I am writing about a recent eligibility enquiry for Treatment Benefit - Dental Benefit submitted for you.
We have now made a decision based on the information available.

I am sorry to tell you that your application has not been allowed as you do not have enough qualifying
social insurance (PRSI) contributions.

Eligibility for Treatment Benefit is based on having sufficient PRSI contributions paid or credited at the
time you seek approval. Depending on your age, the total number of contributions you need will vary, as
will the number of paid or credited contributions required in the relevant contribution year.

The Treatment Benefit Scheme is available to insured workers and retired people who have the required
number of qualifying PRSI contributions. You must have paid Class A, E, P, H or S social insurance
contributions. The amount of social insurance you need depends on your age. Serving members of the
Defence Forces who pay PRSI contributions at Class H are only entitled to a limited range of Treatment
Benefits.

If you have a current medical card, you may be entitled to treatment under the Health Acts. You can get
details and an application forms are available from your local Health Centre or from the Health Service
Executive. You should send a copy of this letter with your application.

What should you do next?

 If you think our decision is incorrect or the contribution record we hold is incorrect, you can
send us more evidence or documents that you think are relevant to your case. A Deciding Officer
will review the decision and will write and tell you the outcome of the review.

Or

 If you are not satisfied with the Deciding Officer’s decision, you may appeal it by writing directly
to the Chief Appeals Officer, Social Welfare Appeals Office, D’Olier House, D’Olier Street,
Dublin 2. You must do this within 21 days of the date on the Deciding Officer’s letter setting out
fully the grounds of your appeal.

QUALIFICATION CONDITIONS

PRSI CONDITIONS

AGE: YOU MUST HAVE AT LEAST

Under the age of 21 years 39 paid contributions in total

Ages 21 - 24 39 paid contributions and either


(a) 39 paid or credited PRSI contributions in the relevant tax
year on which your claim is based
OR
(b) 26 paid PRSI contributions in both the relevant tax year
and the tax year immediately before the relevant tax year.
Ages 25 – 65 260 paid PRSI contributions since first starting work, AND either
(a) 39 paid or credited PRSI contributions in the relevant tax
(also covers anyone who has year on which your claim is based (Ages 25 – 65)
turned 66 after 6th July 1992) OR
(b) 39 paid or credited PRSI contributions in either of the two
relevant tax years on which your claim is based (Aged 66
after 6th July 1992).
OR
(c) 26 paid PRSI contributions in both the relevant tax year
and the tax year immediately before the relevant tax year.
If you satisfy the above conditions when you reach pension age, you will remain qualified for life.

The PRSI contributions that count towards Dental / Optical / Medical Appliance Benefit are Class A, E, H,
P or S rates.
QUALIFIED ADULT

You can get Treatment Benefit on your spouse’s, civil partner’s or cohabitant’s PRSI record provided
he/she satisfies the qualifying contribution conditions and you:
- are dependent on your spouse, civil partner, cohabitant or
- have a gross income of €100 or less per week, or
- earn more than €100 per week and were dependent on your spouse, civil partner or
cohabitant before entering or resuming insurable employment at Class A, E, H, P or S, or
- are getting any of the following social welfare payments: Disablement Pension,
Supplementary Welfare Allowance, Carers Benefit, or
- are getting Carer’s Allowance or a State Pension (non-contributory) in
your own right, and were dependent on your spouse, civil partner or cohabitant
immediately prior to getting the Allowance or Pension.

WIDOW/WIDOWER

If you were entitled to Treatment Benefit on your spouse’s, civil partner’s or cohabitant’s insurance
record at the time of his/her death, you will retain entitlement for as long as you remain widowed.

If you are working and paying PRSI, you may qualify for Treatment Benefit on your own record, provided
you satisfy the qualifying conditions.
