PART I: TITLE AND DEFINITIONS

1. The present rules shall be called the NMIMS KIRIT P. MEHTA SCHOOL OF LAW (Moot
Court Rules, Procedure and Penalties) 2022 or NOVICE MOOT COURT COMPETITION
(Hereinafter referred to as “Novice Moot”) Rules and Procedures 2022 and shall come in
force, on such date as notified by the Moot Court Committee (MCC) to the student body.

2. Definitions:
a. Novice Moot Court Competition shall mean annual moot organized for the students of
First Year only.
b. Participant means a student who has registered for the Novice under chapter 1 of part
II.
c. Team means a team registered for the Novice which shall consist of 3 participants (2
Speakers and 1 Researcher)
d. MCC shall mean the Moot Court Committee formed for the applicable academic year
by notification from the competent authority

PART II: PROCEDURE FOR REGISTRATION, MEMO SUBMISSIONS AND ORAL


ROUNDS

CHAPTER 1: REGISTRATION

3. Each student desirous of participating in the Novice shall register with the MCC in the
prescribed manner and when notified.
4. Each student shall participate in the Novice in a team but will be judged individually. The
speakers will be judged on the basis of the oral rounds and the researcher will be judged on
the basis of the memorial submission.
5. No student who has been banned from mooting activities by MCC will be eligible to register
for the relevant Novice during the continuance of such ban.
6. On registration, each participating team shall be provided a unique three-digit Code (e.g. T01,
T02 etc) which shall be used by both the MCC and the participants over the course of Novice.

CHAPTER 2: MOOT PROPOSITION

7. No further clarifications on the moot problem will be entertained by the MCC beyond the
prescribed notified date under the important list of dates.

8. The participants are required to email their queries pertaining to the moot proposition on the
given email address – sol.mcc2021@gmail.com

CHAPTER 3 : MEMORIAL SUBMISSIONS

12. On completion of the registration process, MCC shall randomly allot sides to each participant
for the purposes of oral rounds. The same shall be notified to the participants against their
Code after the closing of the registration.
Further, MCC shall ensure that such allotment of sides is done impartially and in a fair manner.
13. Each team shall submit a written memorial for both sides (Applicant and Respondent)
as per the notification by the MCC on the given email id– sol.mcc2021@gmail.com
14. The draw of lots for the oral round and exchange of memorials, shall be carried out on email
which shall be sent to each team by the MCC.
15. The Written Memorial shall consist of the following mandatory heads:

a) Cover Page

b) Table of Contents

c) Index of Authorities

d) Statement of Jurisdiction

e) Statement of Facts (not exceeding [2] pages)

f) Issues Raised

g) Summary of Arguments (not exceeding [2] pages)

h) Body of Arguments (not exceeding [20] pages)

i) Prayer for Relief


16. A uniform system of citation (20th edition of the Bluebook citation) shall be adhered to
throughout the Written Memorial.
17. The final date of submission of Written Memorial shall be determined by the MCC. It is the
responsibility of each participant to ensure that the electronic copies of the Written Memorials:
a) Can be opened legibly with Adobe Reader/Microsoft Edge in .pdf Format only.

b) Each team shall mention their individual code on the top right-hand side of the
memorial.

c) The attachments shall be named according to the Code and the Party for which
the written memorial is proposed. (For instance, participants with code “T01” shall

name the attachment as “T01P and T01R” where P is petitioner and R is
respondent.)

18. The Memorial shall be typed on A4-sized paper, with the following mandatory specifications:
a) Font Type: Times New Roman
b) Font Size: 12
c) Line Spacing: 1.5 pts
d) Margins: 1 inch on each side.

b) Font Size: 10
c) Single Spacing
19. All the pages of the memorial must be formatted or printed on paper of A4 size (both sides),
with the following mandatory specifications:

a) All the pages of the memorials must have margins, in accordance with the Novice
Rules or as may be notified by MCC in this regard.

b) Summary of Arguments shall not exceed more than 1500 words.


20. ] Following colour schemes shall be followed for the Cover Page of the Written Memorial:
a) Applicant/Petitioner/Claimant- Blue _____ b) Respondent- Red _____
21. Following penalties, as applicable shall be awarded in case of violation of the rules regarding
Written Memorial specifications:

a) Late submission: (-) 5 marks after the deadline for Memorial submission.

b) Exceeding page limit: (-) 1 mark for each page exceeding the limit.

c) Failure to include any mandatory head (as indicated in point no. above) in the
Written Memorial shall attract a penalty of (-) 2 marks per specification.
d) Violations of Rule 16: (-) 1 mark each page.

e) Plagiarism of any kind is strictly prohibited. Any memorial found to be violating


this rule would not be evaluated.

f) The anonymity of all the participants shall be maintained throughout the Novice.
Any violations made shall entail penalty which may also extend to disqualification
of the participant at any stage of the selection process.

g) In any case, the total accumulated deductions w.r.t. penalties in the Written
Memorial shall not be more than twenty marks.

