1. Purchase preference to Micro and Small Enterprises (MSEs): Purchase preference will be given to MSEs as
defined in Public Procurement Policy for Micro and Small Enterprises (MSEs) Order, 2012 dated 23.03.2012 issued
by Ministry of Micro, Small and Medium Enterprises and its subsequent Orders/Notifications issued by concerned
Ministry. If the bidder wants to avail the Purchase preference, the bidder must be the manufacturer of the offered
product in case of bid for supply of goods. Traders are excluded from the purview of Public Procurement Policy for
Micro and Small Enterprises. In respect of bid for Services, the bidder must be the Service provider of the offered
Service. Relevant documentary evidence in this regard shall be uploaded along with the bid in respect of the
offered product or service. If L-1 is not an MSE and MSE Seller (s) has/have quoted price within L-1+ 15%
(Selected by Buyer)of margin of purchase preference /price band defined in relevant policy, such Seller shall be
given opportunity to match L-1 price and contract will be awarded for 25%(selected by Buyer) percentage of
total QUANTITY.
2. Estimated Bid Value indicated above is being declared solely for the purpose of guidance on EMD amount and
for determining the Eligibility Criteria related to Turn Over, Past Performance and Project / Past Experience etc.
This has no relevance or bearing on the price to be quoted by the bidders and is also not going to have any
impact on bid participation. Also this is not going to be used as a criteria in determining reasonableness of
quoted prices which would be determined by the buyer based on its own assessment of reasonableness and
based on competitive prices received in Bid / RA process.

Buyer Added Bid Specific Terms and Conditions

1. Generic
Bidder shall submit the following documents along with their bid for Vendor Code Creation:
a. Copy of PAN Card.
b. Copy of GSTIN.
c. Copy of Cancelled Cheque.
d. Copy of EFT Mandate duly certified by Bank.
2. Scope of Supply
Scope of supply (Bid price to include all cost components) : Only supply of Goods
3. Past Project Experience
Commercial Experience Criteria for Goods:
For experience, the order(s) executed by the bidder, during the last five years ending on the last day of the
month immediately preceding the month in which the last date of bid submission falls, should be
considered as under:
Three orders each executed for “similar item” Supply of CS/SS/AS Fittings in any Hydrocarbon/Chemical/
Fertilizer/Steel and power industry where executed value is not less than the amount equal to Rs. 308998.
OR
Two orders each executed for “similar item” Supply of CS/SS/AS Fittings in any Hydrocarbon/Chemical/
OR
One order executed for “similar item” Supply of CS/SS/AS Fittings in any Hydrocarbon/Chemical/
FOB/FCA/FOR Dispatch point price (inclusive of P&F, if any) shall be considered for arriving at the executed
order value. However, in case any other cost component like TPI charges, Freight charges, Taxes & Duties
etc. are not indicated separately and are already included in the Purchase Order Value, as evident from the
submitted Purchase order copies, then executed order value shall include such inclusive cost components
also for the purpose of PQC evaluation.
Last date of order execution may fall in the above mentioned period i.e. within last five years ending on
the last day of the month immediately preceding the month in which the last date of bid submission falls
without considering any extensions.
Foreign Orders in currency other than USD shall be converted to USD on the date of the said Purchase

Order.
4. Inspection
THIRD PARTY INSPECTION for IOCL:
Goods and Services shall be subjected to stage wise and final inspection by any of the IOCL approved
Third Party Inspection (TPI) agency 1. M/S ABS INDUSTRIAL VERIFICATION (INDIA) PVT. LTD. 2. M/S APAVE
ASSESSMENTS INDIA PVT LTD. 3. M/S BUREAU VERITAS (INDIA) PVT. LTD. 4. M/S CERTIFICATION
ENGINEERS INTERNATIONAL LTD. 5. M/S INTERNATIONAL CERTIFICATION SERVICES PVT. LTD. 6. M/S
INTERTEK INDIA PVT LTD. 7. M/S LLOYDS REGISTER MARINE AND INSPECTION. 8. M/S MEENAAR GLOBAL
CONSULTANTS LLP. 9. M/S PROJECTS AND DEVELOPMENT INDIA LTD. (PDIL) 10. M/S QUALITY EVALUATION
AND SYSTEMS TEAM PVT LTD. 11. M/S SGS INDIA PVT LTD. 12. M/S TATA PROJECTS LTD. 13. M/S TUV INDIA
PVT LTD. 14. M/S TUV REHIENLAND INDIA PVT LTD. 15. M/S VCS QUALITY SERVICES PRIVATE LTD., and TPI
charges are included in quoted prices, and no additional charges shall be paid by Owner.
It will be bidder’s responsibility to arrange for third party inspection and submit the third party inspection
release note on time. No time extension shall be allowed by IOCL for any delay/lapse in this regard.
Quoted prices are:
i. i) Inclusive of charges for all facilities required for testing and all inspection requirements specified
in the technical specifications and documents enclosed with the TENDER inclusive of destructive
testing charges (if any),all expenses like travel, incidental and fees payable to third party
inspectors.
ii. ii) Inclusive of all IBR/IGC/NACE/Radiography charges as per IOCL’s technical specifications and the
documents enclosed with the TENDER.
iii. iii) All built in import content (if applicable) shall also be subjected to inspection by any of IOCL
approved TPI agency, in the country of origin of the import content, and charges for the same are
included in quoted prices, and no additional charges shall be paid by Owner.

