Quezon Avenue, West Triangle, Quezon City www. dilg.gov.ph ADVISORY FOR : DILG REGIONAL DIRECTORS, BARMM MINISTER OF THE INTERIOR AND LOCAL GOVERNMENT, PROVINCIAL DIRECTORS, CITY DIRECTORS, CITY/MUNICIPAL LOCAL GOVERNMENT OFFICERS, AND ALL OTHERS CONCERNED SUBJECT : IMPLEMENTING GUIDELINES FOR THE CONDUCT OF CY 2022 BARANGAY PEACE AND ORDER COMMITTEE (BPOC) FUNCTIONALITY AUDIT DATE : APR OS 2072 Pursuant to Section 16 of the Republic Act No. 7160 or the Local Government Code of 1991, the local government shall, within their territorial jurisdictions, promote health and safety, improve public morals, maintain peace and order, and preserve the comfort and convenience of their inhabitants. Subsequently, Executive Order No. 366, dated 5 September 1996, was issued requiring all barangays to organize the Barangay Peace and Order Committee to serve as the implementing arm of the City/Municipal Peace and Order Council at the barangay level. In view of the importance of monitoring the performance of BPOCs, the Department issued DILG MC No. 2020-047 dated February 27, 2020, amending DILG MC 2008- 101 dated June 17, 2008, providing the updated functionality indicators, roles and responsibilities and monitoring guidelines of BPOC. The Audit result provides the barangays critical information about the performance gaps and areas for improvements of their respective BPOCs. Considering the current pandemic, the conduct of the BPOC Functionality Audit for CY 2022 shall be implemented by the following guidelines: A. PERIOD COVERED For CY 2022 BPOC Functionality Audit, the BPOC shall be assessed for its performance in CY 2021 ““Matino, Mahusay at Maaasahan” ‘Trunkline No.: 8876-34-54 B. SCOPE OF AUDIT * All Regions shall assess at least 93% of the barangays within their area of jurisdiction. * In cases when covered barangays are declared to be under Alert Level 3 or above, the assessment may be put on hold, provided that the assessment shall resume once Alert Level 2 or lower is declared. Further, the assessment period may be extended for concerned barangays upon request from the DILG Regional Office. . SCHEDULE OF AUDIT * The CY 2022 BPOC Functionality Audit shall commence on April 1, 2022 following the timeline stipulated in the Advisory dated February 21, 2022 entitled NBOO's Adjusted Calendar of Implementation of Barangay-Based Institutions (BBIs) Functionality Audits and Other Monitoring Compliance Activities. * The DILG Regional Office shall prescribe the schedule of submission of the provincial and city/municipal assessment results, provided that the duly signed Regional Summary shall be submitted to the Central Office, through the National Barangay Operations Office (NBOO) on or before July 15, 2022. D. ASSESSMENT REQUIREMENTS AND CRITERIA For this year’s Audit, the barangays are required to comply with the guidelines as. stated in the technical guide notes of the DILG MC No. 2020-047 dated February 27, 2020, which include the following: = Submission of required MOVs per indicator. = Usage of the prescribed template of the BPOC Information Report (attached as Annex 1) "Usage of the updated BPOC Functionality Assessment Form (attached as Annex 2) Please note that while in CY 2021 BPOC Functionality Audit the following indicators were considered as bonus indicators based on the Advisory dated April 6, 2021, entitled “Clarification on Various Issues and Concerns on the Conduct of the BPOC Functionality Audit”, the same shall be treated as main indicators for CY 2022 BPOC Functionality Audit in view of the importance of the presence of these peace and order-related issuances at the barangay level as these are their mandated functions in accordance with pertinent laws, policies, and directives of the Department: Page 2 of 6 Indicator, ___ Legal Bases | barangay: Indicator No. 17. DILG MC No. 2019-121 dated July 29, 2019, | directs all LGUs to manage and maintain roads | within their jurisdiction as a basic service and | facility. | DILG MC No. 2019-167 dated October 4, | 2019, states that the barangay shall be the | primary unit responsible for the continued | maintenance and sustainability of cleared roads. | | DILG MC No. 2020-027 dated February 7, 2020, states that the LGUs shall enact or review existing ordinance/s that provide for the conduct of road clearing operations and the prohibition of road obstructing structures and constructions. 17.2. Indicator No. 17.2 Regulating the sale of cigarettes and alcoholic | beverages to minors. (4.1. 