CHAPTER 4: ORAL ROUNDS

25. There shall be a bench consisting of either one or more judges who shall preside over all
hearings during the oral rounds of the Novice.
26. Every team will be allowed to have a total speaking time of 15 minutes. The speakers of the
teams have the discretion to decide the speaking time amongst them.
27. The order of the pleadings in each oral round shall be: Applicant v. Respondent, followed
by the Applicant’s rebuttal. However, it will be the discretion of the Bench to hear the
rebuttals or end the proceedings.
28. The Judges shall mark the participants after every oral round in the marking scheme provided
to them.

CHAPTER 5: ONLINE RULES

a) The participants must ensure that they have a strong internet connection with good audio
and video facilities. They must use laptops or PC for the oral rounds. The use of cell phones
is prohibited.

b) The background of the participants on video shall be plain and shall not contain any symbols,
representations or any other virtual background.

c) The participants (speakers) must ensure that any noise or audio other than the voice of the
participant should not occur during the online oral rounds. It is advisable to plan and prepare
for the online oral rounds in advance accordingly.

d) Participants shall be permitted to use the screen sharing feature for making their submissions.
Participants are required to use latest version of the Zoom.

e) The teams must ensure that they do not disclose their identity at any stage during the
competition. Disclosure of the same shall lead to the disqualification of the teams.

f) At the time when one participant is speaking, others are expected to keep their microphones
on mute.

g) The participants must not start the session before the host.

h) The Meeting ID, Password and Link to each session shall be shared with the participants
before their round.

CHAPTER 6: MARKING SCHEME AND RANK LIST

29. On completion of the oral rounds and evaluation of written memorial evaluation, a
separate merit list shall be released, illustrating speaker ranks and researcher ranks respectively.

29.1 The speaker list shall consist of ranks allotted to all participants appearing in the oral
rounds.
29.2 The researcher list shall consist of ranks allotted to all participants appearing for the
researcher test and successfully submitting written memorials, wherein equal weightage is given,
on one hand to the researcher test raw score and on the other hand on the basis of the written
memorial submitted.

PART III: SUBSEQUENT MOOT ALLOTMENT

30. The allotment of national and international moot court competition for 1st year students
on the basis of their merit and performance in the Novice Moot shall be at the sole discretion
of the MCC depending on available slots and feasibility.

PART IV: PENALTIES


31. For the purpose of participation in the Novice, no participating team or any
member is allowed to consult with any faculty (including the visiting faculty) or
indulge in any unfair means with the seniors of the NMIMS KPM SOL in pursuant to
the moot problem or any factor regarding the same. The team or any member of the
team violating this rule will be disqualified immediately.

32. The team who voluntarily withdraws itself from participating in the allotted moot will have
a blanket ban of one year from participating in any other Moot Court Competition.
33. The Moot Court Committee shall notify the student body of their decision regarding
imposition of ban on a particular student and of the grounds therein if it was based on the
discretion of the MCC.
34. Students taking in part in any Moot Court Competition without the prior notice or
consent of the MCC shall be banned for one year from participating in any Moot Court
Competition.
35. The above rules shall apply to participants backing out from participation in moots, in so far
as the MCC deems fit to apply the same.
Provided, no penalty shall be imposed for whatever reason except as the grounds recognized
above and corollary, no valid ground for withdrawal from participation is recognized except
the one provided above.

PART V: MISCELLANEOUS

36. Being a part of team IMCC’22 is NOT a bar for any student from participating in
the Novice Moot Court Competition’21.
37. No student of NMIMS KPM SOL shall be allowed to participate in any national or
international moot without participation in the Novice Moot Court Competition. In certain
exceptional cases, face-offs for a particular moot not enlisted in the Novice pool list can be
taken solely at the discretion of MCC.
38. There shall be no preference granted in any other Moot Court Competition notified to the
student body, to teams or students allocated moots through MCC due to postponement or
cancellation of a moot allotted to them.
39. In the event of the cancellation of the allotted moot, the concerned team will be required
to give a common face off for the next available moot if there is more than one team who has
registered with the MCC in order to participate in that said moot.
40. REPEAL AND CONTINUATION:
The present rules shall not be applied to any moot allotted prior to the entry into force of these
rules. On entry into force of these rules, any other rule purporting to govern the herein addressed
matters shall stand repealed.

However, procedures not addressed by this shall continue to be governed by the procedure already
prevalent in the University.
