1. Par. II-A-1.2a

The lot where the MPDP shall be constructed may or may not be owned by the FO
beneficiary.

In case where the lot is owned by a person other than the FO, the person granting
USUFRUCTION must be obsolute owner of the parcel of land and is wiling to grant the
free use of the real property to the NFA and fr which the latter may contruct a MPDP for
the benefit of the beneficiaries of stipulated Farme's Organization. The OWNER (person
granting usutruct) shall enter into a CONTRACT OF USUFRUCT with NFA concerning
the use of the parcel of land for the construction of the MPDP for the benefit of the
Farmer's Organization covering a period of fifteen (15) years.

Each of the Following evidence of lot ownership can be used for the costruction of the
MPDP:

1. Certificate of Title;
2. Transfer Certificate of Title (TCT);
3. Deed of sale with the following supporting documents;
a. Certificate of Title
b. Capital Gain Tax
c. Transfer Tax
d. Tax clearance from treasure's Officer or official receipt for the payment of Real
Estate Tax
e. Copy of Deed of Sale (notarized)
4. Deed of Donation with the following supporting documents;
a. Certified of Titlle
b. Donors Tax
c. Transfer Tax
d. Tax clearnce from Treasurer's Office or official receipt for the payment of Real
Estate Tax
e. Copy of Deed of Donation (notarized)
5. Certificate of Land Ownership Award (CLOA) issued by LBP.

This is with the assumption that the property is not subject to any lien or encumbrance
that would otherwise disturb NFA's peaceful possession over the said property subjct of
the usufruct.

2. Par. II-A-1.2-f
The provision of the MPDP shall be on a turn key basis.This means that the MPDP, after
construction, shall be leased back to the FO beneficiary for a period of fifteen (15) years
and the contract shall take natured of "loan or commodatum". The FO beneficiary must
agree and abide by the terms and conditions contained in the agreement fot the use of
NFA multi-purpose drying pavement to be undertaken with the NFA through the Agency
OProgram Implementors (API).

3. Par. II-A-1.2-g-(second paragraph)

Except when the MPDP site is within NFA premises, the lost area where the MPDP is to
be constructed shall be leade to NFA by the concerned DA Agency or LGU, by
executing a Contract of USUFRUCT.

4. Par. II-A-1.3-j

Upon acceptance of the Mechanical Dryer the API in behalf of the NFA, it shall be
leased by NFA to the FO beneficiary by executing a Contract of Commodatum for a
period of five (5) years, under the terms and conditions contained in the agreement for
the use of NFA mechanical dryer.

5. Par. II-B-3.1-c

All Liquidation reports shall be supported by the following documents:

c.1 Certificate of Inspection issued by API Head

c.2 Certified of Final acceptance for Mechanical Dryer issued by API Head ; or

Certified of Completion for Multi-Purpose Drying Pavement issued by API Head

c.3 Copy of Lease Contract (between NFA and Farmers Organizations for the
utilization of Dryer Facility and Contract of Usufruct on the lot used)

6. The list of requirement for Liquidation Report as provided in the List of Supporting
Documents shall be amendedvto confirm with the requirements as stated in paragraph 5
of the SOP amendment/addendum.

7. For the purpose of facilitating the execution of required lease agreement between NFA
and FO beneficiary and for uniformity of agreement contents, a pro-forma contract is
provede herein under Exhibit 1, 2 and 3. The pro-forma contract shal be the one to be
used and executed by all Agency Progam Implementors for the implementation of the
Postharvest Facility Assistance Program.