11.2. Presidential Decree No. 1619 entitled “Penalizing the use or possession or the unauthorized sale to minors of volatile substances for the purpose of inducing intoxication or in any manner changing, distorting or disturbing the auditory, visual or mental process’, states that the sale of, and offer to sell, to minors of liquors or beverages containing an alcoholic content of thirty per centum or above (80 proof or above) is hereby prohibited and shall be punishable by imprisonment ranging from six months and one day to four years and a fine ranging from six hundred to four thousand pesos. R.A. No. 9214, also known as the Tobacco | Regulatory Act of 2003, provides that any person or business entity or establishment selling to, distributing, or purchasing a cigarette or any other tobacco products for a minor shall be fined the amount of not less than Five Thousand Pesos (Php 5,000.00) or imprisonment of not more than thirty (3) days, upon the discretion of the court. ‘| Page 3 of 6 Indicator Legal Bases ] 11.3. 11.4. Executive Order No. 26 s. 2017, states that selling, distributing, and purchasing tobacco products to and from minors is declared unlawful and prohibited. DILG MC No. 2004-86, enjoins the LGUs to coordinate with concerned law enforcement agencies in taking necessary steps to ensure the implementation of RA. No. 9211, particularly the prohibition of the sale of cigarettes and other tobacco products to persons below 18 years of age. E, GOOGLE MONITORING SHEET * Audit results shall be encoded only in the official monitoring sheet to be shared by NBOO through your respective e-mail addresses. * Encoded data in the Google Drive shall match the Consolidated Regional Results duly signed by the Regional Director to be submitted to the Central Office. * Sharing of Google Drive link to DILG Provincial and City/Municipal Field Offices shall be done at the regional level. F, SAFETY PROTOCOLS «Minimum health protocols and other measures such as wearing face masks and social distancing shall be strictly observed in the conduct of the audit. + Use of different technology platforms in the submission of reports, including the self-assessment forms and means of verifications to be accomplished by the barangays are encouraged. Page 4 of 6 * Conduct of assessment and validation meetings of the Evaluation Task Force (ETF) members via online platforms are also encouraged. G. ROLES AND RESPONSIBILITIES A. National Barangay Operations Office A.1. Provide technical assistance to the Regional Offices; A.2 Create the monitoring system via Google sheets for the BPOC Functionality Audit, and disseminate the same to DILG Regional Offices; 3 Calibrate and finalize audit results gathered from DILG Regional Offices; and 4 Prepare National Report and submit the same to the Office of the Secretary. B. DILG Regional Offices B.1. Formulate regional operational guidelines for the conduct of the CY 2022 BPOC Functionality Audit to include the timelines of submission for city, municipal and provincial consolidated reports; B.2, Disseminate the monitoring system shared by NBOO to field offices within your area of jurisdiction; B.3. Accomplish the BPOC Focal Person Directory thru this link: bit.ly/BPOC-RFPs-Directory; B.4. Ensure the correctness and completeness of the data encoded in the shared Google Drive, and the compliance of the DILG Field Officers on the encoding of their reports; B.5. Review audit results on the CY 2022 BPOC Google Monitoring Sheet; and B.6 Submit Regional Monthly Accomplishment Report every 24 working day of the ensuing month to NBOO by accomplishing the Monitoring Matrix found in this link: bit.ly/Regional-Monthly-Report, and B.7 Submit Regional Summary Report of CY 2022 BPOC Functionality Results to NBOO through the Department's Document Management System (DMS) on or before July 15, 2022. Assess the functionality of the BPOCs based on the BPOC self- assessment form; Evaluate the Means of Verification (MOVs) per indicators as submitted by the barangays; Ensure strict observance of minimum health protocols and other measures during the conduct of the audit; Conduct validation activities whenever necessary; and Accomplish and submit the consolidated monitoring report (BPOC Monitoring Form 2) and assessment results to the DILG Provincial Office, in the case of Component Cities and Municipalities; and to DILG Regional Office, in the case of Highly Urbanized Cities (HUCs) or Independent Component Cities (ICCs).
