Reply to Delay in non-handing over of the site

1. 25.01.2017 The Claimant commenced the
work of chain-link fencing on
25.01.2017 i.e. over 3 1/2 months
after award. On the said date
Claimant had not completed pre-
construction activities.
2. Respondent’s letter Respondent stated various Annexure R-22
dated 17-02-2017 failures at end of Claimant, which page 33-35 SOD
included pre-construction/ Vol-RD1
mobilization activities. The same
were in no way related with
minor issue stated by Claimant.
There was no issue by local public
and no land was in dispute. The
local issues were resolved
immediately. No response was
offered by the Claimant
3. Respondent’s letter In response to Claimant’s letter
dated 22.7.2017 dated 21-07-2017 the
Respondent explained the factual
position giving reference to
discussions with the concerned
authorities. The Respondent also
stated illegal import/export
business operations by Claimant’s
staff. Claimant was warned and
asked not to engage any staff,
who was indulging in illegal
business.
4. August 2017 The Claimant while submitting
their application for grant of EOT
in August 2017 did not consider
any effect of the above so called
hindrances in their EOT
application.
5. Minutes of meeting Contention of mobilization of Ann. C-29 page 58-
dated 04.08.2017 site/ work is contrary to the facts 59 SOC Vol-CD
and submissions made above.
6. Respondent’s email The Claimant’s letter dated Ann. C-30 page 60-
dated 10.08.2017 07.08.2017 was duly replied by 61 SOC Vol- CD1
the Respondent.
7. Minutes of meeting It is brought out that though SDO Annexure R-155
dated 27.9.2018 had come to site on 19-09- 2018 page 323-325 SOD
and during discussions brought Vol-CD2
 out some minor issues. The same
was immediately resolved by the
Respondent. The Claimant was
advised to continue the work.
This is the only reason the issue
was not discussed in the
subsequent meetings dated 27-
09-2018.
8. 11-10-2018 The Respondent’s reply it is clear
that the Claimant has failed to
Respondent’s email in complete the work of diversion of
reply to Claimant’s Muktapur road even in 24
email dated 10-10- months after the award. It is also
2018 pertinent to add that there was
no issue on the said work after
the award.
