SYNOPSIS
Prohibits State from disclosing New Jersey driver’s license holders’ personal
information to other states seeking to issue speed camera or red light camera
citations.

1 AN ACT concerning motor vehicle violations and supplementing


2 Title 39 of the Revised Statutes.

4 BE IT ENACTED by the Senate and General Assembly of the State
5 of New Jersey:

7 1. a. For the purposes of P.L. , c. (C. ) (pending before
8 Legislature as this act:
9 “Interstate motor vehicle information network” means an
10 interstate network used for the exchange of law enforcement,
11 criminal justice, and public safety-related information.
12 "Personal information" means any information that identifies an
13 individual, which information may include an individual's
14 photograph, social security number, driver identification number,
15 name, address, or telephone number.
16 “Speed control device” means an integrated system or device
17 utilizing a camera, or a multiple camera system, and vehicle sensors
18 that is capable of automatically producing a recorded image of an
19 alleged violation that shows a motor vehicle traveling at or above a
20 predetermined speed and a portion of the motor vehicle sufficient to
21 clearly identify the motor vehicle.
22 “Traffic control signal monitoring system” means an integrated
23 system or device utilizing a camera, or a multiple camera system,
24 and vehicle sensors that is capable of automatically producing a
25 recorded image of an alleged violation that shows a motor vehicle
26 unlawfully entering and continuing through an intersection
27 controlled by a traffic control signal and a portion of the motor
28 vehicle sufficient to clearly identify the motor vehicle.
29 b. Notwithstanding the provisions of P.L.1966, c.73 (C.39:5D-
30 1 et seq.) and P.L.1983, c.46 (C.39:5F-1 et seq.), neither the New
31 Jersey Motor Vehicle Commission, nor any other State agency,
32 shall disclose the personal information of drivers with driver’s
33 licenses issued by this State to another state or an interstate motor
34 vehicle information network for the purpose of imposing or
35 collecting a fine resulting from an alleged violation committed in
36 another state that was captured by a traffic control signal
37 monitoring system or a speed control device located in that state.

39 2. This act shall take effect immediately.

44 This bill prohibits the New Jersey Motor Vehicle Commission
45 and other State entities from disclosing the personal information of
46 New Jersey drivers to another state for the purpose of allowing the
47 other state to impose or collect a fine resulting from an alleged
48 violation committed in that state and captured by a speed control

1 device or a traffic signal monitoring system, commonly referred to


2 as a red light camera.
3 The bill defines “personal information” to mean any information
4 that identifies an individual, which information may include an
5 individual's photograph, social security number, driver
6 identification number, name, address, or telephone number. The
7 bill also provides definitions for the following terms: interstate
8 motor vehicle information network, speed control device, and
9 traffic control signal monitoring system.
