported for BACnet


Devices
Insight now supports MS/TP Routed and Ethernet/IP FLNs for BACnet devices. This
feature requires Firmware Revision 3.4 and later.
The BACnet FLN Definition dialog box, which has been added to System Profile, is
used to define MS/TP, MS/TP Routed, or Ethernet/IP FLNs on BACnet field panels
with Firmware Revision 3.4 and later.
● The devices under MS/TP FLN are directly-connected to the BACnet field panel.
● The devices under MS/TP Routed or Ethernet FLNs are not physically connected
to the BACnet field panel.

Totalization Supports BACnet Point Types and Units


Totalization has been enhanced to support additional point types and totalization rates
of seconds, minutes, and hours. This feature requires Firmware Revision 3.4 or later.
The following table displays the Totalization support for different BACnet firmware
revisions:

Enhancements to Managing Alarm Messages for BACnet


Points
A new BACnet Event Enrollment Object Properties dialog box is available through the
Event Enrollment Objects definition window. This dialog box is available through
different workflows in System Profile and Point Editor. When working in System Profile,
you can add, modify, or remove Event Enrollment Objects from the selected device.
When working in Point Editor, you can add, modify, or remove Event Enrollment
Objects that reference the selected object.

Defining the Message that Displays


Alarm messages for BACnet points can be defined through the BACnet Alarm
Message Setup dialog box, which can be opened by clicking the Alarm Properties
button in the Point window. There are three options for defining the message that
displays when a point goes into alarm: Private, Panel, and Shared.
● A Private message is defined with the point and is only available for that point. This
option is selected by default.
● A Panel message is defined in the BACnet Field Panel Definition dialog box and is
only available for points that are defined in that field panel.
● A Shared message is defined in System Profile. You can use the same message
for all alarm conditions, or select a different message for each alarm condition.

Upload/Download and Backup/Restore


● Field panel alarm messages that are associated with EEOs can be uploaded and
downloaded by using the Database Transfer application.

Viewing Alarm Messages in Graphics


Alarm messages may be viewed in the Graphics application by right-clicking on the
graphic control and selecting View Alarm Message from the menu. Alarm messages
can be viewed when using the following graphic controls:
● Point Information Block (PIB)
● Arrow
● Alarm Associated Graphic Link
● Associated Point
● Analog Bar

Selected alarm messages for the BACnet points may be viewed in the Alarm Status
application (Alarm Status > Alarm Message).

Viewing Alarm Message Information in a Report


The Event Enrollment Objects Report displays the Alarm Type plus one of the
following:
● For a Private message, the alarm message text is displayed (maximum 100
characters).
● For a Panel message or a Shared message, the Panel Message Number displays.

New Features in the BACnet FLN Device Definition Dialog


Box
The following figure and table outline the features that have been added to the BACnet
FLN Device Definition dialog box in System Profile. Firmware Revision 3.4 or later is
required to use these features.

1 The Firmware Revision, Application Software Revision, and Model Name fields
have been added to display information from the FLN device. These fields
determine what displays in the Device Type (4) field. To manually update these
fields, click the Update Device Type button (5).
2 The display of the BACnet Address section depends on the FLN device type.
● For an Ethernet or IP FLN device, an IP Address and a Port Number field
display (as shown).
● For an MS/TP FLN device, options to use the decimal or hexadecimal MAC
address display.
3 The Change Image button is now located below the FLN device image. Click
this button to select a different image to represent the device. With Insight
Revision 3.14 and later, the image displayed automatically updates when the
Device Type (4) field is changed.
4 The selection made in the Device Type drop-down list determines the layout of
the BACnet Address (2) section.
5 The Update Device Type button has been added.
When you click this button, the Firmware Revision, Application Software
Revision, and Model Name fields (1) are populated with information from the
FLN device and the device image (3) is updated.

The buttons in the Backup/Restore section of the BACnet FLN Device Definition dialog
box are now available for all FLN devices. If the device does not support the backup-
restore feature, an error displays when a backup or restore is initiated.
● Click the Backup button to back up the BACnet FLN device to the database.
● Click the Restore button to restore the BACnet FLN device data (backed up data)
from the database back to the device.
Before starting a backup or restore, the Password field must contain the correct device
password.
When you perform a backup or restore, the field panel should be online.

