To all members,
We are informing you that the SERA
executive elections have been terminated and will be re-run.
As members will be aware on Saturday
4th June 2022 ballot papers were sent to every SERA member who was a member of SERA on that date. However, after the ballot was sent out it was brought to our attention that two candidates had been left off the ballot paper in an administrative error.
In light of that, it was decided that the
most reasonable and speedy approach to rectify the mistake and to ensure that no-one was unfairly disadvantaged, was to cancel the ballots issued on 4th June and reissue new ballots with the two candidates added. This was sent out as quickly as was workably possible, on 7th June 2022 to those who were members on 4th June 2022.
SERA has since received a solicitors'
letter on behalf of a SERA member challenging certain aspects of the executive election process including the reissuing of ballots as outlined above and threatening legal proceedings. We received a further letter this evening from the same complainant repeating the threat of legal proceedings.
We sought legal advice on these matters.
It was considered that the action taken had been reasonable and fair to all members. However, it has also been considered whether or not it could be argued that the issuing of ballots on the 7th June could be constituted as an entirely new ballot. If so, it would be arguable that the period for voting would be less than the 21 days required for voting outlined in the SERA articles. It would not be possible to extend the voting period as the articles also require a return of ballots seven days before the AGM. So, the safest course of action and remedy was to cancel the election and re-run it in order to assure validity of the election, fairness to all members and to mitigate any risk of further challenge in the election process.
In light of the ongoing legal threat and
the legal advice we have received, the only prudent option for the SERA executive is to terminate the current election immediately and for the whole election process to begin again. Accordingly, we can confirm that the current election has been cancelled. Details of the future election process will be announced in due course.
