NEGOTIATION AGREEMENT.
Brief set of facts of the dispute:
1. Mr. Venkatesh is aged about 65 years. He had come to Bangalore to stay with his son
Ganesh who works at BBMP. On January 26th 2017 at about 9.00 PM Mr. Ganesh and Mr.
Venkatesh were trying to cross road near Yeshwanthpur railway station. Mr. Ganesh crossed
the road thinking that his father is following him but his father could not follow him and
under fear he stood in the middle of the road.
2. Mr. Sandeep, a college student, returning from his friend’s birthday party on his sports bike,
came and hit Mr. Venkatesh.
3. Mr. Venkatesh suffered head injury and his right leg got fractured. He was admitted to
Apollo Hospital by Mr. Ganesh with the help of Mr. Sandeep. Hospital demanded for
25000/- advance deposit and same was given by Mr. Sandeep’s father Mr. Paramesh, who is
an industrialist.
4. After initial treatment he was shifted to District Hospital, where he had to remain as in
patient for two months. Now he is discharged from hospital but he could not attend his daily
routine without the assistance of his son.
5. Mr. Ganesh filed suit for compensation of 10 lakh against Mr. Sandeep. Now parties have
decided to settle their dispute through Negotiation.

Party A: Mr. Ganesh (An employee at BBMP)
Party B: Mr. Sandeep (A college student)

Claims and Demands of the Parties to the Dispute


Financial Claim: Mr. Ganesh has filed the suit against Mr. Sandeep for the compensation amount
of 10 Lakh.

1. Collaborative style: ‘I win- You win’
Both parties have understood the situation, objectives of each other and have come up with long
lasting solution. The decision was collaboratively taken because Mr. Sandeep did not want any
criminal charges to be put against him as that would have caused a black dot in his career and he
also had his exams to be attended in upcoming month and even Mr. Ganesh was ready to give an
undertaking that he will refrain himself from filing criminal case if the compensation was paid.
We have successfully through collaborative approached found the best solution for the dispute.
2. Compromise style: ‘I lose some and win some or You lose some and win some’
We started with the collaborative style of negotiation, but in order to reach a favorable agreement
we later adopted the compromise approach. Wherein, Mr. Ganesh compromised the
compensation amount from 10 Lakh to 7.5 Lakh due to the financial condition of Mr. Sandeep
specially during Covid Pandemic. And Mr. Sandeep who was ready to pay 3 Lakh along with
appointing a Nurse to Mr. Venkatesh came up with an offer of paying 7.5 Lakh.
Mr. Ganesh also compromised not to file any criminal charges against Mr. Sandeep as per
section 279 of IPC.

Terms of the settlement:


1. Compensation amount of 7.5 Lakh to be paid by Mr. Sandeep to Mr. Ganesh with fifteen
days from date of negotiation.
2. Mr. Ganesh will appoint a Nurse to assist his injured father from the amount of
compensation he receives from Mr. Sandeep.
3. An undertaking is given by Mr. Ganesh that he will refrain himself from filing any
criminal charges against Mr. Sandeep.