Discover BACnet FLN Devices


The Discover BACnet FLN Devices dialog box has been added to the System Profile
application. It displays the device information for all the available BACnet devices. You
can access this dialog box by doing one of the following:
● Clicking the Discover BACnet FLN Devices menu on a BACnet field panel of
MS/TP type in FLN configuration
● Right-clicking on any BACnet/IP or MS/TP FLN.
With the Discover BACnet FLN Devices dialog box, you can:
● Discover and display MS/TP and BACnet/IP devices that exist on the BACnet
network.
● Filter BACnet devices based on Device ID range, Network Number, or Vendor ID.
● Add one or more discovered devices to the System Profile tree under the field
panel’s respective FLN.

BBMD Table User Interface Enhancements


The process to create a BBMD table has been streamlined through the following
enhancements in the BBMD Table dialog box:
● The Enable BBMD at this Node check box is now included when the BBMD Table
dialog box is opened from the BACnet Field Panel Definition dialog box. This
eliminates the need to separately open the Cimetrics application and restart the
BACstac protocol.
● The workstation or BACnet device where the BBMD Table dialog box is launched
is now automatically added to the BBMD table and the Port ID from the BACnet
Connection Settings dialog box is automatically used.
● The process to save changes, copy a BBMD table from an existing BBMD device
to this node, or copy the BBMD table from this node to all workstations or devices
in the BBMD table has been simplified. The second dialog box that previously

opened when saving changes has been eliminated. The options are now as
follows:
– OK Button. Saves the BBMD table at this node only.
– Cancel Button. Closes the BBMD Table dialog box without saving any changes
at this node. Any Copy to All operations that were already performed will not be
cancelled.
– Copy to All Button. Saves and synchronizes all BBMD devices in the current list
and copies the BBMD table to each Siemens device or workstation in the list.
Devices in the list that do not have BBMD enabled will be enabled as a BBMD
device when the Copy to All button is clicked.

Trend Definition Editor

Trend Grid Application


The Trend Definition Editor now includes the Trend Grid application. Trend Grid allows
you to create, modify, and delete trend definitions for multiple points. Configure/Edit
access to Trend Definition Editor is required in order to use the Trend Grid application.
The Trend Grid application allows you to do the following:
● Create multiple new trend definitions for multiple points.
● Modify and/or delete multiple existing trend definitions.
● Open existing trend definitions on a per point basis or on a per panel basis to
modify or delete trend settings.
● Use the data grid to copy and paste settings from one cell to another (definition to
another).
● Choose whether to remove supervised points.

Maximum Number of Trend Samples Allowed is Shown


The Trend Definition Editor now shows the maximum number of trend samples allowed
in a particular trend definition. For example, Maximum Samples for this Trend: 2500 (or
field panel maximum).

Displaying the Trended Points for a Field Panel


With Insight Revision 3.14 and later, the Object Selector for the Trend Definition Editor,
Trend Grid, and Report Builder applications automatically filters the point list to only
display the points that are already defined in a trend. The Type and Panel drop-down
lists in the Object Selector can also be used to further filter the point list.

Global Commander
Users who have Command and Configure/Edit access in the Global Commander
application are now able to select the priority to use when commanding BACnet
subpoints so that the internal application will not overwrite the command being issued.
Users also have the option to set (or to not set) the initial value with the command.

General Enhancements
This revision contains the following general enhancements:

BACnet Cimetrics BACstac


Cimetrics BACstac Version 6.4-e is shipped with Insight Revision 3.14. If the BACnet
Option is already installed, you must install the updated Cimetrics BACstac protocol
when you are upgrading the Insight software.

Firmware Revision Support


● BACnet Firmware Revision 3.3.1
● BACnet Firmware Revision 3.4

Siemens Launch Pad Version 1.4


Siemens Launch Pad has been updated to version 1.4.

Security Enhancement
Insight Revision 3.14 has improved network security by no longer granting permissions
to the ATOM$ file share for the Everyone account.
● During a new installation, only the logged on account will be added to the ATOM$
file share with full permissions. You will need to add the appropriate group(s)
and/or account(s) with the proper permissions in order to view or modify
background graphics.
● During an upgrade to Insight Revision 3.14, existing permissions will be retained.

Support for Microsoft Office Excel 2007, 2010, and


2013
You can now export the report data to newer versions of Microsoft Office Excel
(2007/2010/2013). This enhancement has been made to the Report Builder
application.

Section 2 - Fixed Issues


This section lists bug fixes in Insight Revision 3.14.

