HEAD OF THE TOURISM AND CREATIVE ECONOMY AGENCY OF
THE REPUBLIC OF INDONESIA,

Considering : a. that in order to realize an orderly and integrated


management of legal documentation and information in
a network within the Ministry of Tourism and Creative
Economy/Tourism and Creative Economy Agency, it is
necessary to regulate the management of legal
documentation and information within the Ministry of
Tourism and Creative Economy/Tourism and Creative
Economy Agency;

b. that the Regulation of the Creative Economy Agency
Number 1 of 2018 on the Legal Documentation and
Information Network within the Creative Economy
Agency and the Regulation of the Minister of Tourism
Number 5 of 2018 on the Legal Documentation and
Information Network within the Ministry of Tourism are
no longer in accordance with legal developments and
organizational needs so that they need to be replace;
c. that based on the considerations as referred to in letters
a and b, as well as to implement Article 5 section (1) of
Presidential Regulation Number 33 of 2012 on the
National Legal Documentation and Information Network,
it is necessary to stipulate a Regulation of the Minister
of Tourism and Creative Economy/Head of the Tourism
and Creative Economy Agency on the Legal
Documentation and Information Network within the
Ministry of Tourism and Creative Economy/Tourism
and Creative Economy Agency;

Observing : 1. Article 17 section (3) of the 1945 Constitution of the


Republic of Indonesia;
2. Law Number 39 of 2008 on State Ministry (State Gazette
of the Republic of Indonesia of 2008 Number 166,
Supplement to the State Gazette of the Republic of
Indonesia Number 4916);
3. Presidential Regulation Number 33 of 2012 on the
National Legal Documentation and Information Network
(State Gazette of the Republic of Indonesia of 2012
Number 82);
4. Presidential Regulation Number 96 of 2019 on the
Ministry of Tourism and Creative Economy (State
Gazette of the Republic of Indonesia of 2019 Number
269);
5. Presidential Regulation Number 97 of 2019 on Tourism
and Creative Economy Agency (State Gazette of the
Republic of Indonesia of 2019 Number 270);

HAS DECICED:
To issue : REGULATION OF THE MINISTER OF TOURISM AND
CREATIVE ECONOMY/HEAD OF THE TOURISM AND
CREATIVE ECONOMY AGENCY ON THE LEGAL
DOCUMENTATION AND INFORMATION NETWORK WITHIN
THE MINISTRY OF TOURISM AND CREATIVE ECONOMY/
THE TOURISM AND CREATIVE ECONOMY AGENCY.

CHAPTER I
GENERAL PROVISIONS

Article 1
In this Ministerial Regulation:
1. The National Legal Documentation and Information
Network, hereinafter abbreviated as JDIHN, is a forum
for joint utilization of legal documents in an orderly,
integrated, and sustainable manner as well as a means
of providing complete, accurate, easy, and fast legal
information services.
2. The JDIHN Center is the National Law Development
Agency of the Ministry of Law and Human Rights.
3. The Legal Documentation and Information Network of
the Ministry of Tourism and Creative Economy/Tourism
and Creative Economy Agency, hereinafter referred to as
JDIH Kemenparekraf, is a forum for joint utilization of

legal documents in an orderly, integrated, and
sustainable manner as well as a means of providing
complete, accurate, easy, and quickly comprehensive
legal information services within the Ministry of Tourism
and Creative Economy/Tourism and Creative Economy
Agency.
4. Legal Documents are legal products in the form of
legislation or legal products other than legislation which
include but are not limited to court decisions,
jurisprudence, legal monographs, legal magazine
articles, legal books, legal research, legal studies,
academic texts, and draft legislation.
5. Management of Legal Documentation and Information is
the activity of collecting, processing, storing, preserving,
and utilizing legal documents and information.
6. Legislation is a written regulation that contains legally
binding norms in general and is established or
determined by state institutions or authorized officials
through the procedures stipulated in the laws and
regulations.
7. Legal Information is all data and information contained
in Legal Documents.
8. Technical Implementation Unit, hereinafter abbreviated
as UPT, is an independent work unit that carries out
certain operational technical tasks and/or certain
supporting technical tasks from its parent organization.
9. The Tourism Authority Implementing Body, hereinafter
referred to as the Tourism Authority, is a work unit
under the Ministry of Tourism and Creative
Economy/Tourism and Creative Economy Agency.
10. Ministry means the ministry who carries out
government affairs in tourism and government tasks in
creative economy.
11. Minister means the minister who carries out
government affairs in tourism and government tasks in
creative economy.