A. Note for commercial experience criteria:
(1.0)For fulfilling the commercial experience criteria any one of the

following documents may be considered as valid proof for meeting
the criteria:
{1.1}Purchase Order copy along with Invoice(s) with self-
certification by the bidder that supplies against the invoices
covering the “similar order” have been executed to the required
value.
{1.2}Purchase Order copy along with Bank Certificate indicating
payment against the PO.

{1.3}Execution certificate by client with order value. Goods
Receipt Note (GRNs) in case where IOCL is a client.
{1.4} Any other valid document acceptable to IOCL, Decision of
IOCL on acceptance of execution proof shall be final and binding on
the bidder.
(2.0)A Company (bidder) shall not be allowed to use the credentials
of its parent or any group company to meet the Experience
Criteria. Offer from Consortium will not be acceptable unless stated
otherwise elsewhere in the tender document.
(3.0)Bidder should note that submission of authentic documents is
the prime responsibility of the bidder. Wherever IOCL has concern
or apprehension regarding the authenticity / correctness of any
document, IOCL reserves the right of getting the documents cross
verified from the document issuing authority.
(4.0)Notwithstanding any other condition / provision in the tender
documents, bidders are required to submit complete documents
pertaining to COMMERCIAL EXPERIENCE CRITERIA along with their
offer. Failure to meet the COMMERCIAL EXPERIENCE CRITERIA will
render the bid to be summarily rejected. IOC reserves the right to
complete the evaluation based on the details furnished by the
bidder, with or without seeking any additional supporting
documents / clarifications. Bidder’s representation on the same will
not be considered.
(5.0) Verification of authenticity of documents shall be done for the
successful bidders. Once the L-1 bidders are established, their
documents shall be verified from respective Client and contract
shall be awarded once verification is complete. In case, if contract
is awarded pending verification of documents, payment for the
awarded contract shall be released only after verification of
documents is completed. All bidders are requested to submit the
details of their clients in their bid

B. Other Conditions:
i. Clarification after tender opening:
1. Deviation to Gem Terms and conditions including delivery

period, payment terms etc shall not be accepted. No further
clarification may be sought for the same. Bidder’s
representation may not be considered once bidder has been
rejected for the same.
2. If clarification w.r.t. deviations / compliances is sought from
bidder during the tender and bidder does not withdraw the
deviations /comply or does not reply, Bidder’s offer is liable
for rejection. Bidder’s representation on this matter may not
be considered as the bidder has already been offered ample
opportunity to comply with the provisions.
ii. Clarification before tender opening:
1. For any clarification prior to opening of tender, kindly use

representation facility provided by GeM

Disclaimer
The additional terms and conditions have been incorporated by the Buyer after approval of the Competent
Authority in Buyer Organization. Buyer organization is solely responsible for the impact of these clauses on the
bidding process, its outcome, and consequences thereof including any eccentricity/restriction arising in the
bidding process due to these ATCs and due to modification of technical specifications and/or terms and
conditions governing the bid. Any clause incorporated by the Buyer such as demanding Tender Sample,
incorporating any clause against the MSME policy and Preference to make in India Policy, mandating any Brand
names or Foreign Certification, changing the default time period for Acceptance of material or payment timeline
governed by OM of Department of Expenditure shall be null and void and would not be considered part of bid.
Further any reference of conditions published on any external site or reference to external documents/clauses
shall also be null and void. If any seller has any objection/grievance against these additional clauses or
otherwise on any aspect of this bid, they can raise their representation against the same by using the
Representation window provided in the bid details field in Seller dashboard after logging in as a seller within 4
days of bid publication on GeM. Buyer is duty bound to reply to all such representations and would not be
allowed to open bids if he fails to reply to such representations. Also, GeM does not permit collection of Tender
fee / Auction fee in case of Bids / Forward Auction as the case may be. Any stipulation by the Buyer seeking
payment of Tender Fee / Auction fee through ATC clauses would be treated as null and void.
This Bid is also governed by the General Terms and Conditions
In terms of GeM GTC clause 26 regarding Restrictions on procurement from a bidder of a country which shares a land border with India, any bidder from a country which
shares a land border with India will be eligible to bid in this tender only if the bidder is registered with the Competent Authority. While participating in bid, Bidder has to
undertake compliance of this and any false declaration and non-compliance of this would be a ground for immediate termination of the contract and further legal action
in accordance with the laws.