Alarm Issue Management (AIM)


● Database Locking Conflict. Previously, when acknowledging a point for which
Alarm Issue Management (AIM) was enabled, a database locking conflict might
occur and display the error Cannot grant the requested lock; conflict
with an existing lock. This issue has been fixed.
● AIM Report is Showing Wrong Date/Time Stamp. Previously, if you acknowledged
a point in alarm that was initially acknowledged, and then the acknowledged point
failed, the ACK time displayed in the AIM report was later than the Alarm time. This
issue has been fixed. Now, the ACK time displays the current event time (Normal,
Off-Normal, or Fault).

NOTE:
The BACnet stack was also modified in order to fix the incorrect date/time stamps.
When reporting the time of acknowledgment, the system now uses the time of the
most current event (To-Normal, To-OffNormal, or To-Fault). Previously, it would use
the time of the event whose acknowledgement was last sent by the BACnet device.

BN_ADAPT Would Send BPING with Incorrect Invoke IDs


BN_ADAPT would send BPING to BACnet field panels with incorrect Invoke IDs,
resulting in temporary failure of the field panels. This issue has been fixed.

Database Transfer

Backup and Restore for UECs


Previously, the Backup and Restore of BACnet data for UEC devices was not working
when the device was connected at the ALN level. This issue is fixed.

Restore for Field Panels


The Restore operation of field panels would fail when the Descriptor field of MS/TP
subpoints was modified. This issue has been fixed.

DBCS Server
The InfoCenter collection of trends for BACnet points caused DBCS service to run
slowly. As more BACnet panels and trends were added, the collection would eventually
fail. This issue has been fixed.

2 Event Builder

Event Builder
Previously, when an MS/TP FLN Device subpoint was added to the BACnet Command
in the Event Builder application, an incorrect Device Instance and Object Instance were
assigned to the point. As a result, the Point, Device Instance, Object Instance and
Value fields in the Edit Action dialog box displayed incorrect data.
This issue has been fixed. Fields in the Edit Action dialog box now display information
as follows: the Point field displays the subpoint name; the Device Instance field
displays the MS/TP FLN Device Instance Number; the Object Instance field displays
the MS/TP FLN Device Sub point; and the Value drop-down list displays the state text
table values.

Graphics
● Totalized Value Issue for PIBs associated with Event Enrollment Objects (EEOs).
In the Show Options tab of the Point Information Block (PIB) control the Totalized
Value box remained checked for an EEO even after you unchecked it, closed and
reopened the graphic. This issue was causing the graphic to update slowly.

Now, this issue is resolved ensuring that the automatic checking of the Totalized
Value box is removed, thus enhancing the graphic updates.
● Saved Information now Displays for the Chart Data Widget. Previously, for
Enhanced Graphics Controls, if you modified any property of the Chart Data widget
in the Enhanced Graphics Control Properties dialog box, and then saved the
setting, reopening the dialog box did not display the saved information. This issue
has been fixed.
● BACnet Virtual LENUM points do not appear Black. Previously, the BACnet virtual
LENUM points appeared black and did not contain any value when viewed on a
graphic for the first time. This issue has been fixed.

Insight Workstation and Desigo CC Co-existence


At sites with both an Insight workstation and a Desigo CC management station, the
Insight workstation would try to add the Desigo CC management station to each ALN.
During this process, the Event log at the Insight workstation would fill with error
messages because the Insight software replication engine did not assign unique
names on each ALN. This issue has been fixed.

MMI Database Transfer


● In Windows 2012 R2 Server, the MMI Database Transfer application would crash
when you connected any field panel by using the File Menu option. This issue has
been fixed.

Insight OPC Server Crash


The Insight OPC server would crash when certain third-party OPC client applications
were closed. This issue is fixed.

Scheduler
● Duplicate BACnet schedule entries. Previously, in the Scheduler application, when
you modified a BACnet schedule in the Daily and Weekly tabs, a duplicate BACnet
schedule entry was created. This issue has been fixed.
● State Text Table Values. Previously, when you added an MS/TP subpoint to the
Scheduler application, an incorrect ObjectID was assigned to the point. As a result,
incorrect objects would display in the Object Name column in the Schedule Object
Items section of the BACnet Schedule Properties Dialog Box. This issue has been
fixed. Now only the state text table values are displayed in the Object Name
column.