12. The Permanent Secretary of the Ministry of Tourism and
Creative Economy/Permanent Secretary of the Agency
for Tourism and Creative Economy, hereinafter referred
to as the Permanent Secretary of the Ministry, is the
supporting element of the leader who is under and
responsible to the Minister.

Article 2
This Ministerial Regulation is intended as a legal basis for
managing JDIH Kemenparekraf.

Article 3
JDIH Kemenparekraf aims to:
a. ensure the creation of orderly and integrated
management of legal documents and information in the
Ministry and integrated with the JDIHN Center;
b. ensure the availability of complete and accurate legal
documents and information, and can be accessed
quickly and easily;
c. develop effective cooperation in the context of
administering JDIH Kemenparekraf between the center
of Ministry’s JDIH and the JDIHN Center and JDIHN
members; and
d. improve the quality of development and legal services to
the public in the field of tourism and the creative
economy as a form of good governance.

CHAPTER II
ORGANIZATION

Article 4
(1) The organization of JDIH Kemenparekraf consists of:
a. center of JDIH Kemenparekraf; and
b. members of JDIH Kemenparekraf.
(2) The center of JDIH Kemenparekraf as referred to in
section (1) letter a is in the bureau that carries out
duties and functions in the legal field.

(3) The members of JDIH Kemenparekraf as referred to in
section (1) letter b consist of work units whose duties
and functions are to carry out activities related to the
law on:
a. organizational unit for middle high leadership
positions or echelon I;
b. UPT; and
c. the Tourism Authority.

Article 5
JDIH Kemenparekraf as referred to in Article 4 is a member
of JDIHN.

CHAPTER III
DUTIES AND FUNCTIONS

Article 6
(1) The center of JDIH Kemenparekraf as referred to in
Article 4 section (1) letter a is in charge of formulating
policies, fostering, developing, and managing legal
documentation and information within the Ministry.
(2) In carrying out the tasks referred to in section (1), the
center of JDIH Kemenparekraf carries out the following
functions:
a. collection, processing, storage, preservation, and
utilization of document information and Legal
Information issued by the Ministry;
b. development of a legal information system based on
information and communication technology that can
be integrated with the JDIHN Center website;
c. fostering and developing human resources for
managing JDIH Kemenparekraf;
d. supplying management facilities and infrastructure
at the center of JDIH Kemenparekraf;
e. implementation of dissemination and technical
guidance of JDIH within the Ministry;

f. implementation of monitoring and evaluation
regarding the management of documents and Legal
Information in the Ministry; and
g. submission of reports on the implementation of JDIH
Kemenparekraf to the Minister through the
Permanent Secretary of the Ministry and the JDIHN
Center.

Article 7
(1) Members of the JDIH Kemenparekraf as referred to in
Article 4 section (1) letter b are in charge of managing
legal documentation and information issued by
organizational unit for middle high leadership positions
or echelon I, UPT, and the Tourism Authority.
(2) In carrying out the duties as referred to in section (1),
members of JDIH Kemenparekraf perform the following
functions:
a. collection, processing, storage, preservation, and
utilization of information on Legal Documents issued
by the relevant member of JDIH Kemenparekraf;
b. utilization of the Legal Information system which is
centralized in the center of JDIH Kemenparekraf;
c. supplying facilities and infrastructure in order to
support the implementation of the duties of the
relevant member of JDIH Kemenparekraf; and
d. submission of reports on the implementation of
duties and functions periodically 1 (one) time in 1
(one) year to the center of JDIH Kemenparekraf and
the heads of work units, UPT, and the Tourism
Authority.

Article 8
In managing documents and Legal Information, JDIH
Kemenparekraf refers to management standards in
accordance with the provisions of laws and regulations.

Article 9
(1) To support the implementation of the duties and
functions as referred to in Article 6, the center of JDIH
Kemenparekraf forms a technical team of JDIH
Kemenparekraf.
(2) The technical team as referred to in section (1) consists
of the following elements:
a. center of JDIH Kemenparekraf;
b. members of JDIH Kemenparekraf; and
c. a work unit that has the duty of carrying out the
development of information technology and networks.
(3) The technical team as referred to in section (2) is
determined by a Ministerial Decree.

