Ayon sa Artikulo 1544 of the Civil Code, mayroon mga tuntunin sa kagustuhan ng
pagmamay-ari kapag ang pagbebenta ay doble at ito ay mareresolba sa mga susunod na
patakaran.

3. What are implied warranties?
An implied warranty is an assurance that a product is fit for its intended purpose and meets
the buyer's expectations. These implied warranties can be written or oral. Implied warranties
are governed by state laws, not federal laws. The two key types of implied warranties are
merchantability and fitness.
For example, if a farmer goes to a farm supply store, and tells the salesman he needs a plow
for the rocky soil of his farm, and the salesman directs him to a particular plow, there may be
an implied warranty that the plow in question is fit for use in rocky soil.
In a contract of sale, an implied warranty on the part of the seller that he has a right to sell the
thing at the time when the ownership is to pass, and that the buyer shall from that time have
enjoy the legal and possession of the thing.
The two main types are express and implied warranties. An express warranty is one that is
clearly stated (or "expressed") either verbally or in writing, while an implied warranty
automatically covers most consumer goods valued over a certain amount, but only provides a
base level of protection for consumers.

ART. 1547. In a contract of a sale, unless a contrary intention appears, there is:

This article shall not, however, be held to render liable a sheriff, auctioneer, mortgagee,
pledgee, or other person professing to sell by virtue of authority in fact or law, for the sale of
a thing in which a third person has a legal or equitable interest.

Implied warranties under


Articles 1547 and 1562 are:
(1) Implied warranty as to seller’s title. — that the seller guarantees that he has a right to
sell the thing sold and to transfer ownership to the buyer who shall not be disturbed in
his legal and peaceful possession thereof.
(2) Implied warranty against hidden defects or unknown encumbrance. — that the seller
guarantees that the thing sold is free from any hidden faults or defects or any charge
or encumbrance not declared or known to the buyer (Art. 1561.); and
(3) Implied warranty as to fitness or merchantability. — that the seller guarantees that the
thing sold is reasonably fit for the known particular purpose for which it was acquired
by the buyer or, where it was bought by description, that it is of merchantable quality.