System Profile

Modifying TEC Subpoints in Auto Unbundling Dialog


Box
Previously, if you unbundled any subpoint in the Auto Unbundling dialog box, it was
automatically added to the access group where other subpoints of the same TEC were
present. Also, if you unchecked the unbundled status of any TEC subpoint in the Auto
Unbundling dialog box, it was removed along with other TEC subpoints present in the
same access group.
This issue is fixed. Now, only the subpoints whose autounbundling status changes in
the Auto Unbundling dialog box are added or removed from the access group.

Trend Definition Editor


Previously, for P1 TEC and BTEC subpoints with device names greater than 30
characters, trend data was not collected. This issue has been fixed.

User Accounts

BACnet Server
The BACnet Export caused an error when exporting points from User Accounts. This
issue has been fixed.

TEC Subpoints
Previously, TEC subpoints of a TEC were removed from their access group if you have
added or removed the TEC from a different access group. This issue is fixed.

Report Filters for BACnet MS/TP FLN Devices Do Not Work


Previously, the following filter options did not work in the Application Sub-point Display
Report for BACnet MS/TP FLN devices:
● Only Subpoint
● Use Report
● Only Application

2 Error Message on Stopping Objectivity AMS Service

Also, the following attribute filters did not work in the Panel Point Log Report for
BACnet MS/TP FLN devices:
● Priority
● Out Of Service
This issue is fixed.

Error Message on Stopping Objectivity AMS Service


Previously, an error message displayed when manually stopping Objectivity AMS
services. This issue is fixed.

Database Transfer Application does not Transfer Data


Previously, in the Database Transfer application, clicking Upload All displayed an In
progress status without transferring data from panel to database. This issue is fixed.

Firmware Revision 2.8.10 Support for Ethernet MBC and


MEC
The Modular Building Controller (MBC) and Modular Equipment Controller (MEC)
ethernet field panels now support firmware revision 2.8.10.

Section 3 - Installation

CAUTION

All Insight workstations on a Management Level Network (MLN) must be running the
same revision of the Insight software.

CAUTION

In order to properly install all applications, you must have elevated Windows user
privileges if User Access Control (UAC) is enabled.

NOTICE

The procedure for updating a Server/Client configuration has changed due to updates
in Objectivity services.
Before updating the Insight software on the Database Server connected to an MLN,
you must shut down all workstation applications and services on all other Database
Clients that are connected to the MLN.

You can perform the following installations:


● A new installation of Revision 3.14.
● An update to Revision 3.14 from an existing Revision 3.12 or 3.13 installation.

Before installation, do the following:


● Back Up Databases.
Before upgrading to or installing the latest software revision, we recommend that
you fully back up your existing database.
● Install Operating System Software.
You can only install the software after you have properly installed and configured a
supported Windows operating system. For more information, see Section 4 -
System Requirements [➙ 22].

NOTE:
If you intend to use the same computer for both the Insight Database Server and
InfoCenter Advanced Server, only the following operating systems are supported:
• Windows Server 2008 R2 Service Pack 1
• Windows Server 2008 (32-bit) Service Pack 2
• Windows 7 (32-bit and 64-bit) Service Pack 1

● Install Windows Service Packs.

PDF-viewing software is required to read the additional documents that are
available with the installation media and from the Online Documentation toolbar. If
you need PDF-viewing software, Adobe® Reader® software is provided with the
installation media.
● Some Third-party Software is No Longer Available on the Installation DVD.
The following must be installed from their respective sites:
– Java Runtime Environment (JRE) Version 7 Update 71 (1.7.0_71) through all
Versions of Java 8 are supported. To install Java Runtime Environment (JRE),
visit www.java.com.
– Siemens no longer offers Dialogic software. Therefore, verify that the software
is provided with the board purchase or visit
www.dialogic.com/en/products/media/system-release-software.aspx for more
information.

NOTE:
Corel DESIGNER 9 is only included on the installation media when you purchase a
new installation of Insight software. Corel DESIGNER 9 is only to be installed on one
Insight workstation per purchase. If you purchase an upgrade, the upgrade disk does
not contain Corel DESIGNER 9. Therefore, the existing installation on your system
will be used by the Insight software.

● Install Corel DESIGNER® 9.0 if you purchased a new software installation.


In order to have a registered, non-expiring version of the DESIGNER 9.0 software,
you must install it using the third-party tools section of the Insight Installation dialog
box. Not doing so will install a trial version of the DESIGNER software that will
eventually expire.