CHAPTER IV
MANAGEMENT OF DOCUMENTATION AND LEGAL
INFORMATION

Article 10
(1) JDIH Kemenparekraf contains Legal Documents in the
form of:
a. regulation of the Ministry;
b. instruction of the Ministry;
c. circular letter;
d. a memorandum of understanding/ cooperation
agreement of the Ministry; and
e. laws and regulations relating to the main duties and
functions of the Ministry.
(2) In addition to the Legal Documents as referred to in
section (1), JDIH Kemenparekraf may contain:
a. academic manuscripts, urgency manuscripts, or
technical studies;
b. technical instructions or implementation
instructions;
c. jurisprudence; and
d. other Legal Documents.

(3) In addition to containing the Legal Documents as
referred to in section (1) and section (2), JDIH
Kemenparekraf contains Legal Information.

Article 11
(1) The original Legal Document as referred to in Article 10
section (1) enacted by the Ministry is kept by the center
JDIH Kemenparekraf.
(2) Copies of the original Legal Documents can be kept by
members of JDIH Kemenparekraf.
(3) The center of JDIH Kemenparekraf can request the
original Legal Documents that are kept by members of
JDIH Kemenparekraf.

Article 12
(1) The center of JDIH Kemenparekraf builds a legal
information system by utilizing information and
communication technology on jdih.kemenparekraf.go.id
page.
(2) The page as referred to in section (1) is integrated with
the JDIHN Center page.

Article 13
(1) Legal Documents contained in the legal information
system are managed through metadata and can be
accessed by the public.
(2) The legal information system as referred to in section (1)
is managed in accordance with the provisions of the
laws and regulations governing the standardization of
the technical management of legal documentation and
information.

Article 14
(1) The Center of JDIH Kemenparekraf conducts
assessments, classifications, and updates, as well as
disseminates and uploads Legal Documents as referred
to in Article 10 section (1).

(2) The legal documents as referred to in section (1) are
disseminated and uploaded through the
jdih.kemenparekraf.go.id page.

Article 15
Everyone can access and download legal documents and
information through the jdih.kemenparekraf.go.id page.

Article 16
(1) In order to improve the competence and quality of JDIH
Kemenparekraf managers, the Ministry conducts
dissemination and technical guidance.
(2) The dissemination and technical guidance as referred to
in section (1) can be held by the center of JDIH
Kemenparekraf or members of JDIH Kemenparekraf.
(3) In addition to the dissemination and technical guidance
as referred to in section (1) and (2), the center of JDIH
Kemenparekraf and/or members of JDIH
Kemenparekraf can:
a. carry out coordination meetings;
b. follow or attend technical guidance organized by the
JDIHN Center or JDIHN members; and
c. make work visits.

CHAPTER V
MONITORING AND EVALUATION

Article 17
(1) The Center of JDIH Kemenparekraf monitors and
evaluates the management of JDIH Kemenparekraf at
least 1 (one) time in 1 (one) year.
(2) The monitoring and evaluation as referred to in section
(1) is carried out on:
a. the results of the JDIH Kemenparekraf management
activities; and
b. implementation of the duties and functions of JDIH
Kemenparekraf members.

(3) The results of the monitoring and evaluation as referred
to in section (2) shall be reported to:
a. Permanent Secretary of the Ministry; and
b. JDIHN Center via e-report every December.

Article 18
The monitoring and evaluation as referred to in Article 17 is
carried out in accordance with the development and
management needs of JDIH Kemenparekraf.

CHAPTER VI
FUNDING

Article 19
The funding required for the management of JDIH
Kemenparekraf comes from the Ministry's State Budget
and/or other legal sources in accordance with the
provisions of the legislation.

CHAPTER VII
CLOSING PROVISION

Article 20
At the time this Ministerial Regulation comes into force,
a. the Regulation of the Creative Economy Agency Number
1 of 2018 on the Legal Documentation and Information
Network within the Creative Economy Agency (State
Gazette of the Republic of Indonesia of 2018 Number
308); and
b. Regulation of the Minister of Tourism Number 5 of 2018
on the Legal Documentation and Information Network
within the Ministry of Tourism (State Gazette of the
Republic of Indonesia of 2018 Number 879),
is repealed and declared ineffective.

Article 21
This Ministerial Regulation comes into force on the date of
its promulgation.

In order that every person may know hereof, it is ordered to
promulgate this Ministerial Regulation by its placement in
the State Gazette of the Republic of Indonesia.
