COUNTER-AFFIDAVIT

I, CEZAR MILLAN, of legal age, single, resident of Old Remedian, Angeles City,
Pampanga, after having sworn in accordance with law, do hereby depose and says
THAT:

1. I am the respondent in Criminal Case for the crime of Murder under

Article 248 of the Revised Penal Code;

2. I am executing this Counter-Affidavit as a reply and comment to the

Affidavit of witness, Janet Quiambao, who is under investigation by this
Honorable Office in connection with the deaths of Mario Punzalan,
Minda Punzalan, Efren Villanueva, Baby Mesina and Jocelyn Mesina on
May 19, 1988;

3. That in the evening of May 19, 1988, I was in Old Remedian Barbeque
Place in Angeles City, and I was employed as a baker at Minda’s Bakery
owned by the witness sister, Minda Punzalan and brother-in-law, Mario
Punzalan;

4. Also in Minda’s Bakery was my co-baker, Froilan Dela Cruz who is having
a drinking session inside our room. I was invited by Froilan to join but I
declined because I was already tired and I noticed that he was already
drunk;

5. That at around two (2) o'clock in the morning of the following day, I was
awakened by Froilan who was intoxicated by alcohol and I saw on his
bed paraphernalia of a possible drug use;

6. That Froilan is trying to convince me to steal Mario Punzalan’s watch and

sell it which I refused, but Froilan insisted and threatened me that if I still
refused, he will kill me instead;

7. That out of fear of my life, I was compelled in joining Froilan in stealing

Mario’s watch while he was asleep;
 8. That at the time Froilan was stealing Mario’s watch, Mario suddenly
woke up. Thereafter Froilan ordered me against my will to hit Mario
using the rolling pin;

9. Shortly thereafter, Minda Punzalan and Efren Villanueva entered the

room and saw us hitting Mario. Froilan then ordered me against my will
to stab Minda Punzalan with a knife and Froilan stabbing our co-worker,
Efren Villanueva;

10. That after the incident, Froilan ordered me to go with him to check if
there were possible witness;

11. That upon forcibly entering in Janet Quiambao’s room, we saw Baby and
Jocelyn Mesina who were awakened by us barging inside. Froilan then
proceeded to kill Baby Mesina and ordered me to stab also Jocelyn
Mesina which I refused but Froilan threatened me that if I refused, he
will kill me instead;

12. I deny any involvement on the crimes happened and insist that my
actions were against my will and have only done that because of fear
that Froilan will kill me if I refuse him;