During installation:
For installation instructions, refer to the Getting Started Checklist in the installation
media package.

After installation, do the following:


● If you updated the software and the BACnet Option was already installed, you must
install the updated Cimetrics BACstac Protocol. For more information, see
Upgrading the Cimetrics BACstac Protocol in Setting Up BACnet > Setting Up the
Network >Updating Workstation, available from the Getting Started link in the
Online Documentation screen.

Remote Notification Option Considerations


If you are using the RENO® application’s voice notification and dial-in features, you
must also install the Dialogic software. For more information, go to
http://www.dialogic.com/en/products/media/system-release-software.aspx.

APOGEE GO Option Updates


If you are using the APOGEE GO Kiosk feature, you must use the following procedure
to upgrade the Kiosk directories with the latest Revision 3.14 files:
1. Run <InstallDir>\Insight\System\WebConfig.exe after a successful Revision 3.14
upgrade.
2. Select the Install Web Features into IIS option.
3. Select the Kiosk option.
4. Browse to the Kiosk directory to select the Virtual Directory Location.
5. Update the Virtual Directory Name as needed and click Update.
6. If you have multiple Kiosks defined, you must repeat Steps 4 & 5 for each Kiosk
directory.
7. Click Exit.

Inc. as the licensor (hereafter “Siemens” or “Licensor”) of the LICENSED SOFTWARE specified in Clause 1
(each a “Party” and collectively “Parties”). An amendment or addendum to this EULA may accompany the
LICENSED SOFTWARE. The use of the LICENSED SOFTWARE is subject to the provisions of this EULA

documentation for the LICENSED SOFTWARE.
2. Intellectual Property Rights Notice. The LICENSED SOFTWARE and all rights, without limitation including
proprietary rights therein (including any all copyrights, patents, trademarks, trade secrets, and publicity
rights), are owned by Siemens, its licensors or affiliates. The LICENSED SOFTWARE is protected for
Siemens on the basis of copyright law and international treaty provisions as well as on the basis of other
laws and agreements regarding intellectual property. Except as expressly and unambiguously provided
herein, You do not possess, and Siemens does not grant to You, any express or implied rights (whether
by implication, estoppel or other legal theory) in or to any such intellectual property rights and all such
rights are retained by Siemens, its licensors or affiliates. You acknowledge and agree that You, and not
Siemens, shall be solely responsible for the investigation, defense, settlement and discharge of any
intellectual property infringement claim or suit, or any other harm or damages resulting from Your use of or
access to the LICENSED SOFTWARE.
3. License Grant. Only a license is granted for the LICENSED SOFTWARE, the LICENSED SOFTWARE is
not sold. Siemens grants to You in this EULA a revocable, non-transferable, non-exclusive license to use
the LICENSED SOFTWARE in object code solely for Your own use provide You comply with all terms and
conditions of this EULA. The configuration and execution of the LICENSED SOFTWARE is supervised by
either a hardware dongle with a license key, a remote software sentinel with a license key, or a PC-bound
copy protection, supplied separately for the LICENSED SOFTWARE. The EULA permits use of the
LICENSED SOFTWARE, only within the boundaries established by the dongle or remote sentinel and the
license key. Siemens, in its discretion, may withhold distribution of the license key for use of the
LICENSED SOFTWARE by You until an executable version of this EULA is signed by the Parties.
4. Description of Further Rights and Restrictions.
a) If the LICENSED SOFTWARE was obtained by You from Siemens directly or through its licensed
distributors for use on a single machine, then You may only install the LICENSED SOFTWARE on a

single machine owned or licensed by You at any one time.
b) If the LICENSED SOFTWARE was obtained by You from Siemens or its distributors for networked

one time, by the number of active concurrent users for which You obtained a license key from
Siemens.
c) You may not sublicense, assign or transfer this EULA, the LICENSED SOFTWARE or its components,
or any portion thereof without express written consent from Siemens.
d) You may not or direct any third party to, reverse engineer, decompile, decode or disassemble the
LICENSED SOFTWARE except and only to the extent that such activity is expressly permitted by
applicable law notwithstanding this limitation.
e) You (or any third party at Your direction) also shall not (i) modify or create a derivative work of the
LICENSED SOFTWARE, or (ii) extract any individual parts except and only to the extent that such
activity is expressly permitted by applicable law notwithstanding this limitation.
f) This EULA does not grant You any rights whatsoever in relation to Licensor’s or Siemens AG’s
trademarks or service marks.
g) Siemens may at its discretion offer You support services concerning the LICENSED SOFTWARE
("Support Services"). Siemens is entitled to use the technical data that You make available to
Siemens in connection with the use of the LICENSED SOFTWARE and/or with Siemens’ Support
Services for business purposes, including product ordering, support and development. Siemens does
not guarantee that Support Services shall cure any technical problem caused by the use of the
LICENSED SOFTWARE.
5. Reservation of Rights. Licensor reserve all rights not expressly granted to You in this EULA.
6. Additional Software / Component or Third Party Licenses. This EULA applies to updates or supplements
to the original LICENSED SOFTWARE provided by Licensor or Siemens, unless Licensor or Siemens
provides other terms along with the update or supplement. The LICENSED SOFTWARE may contain
certain components such as open source software components or third party components licensed by
Siemens (each, a “Component”). Each Component may have a separate end user license agreement (a
“Third Party License”). The terms of any Third Party License (if any) that apply to the LICENSED
SOFTWARE are either: a) specified in the Additional Terms Addendum below, b) separately accompany
the LICENSED SOFTWARE and are automatically presented for acceptance prior to first use of the
LICENSED SOFTWARE by You and other users You allow access to the LICENSED SOFTWARE in
accordance with the single or networked use licenses You obtained from Siemens, or c) are specified in
the READ ME OSS document available at “WWW.USA.SIEMENS.COM/BTCPSEULA” for the LICENSED
SOFTWARE. The terms of such Third Party Licenses are herein incorporated by reference to this EULA.
7. Termination: This EULA is effective from the first date You install, copy or otherwise use the LICENSED
SOFTWARE. Without prejudice to any other rights of Licensor or Siemens, the EULA shall terminate
automatically and immediately without notice upon conditions set forth in Clause 4 or if You fail to comply
with any provision or condition of this EULA. In such a case You will be obliged to destroy all copies, all
related materials of the LICENSED SOFTWARE and all its components. You may terminate this license at
any time by deleting or destroying the LICENSED SOFTWARE, all backup copies and all related materials
provided to You by Siemens.
8. Backup Copy and Printing Documentation. You may make one copy of the LICENSED SOFTWARE,
excluding the documentation, as an archival backup copy of the original. Any other copies You make of
the LICENSED SOFTWARE are in violation of this EULA. If this LICENSED SOFTWARE includes any
related documentation provided in electronic form, You may print copies of this electronic documentation.
You must reproduce and include the copyright notices on any permitted copies You make of such
electronic documentation.
9. Warranty. Siemens shall be only liable for defects and any violation of property rights, as set forth in this

a) UNLESS SIEMENS AGREES IN A SEPARATE WRITING TO PROVIDE AN EXCEPTION TO THIS

ACKNOWLEDGE THE LICENSED SOFTWARE IS PROVIDED “AS IS” AND NEITHER SIEMENS
NOR ANY OF THEIR LICENSORS (IF ANY) MAKE ANY REPRESENTATIONS OR WARRANTIES,
EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR THAT THE LICENSED
SOFTWARE WILL NOT INFRINGE ANY THIRD PARTY PATENTS, COPYRIGHTS, TRADEMARKS
OR OTHER RIGHTS. THERE IS NO WARRANTY BY SIEMENS OR THEIR LICENSORS OR BY
ANY OTHER PARTY THAT THE FUNCTIONS CONTAINED IN THE LICENSED SOFTWARE WILL
MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE LICENSED SOFTWARE WILL
BE UNINTERRUPTED OR ERROR-FREE. NO ORAL OR WRITTEN INFORMATION OR ADVICE
GIVEN BY A SIEMENS REPRESENTATIVE SHALL CREATE A WARRANTY OR IN ANY WAY
AFFECT THIS DISCLAIMER. YOU ASSUME ALL RESPONSIBILITY TO ACHIEVE YOUR
INTENDED RESULTS AND FOR THE INSTALLATION, USE, AND RESULTS OBTAINED FROM IT.
b) Any further rights and remedies than those as per this Clause 9 (in particular Your right to claim
damages) based on a defect or a violation of property rights shall be excluded. This exclusion shall
not apply in the event of gross negligence, unlawful intent or insofar as mandatory law provides

10. Limitation Of Liability. UNLESS OTHERWISE AGREED IN CLAUSES 9 AND 10, IN NO EVENT SHALL
SIEMENS, ITS EMPLOYEES, LICENSORS, AFFILIATES, AGENTS OR SIEMENS AG AND THEIR
AFFILIATES BE LIABLE FOR ANY LOST PROFITS OR COSTS OF PROCUREMENT OF SUBSTITUTE
GOODS OR SERVICES, PROPERTY DAMAGE, LOSS OF PROFITS, INTERRUPTION OF BUSINESS
OR FOR ANY SPECIAL, INDIRECT, INCIDENTAL, ECONOMIC, PUNITIVE OR CONSEQUENTIAL
DAMAGES, HOWEVER CAUSED, AND WHETHER ARISING UNDER CONTRACT, TORT,
NEGLIGENCE, OR OTHER THEORY OF LIABILITY, OR ARISING OUT OF THE USE OF OR INABILITY
TO USE THE LICENSED SOFTWARE, EVEN IF SIEMENS IS ADVISED OF THE POSSIBILITY OF
SUCH DAMAGES. THE LIMITATION OF LIABILITY SHALL NOT APPLY IF AND TO THE EXTENT
SIEMENS’ LIABILITY IS MANDATORY UNDER THE APPLICABLE LAW (e.g., PRODUCT LIABILITY
LAW OR INTENSIONAL MISCONDUCT).
11. Debugging / Technical Support. Unless otherwise agreed, Siemens or SIEMENS AG and their affiliates
have no obligation to furnish You with any further technical support or to debug the LICENSED
SOFTWARE. Siemens reserves the right to improve the LICENSED SOFTWARE described here and to
carry out modifications at any time without any prior notice.
12. Governing Law/Export Restrictions/Legal Compliance. This EULA shall be governed by and construed
and interpreted by the laws of the State of Illinois, without regard to any conflict of laws provisions therein.
Licensee shall comply with all then-current export and import laws and regulations of the United States
and such other governments as are applicable when distributing or using the LICENSED SOFTWARE.
Licensee hereby certifies that it will not directly or indirectly export, re-export, transship, or transmit the
LICENSED SOFTWARE, or any portion thereof, or related information, media, or products in violation of
United States laws and regulations. You represent and warrant that You are not (i) located in any country
that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a
"terrorist sponsoring" country, or (ii) listed on any U.S. Government list of prohibited or restricted parties
including the Treasury Department's list of Specially Designated Nationals or the U.S. Department of
Commerce Denied Person's List or Entity List.
13. For U.S. Government End Users: The LICENSED SOFTWARE was developed at private expense and is
a “commercial item” as that term is defined at 48 C.F.R. 2.101, consisting of “commercial computer
software” and “commercial computer software documentation” as such terms are used in 48 C.F.R.
12.212. Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4, all U.S.
Government end users acquire the LICENSED SOFTWARE with only those limited rights set forth therein.

14. Miscellaneous. This EULA represents the entire agreement between You and Licensor or Siemens
relating to the LICENSED SOFTWARE and (i) supersedes all prior or contemporaneous oral or written
communications, proposals, and representations with respect to its subject matter; and (ii) prevails over
any conflicting or additional terms of any acknowledgement or similar communication between the parties
during the term of this License. If any provision of this EULA is held invalid, all other provisions shall
remain valid unless such validity would frustrate the purpose of this EULA, and this EULA shall be
enforced to the full extent allowable under applicable law. No modification to this EULA is binding, unless
in writing and signed by a duly authorized representative of each party. This EULA shall be binding on and
shall inure to the benefit of the heirs, successors, and assigns of the parties hereto. The failure of either
party to enforce any right resulting from the breach of any provision of this EULA by the other party will not
be deemed a waiver of any right related to a subsequent breach of such provision or any other right
hereunder.

ADDITIONAL TERMS ADDENDUM


Note: The Third Party Licenses applicable for Components of a respective release of the LICENSED
SOFTWARE are compiled in a readme document that accompanies such release of the LICENSED
SOFTWARE and are presented for “click through” acceptance prior to first use by You and other users You
allow access to the LICENSED SOFTWARE in accordance with the single or networked use licenses You
obtained from Siemens. Upon request by You, Siemens may provide You with an advanced copy of the
readme document containing such Third Party Licenses for the release of the LICENSED SOFTWARE to be
licensed to You.
